AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS
ALLOWING WAIVER OF PARCEL MAPS FOR CERTAIN SUBDIVISIONS
AND AMENDING SUBDIVISION ORDINANCE NO. 1562
THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain :
SECTION ONE:. Section 6 of Ordinance No. 1562 of the City of
Redlands is hereby amended to read:
Section 6 . MAPS : GENERAL PROVISIONS
A tentative and final map shall be required for all
subdivisions creating five or more parcels , five or
more condominiums, or a community apartment project
containing five or more parcels
Except as provided by Section 28 . 5 of this ordinance,
a tentative and parcel map shall be required for all
subdivisions creating less than five parcels.
SECTION TWO: Section 28. 5 of Ordinance No. 1562 is hereby
added to read:
Section 28 . 5 WAIVER OF PARCEL MAP; FINDINGS REQUIRED
(a) The City Council may waive the parcel map requirement
if.
(1) The Subdivision. Map Act would otherwise require
a parcel map because land is to be subdivided for the pur-
pose of lease; or
(2) The land before subdivision contains less than
five acres, each parcel created by the subdivision will abut
upon a maintained public street or highway, and no dedica-
tions or improvements are required; or
(3) Each parcel created by the subdivision has a gross
area of twenty acres or more and has improved access to a
maintained public street or highway; or
(4) The land consists of a parcel or parcels of land
having approved access to a public street or highway,
comprises part of a tract of land zoned for industrial or
commercial development, and has the approval of the City
Council as to street alignments and widths; or
(5) Each parcel created by the division has a gross
area of not less than forty acres.
(b) Before waiving any parcel map, the Council shall
find that the proposed division of land complies with
all requirements of the City Subdivision Ordinance and.
Redlands Municipal Code Articles 926 , 927 , and 928 as
to area, improvement and design, flood water drainage
control , appropriate improved public roads , sanitary
disposal facilities, water supply availability,
environmental protection , and with all other require-
ments of the Subdivision Map Act. A parcel map waiver
may be conditioned upon dedications and payment of
drainage and other fees.
(c) The City Council shall consider an application
for parcel map waiver within 45 days after its filing.
(d) If a waiver is granted, a certificate of compliance
shall be provided to the applicant , upon payment of a
fee set by resolution , in form suitable for recordation
and describing the real property involved, naming its
owners as shown on the waiver application, stating
that a parcel map waiver has been granted by the Council
and setting forth the date of such waiver.
SECTION THREE: This ordinance shall be in force and
take effect as provided by law.
SECTION FOUR: The City Clerk shall certify to the
adoption of this ordinance and cause ,,it or a summary of it to be
published once in the Redlands Daily, pots, a newspaper of general
circulation printed and published iri/`this city,
