HomeMy WebLinkAboutOrdinances_2233_CCv0001.pdf ORDINANCE NO. 2233 AN ORDINANCE OF THE CITY OF REDLANDS TO IMPLEMENT TRANSPORTATION CONTROL MEASURES FROM THE 1991 AIR QUALITY MANAGEMENT PLAN AND 1992 FEDERAL ATTAINMENT PLAN FOR CARBON MONOXIDE BY ADDING CHAPTER 18 , 224 TO THE REDLANDS MUNICIPAL CODE WHEREAS, residents in: the South Coast Air Basin (SCAB) and portions of the South East Desert Air Basin (SEDAB) under the South: Coast Air Quality Management District's (District) jurisdiction, breathe unhealthful air one in every three days`). and, WHEREAS, the SCAB, which encompasses the non-desert portions of Los Angeles, Riverside, and San Bernardino Counties, and all of Grange County, exceeds the Federal and State ambient air quality standards for carbon monoxide (CO) , nitrogen dioxide (NO2) , ozone, and fine particulate ratter (P10) and WHEREAS, SCAG projects the region' s population to grow by 31 percent by the year 2010, from 12 .7 million today to 15 ,7 million, and: WHEREAS, increases in population means increases in -vehicle miles traveled ( T) and vehicle trips (` T) , which translates into increased emissions from mobile sources; and WHEREAS, the 1988 California Clean Air Act (CCAA.) requires severely polluted areas, such as the SCAB, to achieve an average of 1 . 5 or more persons per passenger vehicle during weekday commute hours by 1999 (Health and Safety Cade Section 40920 (a) (2) , and WHEREAS, areas with severe pollution are required by the CCAA to substantially reduce the rate of increase in passenger vehicle trip and miles traveled per trip (Health and Safety Code Section 40919 (a) ( ) ) and WHEREAS, the District Governing Board and Southern California Association of Governments Executive Committee adapted the 1991 Air Quality Management Plass (AQMP) to meet the requirements of the 1988 CC and WHEREAS, severe areas for ozone must adopt specific enforceable transportation control measures (TCMs) to offset any growth in emissions due to increased 'SMT or VT (FCAA, Sections 182 (d) (1) (A) and 187 (b) (2) ) ) and WHEREAS, VMT gust be forecast dor each year up to the year of attainment (FCAA Section 187 (a) (2) (A) ) dorCO; and WHEREAS, Contingency measures must be implemented if any estimate of VMT submitted in an annual report exceeds that predicted in the most recent forecast, or if the SCAB fails to meet the Federal CO standard by the attainment date ( 'CAA Section 187 (a) (3) ) ; and WHEREAS, the 1991 AQMP calls for local governments to implement local government Transportation Control Measures 1.a, 1 .b, 2 .a, 2 .b. , 2 . d. , 2 . e . , 17, and M-14-3 by December 31, 1993; and WHEREAS, the 1992 CO Plan calls for local governments to implement these TCT by December 31, 1993 ; and WHEREAS, the District has prepared a "Handbook for Preparing a Local Government Trip Reduction Ordinance,, that assists local governments in adopting and implementing local government TCMs from the 1991 AQMP and 1992 CO Plan; and WHEREAS, this guidance document has established a regional and subregional trip reduction target by 1994 that equates to the emission reductions from the eight local government TCMs; and WHEREAS, this ordinance implements= TCM s that will achieve the trip reduction target for 1994; and WHEREAS, the trip reduction actions included in this ordinance are above and beyond the existing programs or other TCMs in the AQMP; and WHEREAS, The City is required' to monitor progress in implementing the ordinance and report results annually to the County Transportation Commission and the District; and WHEREAS, the ordinance is likely to be deemed an enforceable mechanism for implementing the TCMs by the ARB and EPA; and WHEREAS, the ordinance complies with EPA' s enforceability criteria; and WHEREAS, this ordinance and any necessary implementation plans will be submitted to the District to be transmitted to ARB and EPA for inclusion in the SIP; and WHEREAS, the City will put into place the necessary staff and financial resources to ensure that the TCMs will be implemented and enforced sufficiently to achieve the trip reduction target; and WHEREAS, the- City will institute a monitoring program necessary to document progress in reducing vehicle trips and VMT and will report to the District or other locally-delegated government agency on an annual basis; and (2) WHEREAS, the impacts of these actions have been quantified using methodologies that are consistent withguidancefrom the South Coast Air Quality Management District and WHEREAS, the District will use the regional monitoring information to determine if, and when a, regional backstop rule is needed to attain the emission reductions targeted in the 1991 AMB and WHEREAS, local governments that adopt ordinances that are estimated to achieve their target reduction would be exempt from the backstop rule; and: WHEREAS, implementation of a comprehensive trip reduction strategy can improve the City' s public health and safety, reduce congestion, and improve air quality; NOW THEREFORE, the City Council of the City. of Redlands does ordain as fellows: SECTION 1.. DEFINITION The following words or phrases shall: have the following meanings when used in this ordinance . A. "South Coast Air Quality Management- District (District) n means the South Coast District as defined in Section 40400 et seq of the Health and Safety Code and is the agency responsible for comprehensive air pollution control in the South Coast Air Basin (SCAB) and certain areas of the Southeast Desert Air Basin (SE AB) . B. 11FCAA11 means the Federal Clean Air Act Amendments of 1990 . C. "CCAA" means the 1988 California Clean Air Act D. "Transportation Control Measure means any strategy for reducing mobile source emissions through reduction of trips, vehicle miles traveled, vehicle hours traveled, traffic congestion, vehicle idling, or vehicle use: 11 11 means Vehicle Miles Traveled, the total miles traveled by a_ vehicle or vehicles over a particular period, whether over a 4--hour period-, over an average vehicle trip, etc-. F 11VT" means Vehicle Trip, a one-way trig from any origin to any destination. (8) G. "SCAG" means the Southern California Association of Governments, a Metropolitan Planning Organization MPO) for Ventura, Los Angeles, Orange, San Bernardino, Riverside, and Imperial counties . H. "Employer" means any person(s) , firm, business, educational institution, government agency, non-profit agency or corporation, or other entity. I . "AQMP" means a document describing how the District plans to achieve Federal and State air quality standards . J. "CITY" means the City of Redlands. SECTION 11 CHAPTER 18 . 224 IS HEREBY ADDED TO THE REDLANDS MUNICIPAL CODE AS FOLLOWS : CHAPTER 18 .224 TRANSPORTATION CONTROL MEASURES SECTIONS: 18 .224 . 010 PURPOSE 18 . 224 . 020 REQUIREMENTS 18 . 224 . 030 MONITORING CRITERIA 18 . 224 . 040 ENFORCEMENT 18 . 224 . 050 FEES 18 .224 . 010 PURPOSE. The purpose of the Transportation Control Measures is to implement the 1991 Air Quality Management Plan and the 1992 Attainment Plan for Carbon Monoxide. The requirements, as provided in this Chapter, are established to achieve the trip reduction targets as established by the Air Resources Board and Environmental Protection Agency. 18 . 224 . 020 REQUIREMENTS . These requirements shall be applicable to developments which receive discretionary approvals from the City after the effective date of this ordinance . A. New non-resident-ial and multifamily (of 10 or more units) developments or remodel, when discretionary review is required, shall install bicycle racks or secured lockers at a rate of one per 30 parking spaces with a minimum of a three-space bicycle rack. (4) B. New non-residential and multifamily (of 10 or more units) developments shall provide on-site pedestrian walkways and bicycle facilities to connect each building in the development to public streets . C. New non-residential development producing 250 or more peak hour vehicle trips shall provide a shower facility accessible to both men and women who bicycle or walk to work. D. New non-residential and multi-family (of 10 or more: units) developments with 100 or more parking spaces shall have a passenger loading area with a curb length of at least 100 feet in a location close to the building entrance . The loading area shall be designed so as not to interfere with vehicle circulation. E. New non-residential development shall designate preferential parking spaces for vanpools near building entrances at a rate of one (1) parking space per 100 spaces. FNew non-residential and residential (of 10 or more units) developments along existing or planned transit routes shall install transit improvements such as bus pullouts, bus pads, and bus shelters . The need for and nature of these improvements are to be defined by the City in cooperation with Omnitrans . G. New residential developments over 500 units shall provide a telecommuting center or contribute toward the development of a telecommuting center. H. office park developments for over 1, 000 employees shall provide on-site video conferencing facilities . I . New non-residential developments linked to other actions that reduce vehicle trips may reduce parking space requirements to account for increased ridesharing and other modes of transportation. The land areas which would otherwise be utilized for parking shall be landscaped. J. New non-residential and multifamily (of 10 or more units) developments shall participate in the development of a bicycle route system consistent with Cg ' s Regional Mobility Element . Ka New non-residential developments producing 250 or more peak hour vehicle trips shall designate on-site parking areas to be used by commuters as park-and-ride lots , (5) L. New non-residential development shall designate preferred parking spaces for employee vanpools and rideshare vehicles near employee building entrances . The designation of preferential parking spaces shall be at a rate of ten spaces per 100 employees with a minimum of one space for businesses with over ten employees. 18 . 224 . 030 MONITORING CRITERIA The monitoring criteria set forth in this section shall be applicable to the individual requirements set forth in Section 18 .224 . 020 . The letter designations in this section correspond to the letter designations for the individual requirements set forth in Section 18 . 224 . 020 . A. Bicycle parking facilities shall be indicated on approved development plans and shall be constructed as a component of the approved project . Installation shall be verified by City building inspectors. The site shall be inspected by the City on a periodic basis to assure the maintenance of the facilities . B . on-site pedestrian walkways and bicycie facilities shall be indicated on the approved development plans and shall be constructed as a component of the approved project . Installation shall be verified by City building inspectors . The maintenance of said facilities shall be verified by City staff on a periodic basis. C. Shower facilities shall be indicated on the approved development plans and shall be constructed as a component of the approved project . Installation shall be verified by City building inspectors . D. Passenger loading areas shall be indicated on the approved development plans. Signs and curb painting shall be installed designating such areas as a component of the approved project. Installation shall be verified by City building inspectors . The maintenance of loading areas shall be verified by the City on a periodic basis . E. Preferential parking spaces for vanpools, shall be shown on plans prior to issuance of a building permit and on designated parking spaces before final occupancy of the project. The spaces shall be designated by appropriate signing or painting. Maintenance of the specified number of designated spaces shall be verified by the City on a periodic basis . (6) tiff F. Transit improvements shall be indicated on the approved development plans. Installation as a part of the approved project shall be verified by City building or public works inspectors . G. Establishment of a telecommuting center or contribution toward the> establishment of a center shall be identified prior to the issuance of building permits and verification made before issuance of a Certificate of occupancy. H. Establishment of video conferencing facilities shall be identified prior to the issuance of building permits and verification made before issuance of a Certificate of Occupancy. I . Parking requirements shall be reduced by the number of vehicles reduced by other trip reduction actions. Deletion of parking areas and installation of appropriate landscaped areas shall be verified by City building inspectors. J. Installation of a bicycle route system shall be accomplished by the City. A fee to implement the development of the bicycle route system shall be established based upon the size of a project . Some projects may be required to install portions of the bicycle route system within their developments and would be approved at the time of final City approvals and inspected by building and public works inspectors . K. An agreement designating a portion of the parking lot as a park-and-ride lot shall be executed before the issuance of a building permit . Said agreement shall specify the area so designated; any exceptions to the designation and the authority of the City to install and maintain signs informing, of the designation. L. Preferential parking spaces for employee vanpools and rideshare vehicles shall be designated on plans before issuance of building permits and designated on parking spaces before final occupancy of the project . The spaces shall be designated by appropriate signing or painting. Maintenance of the specified number of designated spaces shall be verified by the City on a periodic basis. 18 . 224040 ENFORCEMENT Enforcement of Chapter 18 . 224 shall be in accordance with Chapter 18 . 208 of this Title . 7 18 .224 . 050 FEES Fees to implement the provisions of Chapter 18 . 224 shall be adopted by City Council resolution. Section Ill. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and cause it, or a summary of it, to be published once in the Redlands Taily> Facts, a newspaper of general circulation printed and published in the City; and thereafter, this ordinance shall take effect in accordance with law.
