AN ORDINANCE OF THE I p REDLANDS ESTABLISHING THE REGULATION
OF EXCAVATIONS AND FILLS FOR ANY LOT, SUBDIVISION OR PARCEL OF GROUND
The City Council of the City of Redlands does ordain as followsll
SECTION 1, 00 INTENT AND PURPOSE
The purpose of this Ordinance is to safeguard life health, limb, pro-
perty and the public welfare by regulating and controlling the design,
construction, t of materials, and location of all buildings d
structures erec ted: or to be erected. and certain grading within the City
of Redlands,
In adopting this Ordinance, the City Got ell declares the regulations and
standards established herein to be the reasonable re u.la.tlons necessary
for the protection of health, safety and general elf.°a.re
SECTION 1�01 SCOPE
No person shall, do any grading not in compliance with this Code. If two;
or more provisions of this Cede, and any other applicable law, are in
conflict, that which provides the greatersafety- shall are°v :rlp
SECTION 1,02. DEFINITIONS
For the purposes of this Ordinance, the following terms shall be defined
as follows �
, Building Pad a relatively flat site which is designed to be
occupied by buildings and is prepared: by artificial me :ns
including r°adin ,, excavating, f'"ill,ln , or any combination
thereof.,
City - The City of Redlands ,, California
Cuilding Official - The Superintendent of Building and: Safety
of the City of Redlands
Developer person,, persons or corporation developing or
contemplating the development of land tth°ln the City for any
use whatsoever,
Excavation - Excavation shall mean any act by which earth,
sand., gravel, rock or any other similar mater~:ta.l, is out into
dig, quarried, uncovered, removed, displaced or relocated,
and shall Include the conditions resulting therefrom
.,, Fill Fill shall meart any act by whichearth, sand, gravel
neck or any others similar material is deposited, placed ,
pushed, pulled or transported to a place ether; than the place
from which it was excavated , or any material that has been
loosened or disturbed from :its natural state where it was
deposited b evolution of geological processes,,
G. Grading - Grading shall can excavation or fill or any combi-
nation theneof and shall include the conditions resulting from
any excavation or fill.
11. Grading Plan - A plan or map showing the property boundaries,
existing contours and proposed final grades resulting from
grading operations,
K Soils Engineer - A Civil Engineer, registered in the State of
California, with a specialty and experience in the analysis
of as .a
J. Engineer - A Civil Engineer, registered in the State of Cali-
fornia, experienced in the field of land development , grading
and drainage.
V Contractor - Any person properly licensed by the State of
California to perform work as described in thIs ordinance.
SECTION 1.03 PROCEDURES AND RESPONSIBILITY
A. It all be the responsibility of the Devalop er, Engineer,
Contractor or Owner to obtain the servtces of a Soils Engineer.
M Whenever the te=5 "written certification" , "approved in writing'' ,
"specified In w3°'lting4 , "confIrm in writtng4 , etc . , are used in
this Ordinance , it shall be required that the Soils Engineer
prepare such written documentation and that a copy, signed by
the soils Engineer, of said documentation be forwarded immedia-
tely upon completion to ,�

State or Federal Law,
SECTION 1.o4 PERMIT REQUIRED
A permit from the Building and SafetyDivision is hereby required, be-
fore the commencement of any physical work to raise or lower the exist-
ing grade of any lot, or for any excavation or fillxng which changes the
grade of the natural slope of the surface of any lot so that it will not
take natural runoff of water from adjacent lot or lots as before the
excavation or filk or so that the surface drainage of the lot is con-
centrated or collected and discharged onto another lot in a different
location or in greater quantity, or at an accelerated rate, or in such
a way that it will probably result in damage, or in a way that creates
a hazard to the public health, safety, or public property, or to such
extent that the excavation or filling will require or be accompanied by
the hauling of earth or other material over any public street in a ve-
hicle with a gross weight of vehicle and load in excess of that permitted
by law or ordinance of the City, Any permIt issued hereunder shall be
valid for a period not to exceed one (1) year, Unless the earth move-

ment is commenced within one hundred eighty (180 ) days after the is-
suance of the permit , such permit shall expireand if such earth
movement after being started, shad cease for a period of ninety ( `
days , said permit shall expire unless renewed.
SECTION 1�05 EXCEPTIONS
The following are specifically excepted from the provision of this
Ordinance , but this exception sha.lnet effect the applicability of
any provisions hereof to any f"ill rade with the matr;tal of such ex-
cavation;

or not exceeding one foot in depth,.

by a. valid building permit which has been 1., ued by the City.

SECTION i.,o6 FILING OF MAP OF PROPOSED A 'MOVEMENT
Prior to commencement of work there shall he submitted.
A. A finished grading pian prepaied by the Un4 ine r showing the
present contours extended a, reasonable ci L tance beyond the
perimeter of the land and the proposed: final grades. The
proposed final grades shad indicate leanly cuts, fills , an
slopes,, Estimated dates for starting andcompleting the wart
shall be stated,
B, A written. report shalt be -submitted by the Solils Engineer.,
The report shall indicate the type< of a i1 the unit founda-
tion boaring .values for the proposed construction, and: include
any pertinent data or opinion as to slopes which may be safely
constructed,
Details of drainage structures, walls, c _'o bbin , surface
protection and landscaping that will be constructed or in-
stalled on the site.
SECTION �07 STANDARDS FOR EXCAVATION AND FILLS

Maximum Height of Slopes-
No coat or fill slopes shall be constructed, over thirty-five
( feet in height unless the Building Official is furnished
evidence by a written; report from a Soils Engineer that such
slopes will be stable w1th a factor of safety at least one

C. Drainage, General
All drainage e provisi ons shall be of such design as to carry-
surface waters to the nearestpractical street, storm drain,
r natural water-course, or a ;safe place to deposit and re-
ceive

design as not to endanger the health and safety' or any'
property, either private or public ,

Where shall be at least eine ( ) teras..e not less than five (
feet in -width constructed in every fill slope greater than
thirty-five (. feet in height or in cut slopes where the

SECTION 1,, 08 COMPACTION OF FILLS
The Soils Engineer shall control the compaction ef" all fill
and shall certify that the completed f"113 meets the compaction
requirements oaf® this Ordinance.
SECTION 1�09 CONSTRTICTION OF CONTROLLED PIU-13
As supervised by the Soils ngin r, the follow,7"Jig shall be used as a
aide for filled areas. For specific projects , it may be necessary to
make adjustments predicated upon the analysis of the material proposed
to be used for, the fill and other conditions pertaining to the project,
d such adjustments may be made upon written recommendation of the
Soils Engineer.
General Description
This item shall consist of all clearing and grubbing, removal
of existing structures, preparation of land to be filled,
filling of the land, spreading, compaction and control of the
fill, and all subsidiary scrip, necessary to complete the gra-
ding
r -sling of the filled areae to conform with the linea, grades
and slopes as shown can the accepted plans.

B. Clearing Grubbing, and preparing Areas to be Filled
1. A.11 timber, logs, trees , brush, objectionable amounts of
vegetable matter, and other rubbish shall be removed from
the site so as to leave the areas free from all; debris.
The surface shall then be plowed or scarified led to a depth
of at least six inches ") , and until the surface is
free from ruts, hummocks or other uneven features which
would tend to prevent uniform compaction by the equipment
to be u ed
Where fills are made on hillsides or, adjacent to slope
greater than one l vertical to three ( horizontal,
steps of benches ,shall be cut into firm and/or fully com-
pacted

eg n 4. After the foundation, for the fill has been: cleared, plowed,
or scarified, it shall be d.f.a ed or bladed., until if is uni-
form and free from large clods -, brought, to the proper
moisture content and compacted in the same manner and to
the same degree as required for the fill material. Said

bance, and in no case shall said depth be :Leas than six

C. Materials
Material for the fill shall consist of ma.terl.a:l approved b

D. Placing, Spreading and. Compacting Fill; Material.

B� Supervision
Sufficient time shall be spent by the Soils Engineer on the
site each: day that fills .re placed or Cather pertinent work
is accomplished to permit the Soils Engineer to certify to
the proper compaction of all fills and to the adherence with
all ether~ requirements of the Ordinance for which he certifies,
F. Seasonal Limit
No fill material shall, be placed, spread or rolled during
unfavorable weather conditions. When the work is interrupted
by heavy rein, fill operations shall not be resumed until
field tests by the Soils Engineer indicate that the moisture
content and density of the fill are satisfactory for resuml2tion

SECTION 1.10 SAFETY PRECAUTIONS
If at any stage of work can an excavation, or fill, the Building Official
determines by inspection that the nature of the formation i such that
further work is likely to endanger any property or public way, the
Building Official may require, as a condition to allowing the pork to
proceed, that such reasonable safety precautions be taken as the Build-
ing Official. considers advisable to avoid such likelihood of danger.
SECTION 1, 11 RELATIONSHIP OF' BUILDINGS TO CUT AND FILL SLOPES
A. Buildings or structures shall be located clear of the toe or
trap of cut or fill, slopes according to the following:
1,. A minimum of three ( feet provided the slope does not
emceed. ten (10 ) feet in height,,
2. One-half (J) the vertical height of shape for shapes
between ten ( 0) feet and twenty ( O) feet in height
with a maximum of ten (lO) feet for any height shape.
B, Conforming slopes twenty ( 'O) feet or macre in vertical height
shall be provided with a designed retaining wall four ( ) feet
,n height above their tae for that portion of the slope paral-
leling any buildings
SECTION ,,1SPO S BILfT` PERMITTEE
Building and grading permits shall be presumed to incorporate the pro-
viso that the applicant, his agent, employees, or contractors shell
carry out the proposed work in accordance with, the approved plans and
with all requirements of the Ordinance and any other :taws or regulations

applicable thereto, whether, specified or not, No approval shall re-
lieve or exonerate any person from the responsibility of complying
with the provisions and intent of this Ordnance,
SECTION 1.12 I C TIONs ON EXCAVATIONSAND FILLS
Inspections on excavations and fills will be performed by the Soils
Engineer.

SECTION l.14 APPROVAL OF WORK BY CITY

J MAINTENANCE OF PROTECTIVE ICE
The owner of any property on whish an excavation or fill has been made pur-
suant t ► the provisions of this Ordinance, or any otherperson or went
in control of such property, ,shall maintain all slopes , retaining wills
cribbing, drainage, structures and other necessary protective devices
for his and adjoining property,
SECTION iei6 OWNER NOT RELIEVED OF RESPONSIBILITY
Compliance with the requirements and conditions of this Ordinance shall

h .11n t he construed to relieve the owner of rea.l property of any legal
duties, obligations or liabilities incident to the ownership of the
property while the work of grading, excavating or filling is in progress,
or after the completion thereof.
SECTION 1-17 CONDITIONSUPON ISSUANCE
In granting any permit der this ordinance,nc theui kiln Official may
attach such additional requirements and conditions thereto as may he
reasonably deemed necessary to protect public or private property or to
prevent the operation from being conducted in s manner hazardous to life
and property r in a manner likely create a nuisance.
