HomeMy WebLinkAboutOrdinances_1267_CCv0001.pdf ORDINANCE NO. 1267 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING THE REDLANDS ORDINANCE CODE BY ADDING CHAPTER 42 THERETO THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain as follows : SECTION ONE. That the Redlands Ordinance Code be amended by the addition of the following sections. SAFETY FIRE CODE CHAPTER 42 Ordinance No, 1267 CEAPTER 42 Article 420 Adoption 1961 Uniform Fire Code 421 Fire Code & Appendixes Adopted in Part 422 Est abli5lisent & Duties of Division of Fire Prevention Article 11120 Adoption of the 1961 Uniform Fire Code 4201 . The herein designated portions of the Uniform Fire Code , 1961 edition and Appendix A, Appendix C, Appendix E and Appendix G thereto providing regulations consistent with nationally recognized standardpractice, to safeguard life, health, property and public welfare to a. reasonable degree from the hazards of fire and explosion arising from the storage, Ilse and handling of dangerous and hazardous materials, substances and devices , the operation, installation, construction loca- tion, safeguarding and maintenance of attendant equipment , and the installation and maintenance of adequate means of egress not provided for by the Building Code , which Fire Code was approved by the California Fire Chiefs Association Conference hold May 17, 1961„ Three copies of said code and said appen- dixes have been certified as true copies and filed in the office of the City Clerk and hereby adopted by reference. The parts of said code and appendixes so adopted by reference are made a part of this ordinance as though set forth at length herein (ordinance No,, 1267) , Article 421 Fire Code and Appendixes Adopted in Part 4210, The Uniform Fire Code and Appendixes A, C, and G, with the exception of the parts and provisions expressly excepted and deleted and as amended by this Section 2 , are adopted by reference and made a part hereof as provided in Section I hereof, The sections, paragraphs and parts of said Uniform Fire Code> which are excepted, deleted and not adopted include , Section 1. 24 ; Section 13. 24 ; Section 1 , 33 ; Section 13 - 35 ; Section 13. 36 ; Section 13, 37 ; Section 17. 05 ; Section 17, 06 ; Section 23 , 04 ; Section 23 - 051 Section - 1>t #= Section 27- 15 ; Section 27 � 24 ; SAFETY FIRE CODE 4211- 4211 , The following paragraphs and parts of said Uniform Fire Code are adopted= as amended, 4212. Subsection Q of Section 10,01 of the Uniform Fire Code is hereby amended to read as follows : (d) All doors in or leading to required exitways shall. be kept unlocked at all times when the building or floor area served thereby is occupied by customers , 4213, Section 15 . 104 of the Uniform Fire Code is hereby amended to read as follows ,. Section 15, 104 Container, Tanks, Equipment , and Apparatus,, Containers , Tanks , Equipment and Apparatus used or inten- ded to be used for the storage , handling, use or sales of flammable liquids shall be of an approved type, Glass con- tainers exceeding 32 fluid ounces in capacity shall not be approved except where contamination is a factor. Samples of not to exceed one quart of capacity may be taken in glass con- tainers for commercial reference or testing, 4214. Subsection (a) of Section 15, 103 of the Uniform Fire Code is hereby amended to read as follows . (a) Storage , handling or use of Class 1 , Class Il or Class ITI-A flammable liquids in containers exceeding one gallon in aggregate capacity in a dwelling or other place of human habitation; or in excess of six (6) gallons in any other building or other occupancy; or in excess of ten ( 10) gallons outside of any building; except that no permit shall be required for the following: (1 ) For the storage or use of flammable liquids in the fuel tank of a motor vehicle, aircraft , motorboat , mobile power plant or mobile heating plant, (2) For the 5torage or use of paints , oils, varnishes or similar flammable mixtures when such liquids are stored for maintenance, painting or similar purposes for a period of not more than 30 days ,, 4215 , Article 15 of the Uniform Fire Code is hereby amended by adding thereto a now section numbered 15 .225 to read as follows : Section 15. 225 Abandonment The following procedure shall govern and control aban- donment or, removal of underground flammable liquid tanks ; (1) Underground flammable liquid tanks are hereby deemed "out of service" when one of the following occurs ,, he eve r the owner or user shall so state , b Whenever the dispensing apparatus is dis- connected, c) Whenever there is a discontinuance of the use of the tank or its appurtenances for the pur- pose for which it was designed for a continuous sixty day period. - 2 SAFETY FIRE CODE 4215- (2 ) Underground tanks taken out of service shall be disposed of in any of the three following mannerst a) Deing placed in "temporarily out of service'' condition, b Abandoned in place, cl Removed , (3) The owner, operator or person in control of a tank deemed "Out of Service" shall notify the Division of Fire Prevention of such fact and the method of disposition, (4) In all cases where tanks are either rendered "temporarily out of service" or permanently abandoned, records shall be kept of the size of the tank, the location, and the date of abandonment and method used for placing the tank in a safe condition. (5) Tanks shall be rendered "temporarily out< of service '' in accordance with the following procedures : a) "Temporarily" shall mean a period not to exceed ninety days . It may be extended at the discre- tion of the Chief of the Division of Fire Preven- tion for such additional ninety day periods as shall be warranted , b) Gasoline to the extent of five per cent ( 5%) Of the tank capacity shall be left in �ne tank,, c) The fill line , gauge hatch and pump suction shall be capped and secured against tampering, d) The vent line shall be left open, e) As alternates to the above the tank may be ren- dered gas free or filled with water, (6) Tanks shall be abandoned in accordance with the following procedures which shall be carried out in the sequence in which they appear herein.� a) Remove all flammable liquid from the tank and from all connecting lines4 b) The suction, inlet , gauge , and vent lines shall, be disconnected ; c) The tank and any remaining pipe stubs shall be completely filled with an approved material ; d) Cap or plug all connecting lines below ground leVeK Tanks shall be removed in accordance with the follow- ing procedures which shall be carried out in the sequence in which they appear herein a) Remove all flammable liquid from the tank and connecting lines ; b) Disconnect the suction, inlet , gauge, and vent lines � c ) The tank shall be rendered gas free , as indica- ted by a combustible gas indicator, before removal from the ground; d) Cap or plug inlets or outlets and keep them capped or plugged during—the transportation and storage of the tank; - 3 - SAFETY FIRE CODE 4215- e) If the tank is to be disposed of as junk, it should be retested for explosive vapors , and if necessary, rendered gas free , After junking and before releasing to as junk dealer, a suffi- cient number of holes shall be made in the tank to render it unfit for further use ,,,. (8) Tanks located in public property, streets , alloys, easements, or right-of-way shall not be disposed of by aban- donment : Disposition shall be by removal , 5: Subsection (a) of Section 20. 10 of the Uniform Fire Code is hereby amended to read as followst a) No person shall smoke within 25 feet of any L-P Gas container of 1200 gal , or greater capacity ' V Subsection Q ) of Section M10 of the Uniform Fire Code is hereby amended to read as follows ,,. (c ) No person sball install or maintain any L-P Gas container with a capacity of 1.200 gallons or less within 25 feet of any open flame device, outside of buildings , nor shall any person Install or maintain any such container with a capacity in excess of 1200 gallons within 50 feet of any such open flame device,, Article 422 Establishment and Duties of the Division of Fire Prevention 4220, The Uniform Fire Code shall be enforced by the Division of Fire Prevention in the Fire Department of the City of Redlands , California , which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department , 4221 , The Chief of the Division of Fire Prevention shall be appointed by the Chief of the Fire Department pursuant to the provisions of the Personnel Merit System of the City, 4222 , The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary 4223, Uniform Fire Code Amendment - Section 17a of Appendix E of the Uniform Fire Code as amended to read as follows :, The Chief may cause to be removed and cleared within to (20 ) feet on each side of every roadway all. flammable vegetation or other combustdble growth, and may enter on private property to do so , When the Chief determines that any flammable vegetation or combustible growth consul 1.. - 4 SAFETY FIRE CODE 4223- tes a present tisk, and tbreatens the public health, safety and welfare, he may immediately cause its removal and the reasonable cost of such work shall be charged to the owner of the premises as shown by the current rolls of the Tax Assessoris Office of San Bernardino County, and added to the owner' s tax bill for payment prior to the date upon which taxes are due, and shall be a lien on the real property until is This section shall not apply to single specimens of trees , ornamental shrubbery, or cultivated ground cover such. as green grass , ivy, succulents , or similar plants used as ground cover, provided that they do not for a means of readily transmitting fire. Section 27. 22 Burning of Waste Material Section 27 .22 shall be amended as follows -,,, No waste matter shall be disposed of by burning except as follows £ (1) Hours of Burning, Burning shall take place between the hours of 000 AM and 1100 AM (2) Open durningo Burning of combustible waste matter other than paper may be done in the open under the following conditions :,,, a) A written approval shall be obtained from the San Bernardino County Air Pollution Control District � b) A permit to engage in such burnine shall be obtained from the it Department , Appli- cants for such permit must be in possession and control of the lot or parcel of land on which the burning is to be done (3) Burning inIncinerators , Incinerators shall be placed not less than fifteen feet from combustible buildings or materials . Incinerators all be constructed in such a manner that there is no emisaion or escape of sparks or burning brands Of 5UMiCient size or heat intensity as to ignite or endanger adJacent combustibLe material , and shall meet the minimum construction requirements of the San Bernardino County Air Pollution Control Dlstrict � Use of incinerators shall be limited to the burning ofpaper only, (4) Large Scale Bars ingi No person shall kindle or maintain any open large scale burning except under super- vision and instruction of the Cbief of the fire department or his officers and shall be subject to the following rules and regulations ,, 5 SAFETY FTRE CODE 4224 a) That the granting of such permit shall be issued at the discretion of the Chicf of the Fire Department , and that the granting of such permit shall be based on the volume of etre the equipment required, the time involved ir,, burning such fire , weather , and location of, such fire , b) That the permit for such fire may be revoked upon failure of the person or persons obtain- ing such permit to comply with the instructions of the Fire Chief, or upon an unforeseen, nuisance resulting in excessive smoke or ashes or other annoyance to the adjacent neighborhood, or upon weather changes during the time of burning,, SECTION TWO. That Ordinance Na. 986 and Ordinance No. 12, 5 and any other ordinances or parts of ordinances in conflict herewith be and are hereby repealed. SECTION THREE. This ordinance shall be in force and take effect as provided by law SECTION FOUR. The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in the City of Redlands . ,ATTEST- sZ Waldo F.
