HomeMy WebLinkAbout3637RESOLUTION NO 3637 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS, CALIFORNIA, AUTHORIZING EXECUTION OF MUTUAL ASSISTANCE AGREEMENT FOR FIRE PROTECTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS, that the Mayor is hereby authorized to sign and the City Clerk to attest to an agreement between the San Bernardino County Forestry and Fire Warden Department and the City of Redlands for mutual assistance fire protection services within the respective city and adjacent unincor- porated areas, as shown on the attached map, which agree- ment takes effect at midnight ADOPTED, SIGNED AND APPROVED this 18th day of December, 1979 ATTEST APPROVED FOR FORM s/ Edward F Taylor City Attorney Mayor of e City_of Red I, Peggy A Moseley, City Clerk, City of Redlands, do hereby certify that the foregoing resolution was adopted by the City Council at a regular meeting thereof held on the 18th day of December, 1979, by the following vote AYES Councilmembers Knudsen, DeMirjyn, Elliott, Riordan; Mayor Martinez NOES None ABSENT None MUTUAL AID AGREEMENT This AGREEMENT, made and entered into this day of December, 1979, by and between the SAN BERNARDINO COUNTY FORESTRY AND FIRE WARDEN DEPARTMENT (hereinafter referred to as COUNTY) and the REDLANDS CITY FIRE DEPARTMENT (hereinafter referred to as CITY) WITNESSETH WHEREAS, it is the intent of the parties hereto to assist each other on fire occurring in the City of Redlands and adjacent unincorporated areas as shown on the attached map. ITOW, THEREFORE, it is agreed as follows 1. When either the CITY or COUNTY receives a report of any fire or other emergency in the area shown on the attached map, the one having responsibility shall respond in their normal manner and notify the other party as soon as practical 2. The CITY shall respond to any fire or other emergency with at least one (1) engine or tanker, in the jurisdiction of the COUNTY, as shown on the attached map 3 The COUNTY shall respond to any fire or other emergency with at least one (1) engine or tanker in the jurisdiction of the CITY, as shown on the attached map 4 Other emergency as used in the foregoing sections is defined as any type ofemergency incident to which either party normally responds to; i e , medical aid, hazardous materials spill, gas leak, etc 5 The response of equipment and personnel by one agency to assist the other shall be automatic upon notification of an emer- gency and shall be subject to its availability 6. The senior officer of the agency having jurisdiction of the fire shall be in charge of all personnel and equipment at the scene. If no one from the agency having jurisdiction is at scene upon the arrival of the agency providing assistance, the senior officer of the latter agency shall be in charge until the arrival of the agency having jurisdiction. 7. Mutual assistance personnel and equipment shall normally be the first to be released from the fire unless unusual conditions prevail 8 It is agreed that this mutual assistance shall be provided by either the CITY or COUNTY at no cost to the other agency 9 If, while providing mutual assistance to the other, either the CITY or COUNTY has the need to release or reassign its equipment and/or personnel, they shall do so only after notifying the officer in charge of the fire 10 Neither party hereto shall be deemed to assume any responsibility of liability for the negligent or intentional acts of any officer or employee of the other party In the event that either party pays, or is required to pay (by judgment, stipulated judgment, or otherwise) any tort claim arising out of the negligent or intentional act or failure to act of an officer or employee of the other party, then the party making payment shall be indemnified by the other party for the amount of such claim or judgment; provided that the party against whom any tort claim is filed shall give prompt notice to the other party, as well as the opportunity to pay, deny, or defend against the claim or suit, if it so desires. 11.
