AN ORDINANCE OF THE CITY OF DLANDS AMENDING CHAPTER 3.66 OF THE
REDLANDS MUNICIPAL CODE RELATING TO RATES AND CHARGES FOR THE
CITY'S SOLID WASTE SERVICE
WHEREAS, pursuant to Section 3.66.030 of the Redlands Municipal Code, the City
imposes rates and charges to lund the cost of providing solid waste, green waste and recycling
services;and
WHEREAS, by its Ordinance Nos. 2729 and 2730, adopted in 2010, the City Council of
the City of Redlands(the"City Council") adopted a schedule of rates and charges that fairly and
equitably spread identified costs of providing solid waste, green waste and recycling services
across different service classes;and
WHEREAS, the City has restudied its costs of providing solid waste, green waste and
recycling services, and has determined that the budgets used as the basis for the 2010 rates did
not fully include all costs associated with providing these services, and
WHEREAS, the City has developed a revised schedule of rates and charges that will
recover the full costs of service while maintaining the proportionality of the 2010 rates; and
WHEREAS, on October 5, 2012, following the procedures required by Section 6 of
Article XIII D of the California Constitution, the City mailed notice of a public hearing on the
revised rates and charges; and
WHEREAS,on November 20, 2012,at the time and place set forth in the notice of public
hearing, the City Council held a full and fair public hearing at which it heard and considered
oral and written testimony regarding the revised schedule of rates and charges; and
WHEREAS, written protests against the revised rates and charges were not submitted
with respect to a majority of the parcels subject to the revised schedule of rates and charges; and
WHEREAS, the City Council desires to adopt the revised schedule of rates and charges
as set forth in the notice of public hearing;
THE CITY COUNCIL OF THE CITY OF DLANDS DOES ORDAIN AS
FOLLOWS:
Section 1. The City Council finds that the forgoing recitals are true and correct-
Section 2- Section 3.66.040 of the Redlands Municipal Code is hereby deleted in its
entirety and is amended to read as follows:
"RATES AND CHARGES: The amounts of bi-monthly solid waste rates applicable to
residential and non-residential properties shall be set forth in the below tables. Solid Waste
customers who possess local mutual water company stock shall receive a monthly bill for solid
waste service,and the monthly solid to rates for such customers shall be fifty percent(50%)
of the amounts of the bi-monthly rates.

Section 3. The City Council finds and determines as follows:
A. The rates and charges set forth in this Ordinance are imposed solely for the purpose
of finding the City's costs of providing solid waste, green waste and recycling
services.
B. Proceeds of the rates and charges will not be used for any purpose other than
providing solid waste, green waste and recycling services. To the extent solid waste,
green waste and recycling operations make use of municipal resources (such as
administrative resources) or cause wear to municipal infrastructure (including street
pavement), rates and charges may be used to fund the portion of costs or of
infr-astructure repair, maintenance or reconstruction associated with providing solid
waste,green waste and recycling services.
C. Revenues derived from the rates and charges will not exceed the amount required to
provide solid waste, green waste and recycling services, as described in subdivision
(B)of this Section.
D. The amount of the rates and charges imposed upon any parcel or person as an
incident of property ownership will not exceed the proportional cost of the service
attributable to the parcel or person.
E. Rates and charges are imposed only for services that are actually used by, or
immediately available to, a parcel or customer.
F. The rates and charges will not fund general government services and will fund only
costs associated with (or necessitated by) the provision of solid waste, green waste
and recycling services.
Section 4. This Ordinance, and the rates set forth herein, shall be effective February 1,
2013.
Section 5. The City Council finds and determines that the adoption of this Ordinance is
exempt from review under the California Environmental Quality Act C'CEQA7) pursuant to
Public Resources Code section 21080(b)(8) and state CEQA Guidelines section 15273 which
provide that CEQA is not applicable to the restructuring of rates and charges approved by a
public agency for the purpose of meeting operating expenses.
Section 6. The City Clerk shall certify to the adoption of this ordinance and cause it, or a
summary of it to be published once in the Redlands Daily Facts, a newspaper of general
circulation printed and published in this City.
