HomeMy WebLinkAboutOrdinances_1497_CCv0001.pdf ORDINANCE NO. 1497 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING THE TRAFFIC ORDI- NANCE SECTION OF THE REDLANDS ORDINANCE CODE AND ORDINANCE NO. 1075, AND RESCINDING ORDINANCE NO. 1442 THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOL- LOWS : SECTION ONE: That Section 67105 of the Redlands Traffic Ordi-- nance and Ordinance No. 1075 are amended to read as follows, that Section 67106 is hereby added, and Ordinance No. 1442 is rescinded: TRAFFIC REDLANDS TRAFFIC ORDINANCE Sec. 67022, Cont. (c) "CONTROLLED ACCESS HIGHWAY. " Every highway, street or roadway in respect to which owners or occu- pants of abutting property or lands and other persons have no legal right of access to or from the same, except at such points only and in such manner as may be determined by the public authority having jurisdiction over such highway, street, or roadway. (1075) ARTICLE 671 Traffic Administration § 671010 "POLICE ADMINISTRATION. " There is hereby established in the Police Department of this City a traffic di- vision to be under control of an officer of Police appointed by and directly responsible to the Chief of Police. (1075) § 67102. DUTY OF TRAFFIC DIVISION. It shall be the duty of the traffic division with such aid as may be rendered by other members of the police department to enforce the street traffic regulations of this City and all of the State vehicle laws applicable to street traffic in this City, to make arrests for traffic violations, to investigate accidents and to cooper- ate with the City Traffic Engineer and other officers of the City in administration of the traffic laws and in developing ways and means to improve traffic conditions, and to carry out those duties specially imposed upon said division by this ordi- nance and the traffic ordinances of said City. (1075) § 67103 . "CITY TRAFFIC ENGINEER. " The office of City Traffic Engineer is hereby established. The City Engineer shall serve as City Traffic Engineer in addition to his other functions, and shall exercise the powers and duties with res- pect to traffic as provided in this ordinance. (1075) 67104. EMERGENCY AND EXPERIMENTAL REGULATIONS. (a) The Chief of Police is hereby em- powered to make regulations necessary to make effective the provisions of the traffic ordinances of this city and to make and enforce temporary or experimental regulations to cover emergencies or special conditions. No such temporary or ex- perimental regulation shall remain in effect for more than 90 days. (1075) (b) The Chief of Police may test traffic control devices under actual conditions of traffic. (1075) 8/1/72 TRAFFIC REDLANDS TRAFFIC ORDINANCE Sec, 67105 § 67105 . TRAFFIC COMMISSIONS ITS POWERS AND DUTIES . (1497) (a) There is hereby established a traffic commission to serve without compensation and to act as an advisory board to the City Council of the City of Redlands. (b) It shall be the duty of the traffic commission, and to this end it shall have the authority within the limits of the funds at its disposal, to coordinate traffic activities (to carry on educational activities in traffic matters) , to supervise the preparation and publication of traffic reports, to receive complaints having to do with traffic matters, and to recommend to the City Council ways and means for improving traffic conditions and the adminis- tration and enforcement of traffic regulations. (c) MEMBERS , The said traffic commis- sion shall consist of seven (7) members, of which six (6) mem- bers shall be appointed by the Mayor of said City, with the approval of the City Council of said City, from city residents at large who are not city officials, for staggered terms of four (4) years. In addition, a student member shall be selected by the commission for recommendation to the Mayor of said City and the City Council of said City for appointment of one (1) year as a full voting member of the commission. Terms of office shall coincide with the fiscal year of said City, (d) OTHER DUTIES . The traffic commis- sion shall perform such other duties as may be prescribed by ordinance not inconsistent with the provisions of this chap- ter. (e) ADVISORY MEMBERS. At all times the commission will be advised by the Chief of the Traffic Division of Redlands Police Department, a member of the City Council, and a representative of the Department of Public Works of said City, who shall attend all meetings and serve in an advisory capacity to said commission. 67106. OFFICERS AND MEETINGS , (a) The traffic commission, during the July meeting, shall select a chairman for the term of one (1) year and such other officers of the commission as it may deem advisable, and shall make such necessary rules and regu- lations as are necessary to fulfill the obligations and duties of the commission. (1497) 8/1/72 I TRAFFIC REDLANDS TRAFFIC ORDINANCE Sec. 67106, Cont. (b) MEETINGS, The commission shall keep records of all its acts and proceedings and shall have regular meeting dates, and shall submit all its recommenda- tions to the said City Council and City Manager, (1497) ARTICLE 672 Obedience to Traffic Regulations 67201. REQUIRED OBEDIENCE TO TRAFFIC ORDINANCE. It is a misdemeanor for any person to do any act forbidden, or fail to perform any act required, by this ordinance, (1075) § 67202 . AUTHORITY OF POLICE AND FIRE DEPARTMENT OFFICIALS . (a) It shall be the duty of the offi- cers on the Police Department or such officers as are assigned by the Chief of Police to enforce all street traffic laws of this City and all of the State Vehicle Laws applicable to street traffic in this City, (1075) (b) Officers of the Police Department or such officers as are assigned by the Chief of Police are hereby authorized to direct all traffic by voice, hand, or signal in conformance with traffic laws, provided that, in the event of a fire or other emergency, or to expedite traffic or to safeguard pedestrians, officers of the Police Department may direct traffic as conditions may require notwithstanding the provisions of the traffic laws. (1075) (c) Officers of the Fire Department, when at the scene of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. (1075) § 67203 . OBEDIENCE TO POLICE AND FIRE DEPARTMENT OFFICIALS , No person shall wilfully fail or refuse to comply with any lawful order or direction of a police officer or fire department official. (10 7 5) § 67204, PERSONS OTHER THAN OFFICIALS SHALL NOT DIRECT TRAFFIC. No person other than an officer of the Police Department or a person deputized by the Chief of Police or person authorized by law shall direct or attempt to direct traffic by voice, hand or other signal. (1075) 8/l/72 All SECTION TWO: All other ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION THREE: This ordinance shall be in force and effect as provided by law. SECTION FOUR: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published once in the Redlands Daily Facts, a daily newspaper designated for that purpose.
