HomeMy WebLinkAboutOrdinances_2167_CCv0001.pdf ORDINANCE NO. 2167 AN ORDINANCE OF THE CITY OF REDLANDS ADDING CHAPTER 5 . 96 OF THE REDLANDS MUNICIPAL CODE TO ESTABLISH A STREET SWEEPING FEE WHEREAS, the City Council of the City of Redlands (this "City Council") has determined that residential and nonresidential property within the City should pay a fee to defray the cost of street sweeping and non-point source pollution control services provided to all residential and nonresidential areas within the City; and WHEREAS , this City Council has determined, based on reports from staff, that streets abutting certain nonresidential uses are swept more often than residential streets to account for increased garbage and non-point source pollution generation due to commercial and other nonresidential uses; and WHEREAS, this City Council has determined that all properties within the City receive benefit from having clean streets within the City through a City-wide street sweeping and non-point source pollution control program; and WHEREAS, the revenues generated by this fee do not exceed the reasonable cost of providing the street sweeping and non-point source pollution control services funded by this ordinance; and WHEREAS , notice of the public hearing on the adoption of the proposed fee has been provided in accordance with Government Code Section 66018 ; NOW, THEREFORE, be it ordained by the City Council of the City of Redlands as follows: Section 1 . Chapter 5 . 96 shall be added to the Redlands Municipal Code to read as follows: "Chapter 5 . 96 Street Sweeping Fee Section 5 . 96 . 010 Street Sweeping Fee Section 5 . 96. 020 Collection of Street Sweeping Fee Section 5 . 96. 030 Use of Street Sweeping Fee Section 5 . 96. 010 Street Sweeping Fee A. A Street Sweeping Fee as provided in this Chapter shall be paid by all developed property within the City. B. The Street Sweeping Fee shall be in the following amounts: 1 . Residential : $25. 32 per year per dwelling unit. 2 . Nonresidential : Based on water meter size in accordance with the following tables: (a. ) For nonresidential areas swept on a two times per month schedule: Water Meter Size Annual Rate up to 1" diameter $25. 32 1 . 5" to 3" diameter $45 . 60 4" to 10" diameter $147 . 60 (b. ) For nonresidential areas swept on an eight times per month schedule: Water Meter Size Annual Rate up to 1" diameter $101 . 28 1. 5" to 3" diameter $182 . 40 4" to 10" diameter $590. 40 Section 5 . 96 . 020 Collection of Street Sweeping Fee The Street Sweeping Fee shall be collected in the same manner as , and along with, the City's monthly water service charges. Section 5. 96.030 Use of Street Sweeping Fee. The Street Sweeping Fee shall be used by the City to defray the cost of sweeping, litter abatement and non-point source pollution control on public and private streets and storm drain systems within the City. " Section 2 .
