HomeMy WebLinkAboutOrdinances_2097_CCv0001.pdf ORDINANCE NO. 2097 AN ORDINANCE OF THE CITY OF REDLANDS ADDING CHAPTER 10 .54 TO THE REDLANDS MUNICIPAL CODE RELATING TO TRUCK ROUTES THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN: SECTION 1 . Chapter 10 .54 is hereby added to the Redlands Municipal Code to read as follows: "CHAPTER 10 . 54 TRUCK ROUTES SECTION 10 .54 .010 Establishment. Whenever the City Council , by resolution, designates and describes any street or a portion thereof, as a street the use of which is permitted by any vehicle exceeding a maximum gross weight limit of five tons, the City Engineer is hereby authorized to designate such streets by appropriate signs as truck routes for the movement of vehicles exceeding a maximum gross weight limit of five tons. SECTION 10 .54 .020 Use of Truck Routes. Whenever truck routes are established and designated by appropriate signs, the operator of any vehicle exceeding a maximum gross weight limit of five tons shall drive on such routes and none other; provided, however, the provision of this Chapter shall not prohibit the operator of any vehicle exceeding a maximum gross weight of five tons from having ingress and egress by direct route to and from restricted streets when necessary for the purpose of making pick-ups or deliveries of goods, wares and merchandise from or to any building or structure located on such restricted streets or for the purpose of delivering materials to be used in the actual or bona fide repair , alteration, remodeling or construction of any building or structure upon such restricted streets for which work a building permit has previously been obtained, subject to the restrictions of Section 54 .040 . SECTION 10 .54 .030 Exemptions. The provisions of this Chapter shall not apply to the following vehicles: A. Passenger buses under the jurisdiction of the Public Utilities Commission of the State; B. Vehicles owned by a Public Utility while necessarily in use in the construction, installation or repair of any public utility; and C. Any vehicle defined in the Vehicle Code as a house car or a vehicle used for recreational purposes only. SECTION 10 .54 .040 Deliveries to Construction Sites. The route to be used by vehicles exceeding a gross weight of five tons, which are delivering materials and equipment to a construction site not on a truck route shall be subject to the review and approval of the City Engineer . SECTION 10 .54 .050 Review of Proposed Route. At the time of application for a building, grading, off-site improvement, street cut, sewer or water permit, the applicant shall submit to the City Engineer a proposed route to be used be vehicles traveling to--and-from the construction site. The City Engineer shall review and approve the route or provide an alternate route to be used by the applicant. If the proposed route submitted by the applicant is not approve by the City Engineer, the City Engineer shall make known to the applicant, if requested, the reasons upon which is disapproval was based. A diagram of the approved route, signed by the City Engineer, shall be given to the applicant and shall be retained by the applicant at the project site during the course of construction." SECTION 2. This ordinance shall take effect as provided by law. SECTION 3 . The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in this City.
