Article 581. Rubbish, Weed, Plant Removal
582 . Tree Trimmings
5811. FIRE AND SAFETY HAZARD, Every owner, occupant,
and person in control of any 'Land or interest in property
in the City of Redlands shall remove and abate from such
land or interest, and all sidewalks, parkways, and untrav-
eled portions of any public highway or public road eAsbmehts
adjacent thereto, all noxious weeds, or vegetation, dry
grass, tumbleweeds, dead trees, and rubbish which is com-
bustible, and constitutes a fire, health, or safety hazard,
or endangers or injures adjacent property, or which may
become so within a reasonable period of time.
§ 5812. DANGEROUS, POISONOUS PLANT$. Every owner,
occupant, and person in control of any land or interest
in property in the City of Redlands shall remove and abate
from such land or interest, and all sidewalks, parkways,
and untraveled portions of any public highway or public
road easements ad4acent thereto, all noxious, poisonous,
or inherently dangerous plants or vegetation which may
cause damage to adjacent property, or endanger the health,
safety, or welfare of any person or property. This section
shall not apply to t plant known as the common oleander.
§ 5813 . COMPLIAXCEa The removal and abatement required
by this ordinance shall be completed before any weeds,
vegetation, dry grass, tumbleweeds, or other plant material
have matured, or before seeds which may cause the spread
of such plants have started to separate from them, or,
while remaining attached, tc such planta, are being blown
or transported by the elements, or being carried by persons
or animals to other premises.
5814. ENFORCMEINT, The officers and employees of the
City of Red1ands who shall er&arces this Chapter are as
follows2 Fire Chief and Street Superintend ent. Each of
these off!.cers and employees may appoint a deputy to per-
form the same duties,

whenever such officer determines that it is necessary to
enforce any provision of this Chapter, shall issue an order
and notice to remove hereinafter called "order" of the
following methods®
a. Registered letter to the person shcwn on the
tax rolls of the San Bernardino County Assessor 's office.
b. By personal serv1klce,
C. By povting the property.,

provided in Section 5 shall have substantially the follow-

If these are not removed from the premises within fifteen
(15) days, the duly appointed officer may order them
removed by public employees, private contractor, or other
person, and the cost of such removal and service charges
shall be levied and assessed against the property as a
special assessment lien, unless the property owner elects
to pay such cast in cash.
No appeal from this order may be made after the
expiration of the said fifteen (15) days . Appeals roust be
filed with the undersigned officer, who wi.11 set the same
for hearing before the City Council and notify you of the
date of such. hearing.

3 Appeal from the order may be made to the
City Council of the City of Redlands within the time pro-
vided for compliance with the order. The appeal shall be
in writing and filed with the enforcement officer who
signed the order. Timely appeal. shall stay further action
until the date set for hearing. The officer of the City
of Redlands who receives the written appeal shall inform
the City Clerk, who shall set the appeal. before the City
Council for bearing, and notify the appellant of the
hearing date at least 1.5 days before it is set if the
appellant resides outside the City of Redlands, and at
least 25 days if the appellant resides outside the State
of California. The City Council shall, grant or deny the
appeal, and its decision shall be conclusive,

.4 Upon failure to comply with the order or any
subsequent requirement of the City Council, the enforcement
officer who issued the order, or the City Council may cause
such weeds or vegetation, dry grass, tumbleweeds, dead
trees, and any combustible rubbish, as described in the
order I to be removed by a private contractor, employed by
the City Council, in the manner specified by the Council,
or by employees of the City of Redlands. The cost of such
work shall be assessed against the property from which
the removal is made, and such property shall be subject
to a special assessment lien for said purpose.
.5 When the work of removal has been completed,
the agency, officer, or contractor shall render to the
City Treasurer an itemized statement of its cost. The
City Treasurer shall pay the amount stated from the fund
of the City of Redlands, A demand for payment of the
amount of the cost shown in the statement and paid by the
City, in addition to a service charge of $5.00, shall be
sent to the owner of the property, by posting in the United
States mail, such bill accompanied by an affidavit of
mailing.
.6 If payment is not made within thirty (3G)
days after mailing such bill, the City Treasurer shall
certify to the Assessor the demands remaining unpaid, in
accordance with the statutory provisions for special
assessments and tax liens . The amount of the billing
shall be entered upon the tax rolls as a special assessment
and tax lien upon the property from which removal was
made. The special assessment and tax shall be included
upon the next succeeding tax statement.
§ 5815. MISDMEANOR. It shall be a misdemeanor for
any person, natural or corporate, owning, possessing, or
controlling any promises to fail to comply with the
provisions of this Chapter, its enforcement by any of the
officers, employees or deputies, named in this Chapter,
or to prevent any such officers, employees, or deputies,
or approved private contractors, to enter any premises
for the purpose of removing any material hereinbefore
described, or to interfere in any manner whatever with
any of them in the work of removal herein provided.
§ 5816 . PENALTY. A person, firm, company, or corpora-
tion violating any of the provisions of this Ordinance
shall be deemed guilty of a misdemeanor and upon arrest
and- conviction shall be punished by a fine of not more
than $500.00 and imprisonment of not more than ninety (90)
days, or both.

§ 5817. RULES AND REGULATIONS . The City Council shall
have authority, and is hereby authorized to promulgate
reasonable rules and regulations to enforce and apply
the provisions of this chapter.
Shm-011 any provisions, section, clause, or work
of this chaj: .- ::r be held unlawful or unconstitutional, all
other porti,'_..' of the chapter shall have full force and
effect, and this City Council hereby passes each of the
provisions herein separately. All ordinances or provi-
sions of ordinances of tie City of Redlands in conflict
with any provision of this ordinance are hereby repealed.
This ordinance shall take effect thirty (30) days after
the date of its adoption and prior to the expiration of
fifteen (1.5) days from the passage. _th,*,r,eof, shall be
