HomeMy WebLinkAboutOrdinances_2378_CCv0001.pdf ORDINANCE NO. 2378 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING TITLE 17 AND TITLE 18 OF THE REDLANDS MUNICIPAL CODE BY ADOPTING ZONING ORDINANCE TEXT AMENDMENT NO. 259 RELATING TO SOCIO-ECONOMIC COST/BENEFIT STUDIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: SECTION ONE: Chapter 17.08.020, entitled Planning Commission - Advisory Agency Powers and Duties, of the Redlands Municipal Code shall be amended to read as follows: 17.08.020 Planning Commission - Advisory Agency powers and duties. The Planning Commission is hereby made the Advisory Agency of the City Council on the review of tentative subdivision maps and shall hold a noticed public hearing and file a written report of its recommendations with the City Council. The City Council shall hold a noticed public hearing on the application and approve, conditionally approve, or disapprove the tentative subdivision map. The Council shall deny approval of a tentative subdivision map if it can make any of the findings contained in Section 17.36.050 of this Chapter. SECTION TWO: Chapter 17.080.025, entitled Socio-Economic Cost/Benefit Study and Findings Required, is hereby added to the Redlands Municipal Code to read as follows: 17.08.025 Socio-Economic Cost 1 Benefit Study and Findings Required All tentative subdivision maps shall be required to submit a socio-economic analysis and cost I benefit study, which shall also be included in all environmental documents submitted, to the extent permitted by law, identifying the source of funding for necessary public infrastructure and reflecting the effect of such development on the City, as part of the application process. The City Council shall publish notice of and hold at least one public hearing at which the public may appear and be heard to consider the socio-economic cost/benefit study. Approval of the development project shall only occur if the socio-economic study finds and determines to the satisfaction of the City Council that the development project 1) will ORDINANCE NO. 2378 PAGE NO. 1 not create unmitigated physical blight within the City or overburden public services. including without limitation the sufficiency of police and fire protection, and 2) the benefit of the development project to the City outweighs any direct cost to the City that may result. The City Council may, however, approve a development project for which the socio-economic study fails to make the required findings or determinations if the City Council finds and determines upon a 4/5ths vote of its total authorized membership that the benefits to the City from the development project outweigh the negative socio-economic effects that may result. SECTION THREE: Chapter 18.12.200, entitled Socio-Economic Cost/Benefit Study and Findings Required, is hereby added to the Redlands Municipal Code to read as follows: 18.12.200 Socio-Economic Cost 1 Benefit Study and Findings Required. A. Every development project proposal requiring a General Plan Amendment, Zoning Amendment, Specific Plan, or for Conditional Use Permits and Commission Review and Approvals involving structures and related outdoor uses larger than 5.000 square feet (calculated on a cumulative total of the structure and / or use and excluding parking areas required for the use), shall submit a socio-economic analysis and cost / benefit study, which shall also be included in all environmental documents submitted, to the extent permitted by law, identifying the source of funding for necessary public infrastructure and reflecting the effect of such development on the City, as part of the application process. The City Council shall publish notice of and hold at least one public hearing at which the public may appear and be heard to consider the socio-economic cost benefit study. Approval of the development project shall only occur if the socio-economic study finds and determines to the satisfaction of the City Council that the development project 1) will not create unmitigated physical blight within the City or overburden public services.. including without limitation the sufficiency of police and fire protection. and 2) the benefit of the development project to the City outweighs any direct cost to the City that may result, The City Council may, however, approve a development project for which the socio-economic study fails to make the required findings or determinations if the City Council finds and determines upon a 4/5ths vote of its total authorized membership that the benefits to the City from the development project outweigh the negative socio-economic effects that may result. In addition to the aforesaid findings. the Council shall in granting approval of a project, make the required findings specified in this Title for the land use application(s) under review. B. Development projects that directly further the primary institutional purposes of churches. hospitals, schools (including private schools and universities), and ORDINANCE NO. 2378 PAGE NO. 2 p organizations such as the YMCA and YWCA. on sites held by such entities as of March 1 . 1997, are exempt from the provisions of subsection A requiring a socio- economic study so long as such development projects are either 1) non-residential in character, or 2) provide only dormitory. staff housing, or senior congregate care facilities for those exempt entities. C. In addition to the above exemptions, applications initiated by the City of Redlands, such as General Plan Amendments. Municipal Code Text Amendments, Zone Changes, Specific Plan Amendments. or similar actions, shall be exempt from a socio-economic cost/benefit study. SECTION FOUR: Chapter 18.192.180, entitled Socio-Economic Cost/Benefit Study and Findings Required, is hereby added to the Redlands Municipal Code to read as follows: 18.192.180 Socio-Economic Cost 1 Benefit Study and Findings Required. Projects subject to a Socio-Economic Cost / Benefit Study requirement. as determined in Section 18.12.200. shall be reviewed by the City Council at a noticed public hearing to approve. conditionally approve. or disapprove the application. The Council in granting approval of a Conditional Use Permit shall make the findings contained in Section 18.192.070 of this Chapter. Prior to City Council review. the application shall be reviewed by the Planning Commission at a noticed public hearing and a written report of its recommendation shall be filed with the City Council. SECTION FIVE: The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in the Redlands Daily Facts.. a newspaper of general circulation within the City, and thereafter. this ordinance shall take effect in accordance with law.
