AN ORDINANCE PROVIDING FOR MINOR EXCEPTION
PERMITS FOR PROTECTIVE SWIMMING POOL FENCING
REQUIREMENTS
THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain as
follows :
SECTION ONE: Redlands Zoning Ordinance No . 1000,
Sections 43 . 20 ( c ) ( 1) and ( 2 ) are amended as follows :
'°l . PURPOSE. This Section provides for the
granting of minor exceptions to the fencing
development standards, retaining wall heights ,
solar collectors, grading standards , and the
requirements of Article 847 of the Redlands
Ordinance Code ( fencing of swimming pools ) in
those cases where such minor exceptions are
determined to be warranted by practical
difficulties , unnecessary hardships or results
that , without the minor exception, may be
inconsistent with the intent of the ordinance.
The granting of a minor exception is only
permitted where it is found to pose no threat
to public health and safety and where to grant
such a minor exception would not be
inconsistent with the intent of Section 84700
of the Redlands Ordinance Code .
2 . SCOPE. Minor exceptions pertaining to
garden or retaining wall heights , solar
collector or storage tank installations ,
grading standards , and protective swimming
pool fencing may be granted by a committee
composed of the Community Development Director
or his designated representative , the Building
and Safety Director or his designated repre-
sentative, a Planning Commission member and a
City Council member. "
SECTION TWO: Chapter 84 , Section 84704 of the Redlands
Ordinance Code is amended as follows :
"§84704 . MODIFICATIONS
1 . When an owner of property claims that
special circumstances or conditions applicable
to that property would result in an unreason-
able loss of enjoyment or utility when the
requirements of this Chapter are strictly
applied, the owner may file for a Minor Excep-
tion Permit in accordance with provisions of
Section 43 . 20 of the Redlands Zoning Ordinance.
2 . The application for a Minor Exception
Permit shall be processed in accordance with
Section 43 . 20 of the Redlands Zoning Ordinance,
and the Minor Exception Committee shall, after
reviewing the facts, either grant, grant with
conditions , or deny the application. If a
Minor Exception Permit is either granted or
granted with conditions, the approval shall be
accompanied with a finding of fact that the
degree of protection provided by Article 847
of the Redlands Ordinance Code, and by Section
43. 20 (b) ( 2 ) of the Redlands Zoning Ordinance
will not be reduced by the granted minor
exception. "
SECTION THREE: This section shall be in force and take
effect as provided by law.
SECTION FOUR. The Mayor shall sign this Ordinance and
the City Clerk shall certify to the adoption of this Ordinance and

cause it, or a summary of it to be published once in the Redlands
Daily Facts , a newspaper of general circulation printed and
published in this City.
