HomeMy WebLinkAboutOrdinances_2287_CCv0001.pdf ORDINANCE NO. 2287 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTERS 13.64, 13.72, 13.76 AND 13.80 OF THE REDLANDS MUNICIPAL CODE RELATING TO SOLID WASTE COLLECTION WHEREAS, the City of Redlands ("the "City") is mandated by the California Integrated Waste Management Act of 1989("AB 939"),to reduce the volume of solid waste disposed in landfills by 25 percent by the year 1995, and by 50 percent (or as much as feasible) by the year 2000, and the City Council has determined that it is desirable to make adequate provisions for meeting these goals; and WHEREAS, AB 939 requires jurisdictions to make efforts to maximize use of source reduction, recycling, and composting, to meet these goals; and WHEREAS, planning information contained in the City's Source Reduction, Recycling Element identifies greenwaste as a type of solid waste which comprises 22 percent of the residential waste stream; and WHEREAS, the City currently operates a single-family residential separated greenwaste collection program for approximately 2200 households; and WHEREAS, based upon information presented to the City Council by the Solid Waste Division staff, the City Council has determined that it is desirable to expand the separated greenwaste collection City-wide to facilitate meeting the goals of AB 939; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS: Sect Qa 1. Section 13.64.105 is hereby added to the Redlands Municipal Code to read as follows: 13.64.105 Greenwaste defined. 'Greenwaste' means yardwaste, including grass cuttings, prunings, tree branches, leaves, wood, sawdust, and other discarded plant material from private and/or public areas. It does not include palm fronds, cactus, or tree limbs or stumps larger than six inches in diameter." DJM535LE 6 Section 2.: Section 13.72.010 of the Redlands Municipal Code is hereby amended to read as follows: "13.72.010 Purpose. For the purpose of regulating the collection of solid waste, greenwaste, and recyclables in the City, the rules and regulations set out in Chapters 13.54, 13.68, 13.72, 13.76, and 13.80 shall be observed." Section 3. Section 13.72.245 is hereby added to the Redlands Municipal Code to read as follows: "13.72.245 Prohibited substances -greenwaste. No glass, paper, plastic, razor blades, metal, chemicals or other substances rendering such greenwaste unfit for the consumption of animals or production of soil amendments or compost shall be mixed therewith." Section 4. Section 13.72.250 of the Redlands Municipal Code is hereby amended to read as follows: "13.72.250 Tagging of containers in noncompliance. A. If the provisions of this Chapter are not fully complied with, the collector shall place a tag on the container so stating. No collection shall be made until the provisions of this section are complied with. A collection service for tagged containers may be subject to additional trip or service charges. B. All households participating in the greenwaste collection program shall place all greenwaste within the designated greenwaste container. Greenwaste containers that are contaminated with anything that is not greenwaste will not be collected." Section 5. Section 13.72.270 of the Redlands Municipal Code is hereby amended to read as fellows: "13,72.270 Frequency of collection -residential. All residential units shall be collected a minimum of once a week, and all solid waste, greenwaste, and recycables shall be removed from the premises and disposed of in such a manner as not to become a nuisance, menace, or danger to public health." WMf53 SLE t ,ion 6. Section 13.72.300 of the Redlands Municipal Code is hereby amended to read as follows: "13.72.300 Transportation of greenwaste. Greenwaste may be transported by the occupant or a person hired by the occupant, if authorized by the Solid Waste Manager." Section 7. Section 13.76.035 is hereby added to the Redlands Municipal Code to read as follows: "13.76.035 Residential containers - greenwaste. Residential units serviced by the automated system may select either a 60 gallon or 90 gallon automated container and shall be charged in accordance with the solid waste rate schedule (Title 3, Chapter 3.66, Section 3.66.040). Any owner or occupant who requires additional automated containers for greenwaste or household collection may request so, with additional charges in accordance with such solid waste rate schedule." Swim 8. Section 13.80.050 of the Redlands Municipal Code is hereby amended to read as follows: "Section 13.80.050 Exemption from service. Any owner of a single family residential property may claim exception from any fee imposed by this Chapter on the basis that no solid waste,garbage, rubbish, ashes, or greenwaste, shall be placed or offered for collection by the City from such property. The Solid Waste Manager shall exempt such property from participation; provided, that any such statement or representation must be made in affidavit form, fully sworn to by the person making such statement or representation and fled with the Solid Waste Manager. Such exception shall be valid only for the time that the representation or statements made in such affidavit continue to be true. Any violation of provisions of the exemption shall result in reinstatement of full participation for the entire current period with no further exemption permitted."
