HomeMy WebLinkAbout3915RESOLUTION NO 3915 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ESTABLISHING GUIDELINES FOR ALTERATION OF PROJECTS APPROVED PURSUANT TO PROPOSITION "R" AND ORDINANCE NO 1788 WHEREAS, on November 7, 1978, the voters of the City of Redlands approved an initiative ordinance entitled Proposition "R" to moderate the rate of growth within the City to preserve the City's unique environment and character, and WHEREAS, Proposition "R" prescribes a program to limit major subdivision residential development to 450 dwelling units each calendar year through the competitive evaluation of applications, and requires the City to prepare and adopt a procedure for such competitive evaluation, and WHEREAS, in accordance with the directive contained in Proposition "R," the City has enacted Ordinance No 1788 providing for the competitive evaluation of projects by the assignment of points in a number of categories by City staff, the Planning Commission and the Redlands Unified School District, and further providing for subse- quent award of development allocations by the City Council, and WHEREAS, Ordinance No 1788 states that a project submitted for allocations may not be altered prior to receiving allocations, but is silent as to whether a project which has already received allocations may later be altered in any respect, and WHEREAS, this City Council believes that guidelines should be available to allow a developer who has already received development allocations to alter his project in a manner which would not have resulted in the assignment of fewer points if the alteration had been incorporated into the approved application for development allocations, and that such guidelines would further the purposes set forth in Proposition "R", and WHEREAS, Ordinance No 1788 also states that its provisions may be implemented by resolution to further the purposes set forth in Proposition "R", NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows SECTION ONE Following receipt of development allocations, the developer of an approved project may file an application with the City Planning Department for authori- zation to alter the project in any manner which would not have resulted in the assignment of fewer points if the alteration had been incorporated into the approved application for development allocations as originally submitted Such application shall be accompanied by an application fee of $500 SECTION TWO Upon receipt of an application to alter an approved project, the Planning Department shall determine which point categories addressed in Ordinance No 1788 might have been affected if the requested alteration had been incorporated as part of the approved application for development allocations as originally sub- mitted, and whether the Planning Department, the Planning Commission or the Redlands Unified School District is responsible for assigning points in those categories The Planning Department shall reassign points in all affected categories which are subject to assignment by the Planning Department If the Planning Department finds that the requested alteration might have affected the assignment of points in any category subject to assignment by either the Planning Commis- sion or the Redlands Unified School District, the Planning Department shall refer the application to either or both of those assigning bodies for a similar determination regarding each of the categories subject to their review and assignment of points SECTION THREE The Planning Department, Planning Commission or Redlands Unified School District, as the case may be, shall report in writing to the City Council any change in the assignment of points in any category addressed by Ordinance No 1788 If the City Council determines that the project as revised would have received fewer total points than the project originally approved, then the City Council shall deny the application to alter the approved project SECTION FOUR If the Planning Department, Planning Commission or Redlands Unified School District, as the case may be, determines that the project would not have received fewer total points if the requested alteration had been incorporated into the approved application for development allocations as originally submitted, the City Council may elect to approve the application for alteration of the project if it determines that such alteration will further the purposes set forth in Proposition "R " ADOPTED, SIGNED AN►D APPROV :D th,.s l6th day of August, 1983 Ma or of the City oedlands ATTEST Resolution No 3915 Page two -
