HomeMy WebLinkAboutOrdinances_1455_CCv0001.pdf ORDINANCE NO, 1455 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING THE TRAFFIC ORDINANCE SECTION OF THE REDLANDS ORDINANCE CODE AND REGU- LATING THE USE OF MOTOR VEHICLES UPON PROPERTY WITHIN THE CITY OF REDLANDS THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOL- LOWS : SECTION ONE: That the Redlands Ordinance Code be amended by adding Articles 686, 687, 688, and 689 to Chapter 67, as follows: TRAFFIC REDLANDS TRAFFIC ORDINANCE Art. 686 ARTICLE 686 Definitions 68600. WORDS AND TERMS . Certain words and terms used in this Chapter shall have definitions and meanings as follows: (1455) . 1 MOTOR VEHICLES. A motor vehicle is any vehicle which is self-propelled. . 2 MUFFLER, A muffler is a device consisting of a series of chambers or baffle plates or other mechanical design for the purpose of receiving exhaust gas from an internal combustion engine, and effective in reducing noise. . 3 AUTHORIZED EMERGENCY VEHICLES . An author- ized emergency vehicle is : (a) Any publicly owned ambulance, life- guard or lifesaving equipment or any privately owned ambulance used to respond to emergency calls and operated under license issued by the Commis- sioner of the California Highway Patrol. (b) Any publicly owned vehicle operated by the following persons, agencies, or organizations: (1) Any forestry or fire department of any public agency or fire department organized as provided in the Health and Safety Code. (2) Any police department, including those of the University of California and the California State Colleges, sheriff' s depart- ment or the California Highway Patrol. (3) The district attorney of any county or any district attorney investigator. (4) Any constable or deputy constable engaged in law enforcement work. (5) Peace officer personnel of the Department of Justice. 7/20/71 eE . TRAFFIC REDLANDS TRAFFIC ORDINANCE §68600 Cont. (c) Any vehicle owned by the state or any bridge and highway district, and equipped and used either for fighting fires, or towing, or servicing other vehicles, .caring for injured persons, or repairing damaged lighting or electrical equipment. (d) Any state-owned vehicle used in res- ponding to emergency fire, rescue or communications calls and operated either by the California Disaster Office or by any public agency or industrial fire department to which the California Disaster Office has assigned such vehicle. (e) Any state-owned vehicle operated by a fish and game warden, (f) Any vehicle owned or operated by any department or agency of the United States government: (1) When such department or agency is engaged primarily in law en- forcement work and the vehicle is used in responding to emergen- cy calls, or (2) When such vehicle is used in res- ponding to emergency fire, ambu- lance, or lifesaving calls , (g) Any vehicle for which an authorized emergency vehicle permit has been issued by the Commissioner of the California Highway Patrol . ARTICLE 687 Operation of Vehicles 68700. PERMISSIVE OPERATION. No person shall operate a motor vehicle within the City of Redlands, on any lands or premises without having written permission from the owner of _such lands or his agent, or the person in lawful possession thereof; provided, however, that this section shall not be applicable to persons having visible or lawful business with said owner, agent or person in lawful possession. Upon request of a peace officer, any such written permission shall be displayed to the peace officers 7/20/71 TRAFFIC REDLANDS TRAFFIC ORDINANCE Art. 688 ARTICLE 688 Limits on Noise 68800. NOISE LEVEL. No person shall operate on lands or premises in the City of Redlands any motor vehicle which makes sounds and noise in excess of the noise level provided in Section 23130 of the Vehicle Code of the State of California. § 68801. SPARK ARRESTER AND MUFFLER, Any motor vehicle operated on property within the City of Redlands shall be equipped with a spark arrester and muffler as defined in Section 27150 of the Vehicle Code of the State of California. No person shall operate a motor vehicle unless it is so equipped with a spark arrester and muffler. ARTICLE 689 Exceptions 68900. EXCEPTED VEHICLES . The provisions of Articles 686 through 688 shall not apply to the following vehicles: . 1 Authorized emergency vehicles . . 2 Vehicles operated upon parking lots or structures open to the public or private parking lots or struc- tures and operated solely for ingress to and egress from said parking area and parking. . 3 Vehicles operated upon property primarily used for motor vehicles retail or wholesale sales, service or repair, manufacture, or distribution, but operated in a manner not to be offensive and which shall not disturb the peace and quiet of the general neighborhood. .4 Vehicles generally used exclusively for commercial, industrial, or office purposes in a manner that shall not be offensive and shall not disturb the peace and quiet of the neighborhood. .5 Vehicles operated upon private roadways or easements necessary for ingress to or egress from property used for those purposes designated in subsections (b) , (c) , and (d) above, and for no other purpose. .6 Vehicles operated upon public streets and highways . 7/20/71 a E WIN TRAFFIC REDLANDS TRAFFIC ORDINANCE §68900, Cont. . 7 Vehicles operated on property actually used for residential purposes, where such motorcycles or motor driven cycles are on said property with the express or implied invitation of the owner or occupant and when such use is solely for ingress to and egress from said residential property. (1455) 7/21/71 SECTION TWO: This ordinance shall be in force and take effect as provided by law, SECTION THREE: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in the City of Redlands.
