AN ORDINANCE OF THE CITY OF REDLANDS AMENDING ORDINANCE NO. 1118
OF THE CITY OF REDLANDS, SPECIFICALLY ARTICLE 409 OF THE ORDINANCE
CODE ESTABLISHING PROCEDURES FOR THE DISPOSAL OF UNCLAIMED PROPERTY:
AMENDING SECTIONS 40901, 40902, 40903, 40904 THEREOF AND ADDING
ADDITIONAL SECTIONS .
THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain:
SECTION ONE: That the City of Redlands Ordinance Code be
amended by amending Article 409 "Unclaimed Property" to read as
follows:
ARTICLE 409
Unclaimed Property
40901 . CUSTODIAN. The Chief of Police shall be the custodian
of all property seized, recovered, found, stored, or otherwise coming
into the custody of the Redlands Police Department as the result of
the carrying out of official duties by police officers or employees
of the police department and of found property which is given into
the care and custody of the police department by citizens.
40902 . RETURN TO LEGAL OWNER: EXCEPTIONS. The Chief of Police,
or his designee, shall attempt to determine the lawful owner of all
property coming into the custody of the Redlands Police Department
and to return such property to such owner. Property which is
evidence in a criminal trial shall be disposed of as the court directs.
Property which is contraband, or the return of which is otherwise
prohibited by statute, or the return of :which may encumber the City
of Redlands with civil liability by its return, shall be disposed of
as directed or authorized by statute or ordinance.
40903. RETURN OF FOUND PROPERTY. Unless returned earlier to the
legal owner thereof, unclaimed found property shall be held in cus-
tody no less than 180 days. Prior to the expiration of 210 days from
the date found property was given into the custody of the police de-
partment, the finder may claim unclaimed property upon the showing of
proof that the finder has complied with all requirements of statute
in attempting to locate the legal owner thereof_ and in attempting to
return same to such legal owner.
40904 . DISPOSITION OF PROPERTY. Unless otherwise herein directed,
all property, remaining unclaimed and in the custody of the Redlands
Police Department after the expiration of 210 days from the date such
property came into the custody of the police department , shall be
disposed of by public auction. Currency and coin, except mounted
coin collections, shall be given into the custody of the Treasurer
of the City of Redlands in exchange for a receipt therefore. Mounted
coin collections remaining unclaimed shall be disposed of by sealed
bid at public auction, which bid shall exceed the current actual face
value of the coins contained in the collection. Such unclaimed pro-
perty as, in the opinion of the. Chief of Police , would assist the
police department in carrying out its mission may be retained and any

such retained property shall be included in the assets of the
City of Redlands and entered into the inventory of the police
department.
40905. PUBLIC AUCTION. Public auction of unclaimed property
shall be performed as the Treasurer of the City of Redlands
directs. Notice of auction shall be given to the general public
not less than five days prior to the time fixed therefore by
publication once in a newspaper of general circulation to resi-
dents of the City of Redlands.
40906. DESTRUCTION. Disposal by destruction of property
which is contraband, or for which destruction is authorized or
directed by statute or ordinance, shall be accomplished by
rendering such property totally useless and accessible to reuse .
SECTION TWO: This ordinance shall be in force and take
effect as provided by law.
SECTION THREE: The City Clerk shall certify to the adoption
of this ordinance and cause it to be published once in the
Redlands Daily Facts, a newspaper of general circulation printed
and published in this city.
