HomeMy WebLinkAboutOrdinances_1625_CCv0001.pdf ORDINANCE NO. 1625 AN ORDINANCE OF THE CITY OF REDLANDS PROVIDING FOR ADEQUATE DRAINAGE FACILITIES, PROVIDING FOR EXEMPTION OF CERTAIN STORM DRAINS , PROVIDING FOR RELIEF UNDER CERTAIN CIRCUMSTANCES AND RESCINDING ORDINANCE NO. 1356 AND ORDINANCE NO. 1466 . In order to promote the public health, safety and general welfare and provide for the orderly growth and development of the City in har- mony with the physical aspects of the City; provide for the conservation, stabilization and protection of the value of property; provide adequate drainage facilities for the protection of life and property; the City Council of the City of Redlands does ordain as follows : SECTION ONE: Ordinance No. 1356 and Ordinance No. 1466 are hereby rescinded. SECTION TWO: The City Council of Redlands hereby assumes control of the design and improvement of land subdivisions of property, as such power is vested in the City by the provisions of the Subdivision Map Act of the State of California, Division 4, Part 2, Business and Pro- fession Code of the State of California, and amendments thereto. It is hereby made unlawful for a subdivider, person, firm, corporation, part- nership or association to sell or offer to sell , or lease any lands within a subdivision, or property split, until the subdivider, person, firm, corporation, partnership or association shall have first conformed to the requirements of said Subdivision Map Act and the provisions of this ordinance (Amended 1963 - Ord. 1231) . SECTION THREE: Any drainage channel passing through or adajcent to any parcel of land being proposed as a subdivision, lot split, or building site shall have said channel enclosed by a conduit consisting of reinforced concrete pipe or reinforced concrete structure in ac- cordance with Comprehensive Storm Drain Plan No. 4 of the San Bernardino County Flood Control District, Zone 3 . Said channel shall be constructed to withstand all anticipated external loadings and shall be built in an area where the conduit is accessible dor maintenance with motorized equipment. SECTION FOUR: The Reservoir Storm Canyon Drain, located on the northeasterly side of Redlands Boulevard between Fern Avenue and Ford Street, and the Mill Creek Zanja Drain, for its entire length within the City of Redlands, shall be exempt from the provisions of this section. SECTION FIVE: The Advisory Committee established pursuant to Ordinance No. 1447 may waive the requirements of this ordinance provided the committee unanimously finds that construction of the drain is not feasible, and such waiver will not adversely affect the health, safety and welfare of the public. Decisions of the Advisory Committee may be appealed to the City Council by the applicant. Appeals shall be filed in writing with the City Clerk not less than five days prior to Council meeting date at which the appeal is to be considered. SECTION SEVEN: The City Clerk shall certify to the adoption of this ordinance and cause the same to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in this city.
