ORDINANCE NO. 1665
AN ORDINANCE OF THE CITY OF REDLANDS CREATING A PLANNED
LOCAL DRAINAGE FACILITIES FUND AND PROVIDING FOR THE PAYMENT
OF FEES FOR STORM WATER DRAINAGE FACILITIES CONSTRUCTION AS A
CONDITION OF LAND DEVELOPMENT.
In order to promote the public health, safety and general
welfare; provide for the orderly growth and development of the
city in harmony with the physical aspects of the city; provide
for the conservation, stabilization and protection of the value
of property and provide adequate drainage facilities for the
protection of life and property; the City Council of the City
of Redlands does ordain as follows :
SECTION ONE: That the need for additional drainage facilities
throughout the City of Redlands has been clearly demonstrated in
Comprehensive Storm Drain Plan No. 4 prepared for Zone 3 of the
San Bernardino County Flood Control District.
SECTION TWO: That the entire City of Redlands is hereby
designated to be a single local drainage area .
SECTION THREE: That there is hereby created a Planned Local
Drainage Facilities Fund as provided for in the Subdivision Map
Act of the State of California . Monies in said Fund shall be
expended solely for the design and construction of local drainage
facilities within the city.
SECTION FOUR: That there is hereby imposed a drainage fee on
all land development within the City of Redlands . The amount and
payment schedule for said fee shall be established by resolution
of the City Council . All drainage fees collected shall be deposited
in the Planned Local Drainage Facilities Fund.
SECTION FIVE: That all monies in the Planned Local Drainage
Facilities Fund not immediately required for construction purposes
shall be invested in a manner provided by law in the State of
California and all interest paid for such investment shall accrue
to said Fund.
SECTION SIX: That developments which require construction of
drainage facilities in excess of 30-inches in diameter as a condition
of approval shall be granted a credit toward required fees. Such
credit shall apply only if construction is accomplished in accordance
with Comprehensive Storm Drain Plan No . 4 and shall equal the re-
quired fee or construction cost whichever is lower.
SECTION SEVEN: That this ordinance shall be in force and take
effect as provided by law.
SECTION EIGHT: That the City Clerk shall certify to the
passage of this ordinance and shall cause the same to be published
once in the Redlands Daily Facts, a daily newspaper hereby designated
for that purpose .
