HomeMy WebLinkAboutOrdinances_1324_CCv0001.pdf ORDINANCE NO. 1324 AN ORDINANCE OF THE CITY OF REDLANDS ADOPTING AND ESTABLISHING •RULES AND REGULATIONS OF THE CONSTRUCTION, MAINTENANCE, USE AND OCCUPANCY OF APARTMENT HOUSES, HOTELS AND DWELLINGS WITHIN THE CITY OF REDLANDS ; ADOPT- ING THE UNIFORM HOUSING CODE 1964 EDITION, FOR THE PURPOSE OF PROVIDING MINIMUM REQUIREMENTS FOR THE PROTEC- TION OF LIFE, LIMB, HEALTH, PROPERTY, SAFETY AND WELFARE OF THE GENERAL PUBLIC AND THE OWNERS AND OCCUPANTS OF RESIDENTIAL BUILDINGS . THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS: SECTION ONE: This Ordinance shall be known as the "Uniform Housing Ordinance. " SECTION TWO: Those certain rules and regulations which provide for the construction, modification or alteration, repair or extension of all buildings or portions thereof used, or designed or intended to be used for human habitation, as set forth in that certain code printed in booklet form, and entitled "Uniform, Housing Code, 1964 Edition, " prepared and promulgated by the International Conference of Building officials . Three (3) copies of which Code have here- tofore been filed in the office of the City Clerk of the City of Redlands, and which copies are identified by certificates attached thereto, reading substantially as follows: "I, Peggy As Moseley, hereby certify that the three annexed copies of the Code entitled "Uniform Housing Code, 1964 Edition, " were filed in the office of the City Clerk of the City of Red- lands on the 15th day of November, 1966, and are true, correct and complete copies of said Code which is sought to be adopted by reference by Ordinance of the City Council of said City, Peggy Ad Moseley City Clerk of the City of Redlands, " be and the same are hereby established as rules and regulations and a code of said City; and each and every part of said code, and each and every reference as the "Uniform Housing Code, 1964 Edition, " and is made a part hereof as fully as though set forth at length in this ordinance, except as hereinafter provided. SECTION THREE: The following titles, articles, sections and provisions of the Uniform Housing Code, 1964 Edition are hereby amended to read as follows: Section H-203: Board of Appeal. The Board of Appeal and the procedures concerning its operation as stated in Ordinance No, 1308, City of Redlands, shall also apply to all appeals result- ing from the administration of this Code. - 1 - Section H-401: Change of Definition - BUILDING OFFICIAL. Building Official is the officer charged with the adminis- tration and enforcement of this Code. The Building Official as defined will be the City of Redlands Director of Building and Safety or his regularly authorized deputy. SECTION FOUR: The following section is hereby added to and made a part of the Uniform Housing code, 1964 Edition. Section H-506: Conflict with Other Ordinances. In any case where the requirements of Zoning Ordinance 1000, other ordin- ances adopted by the City of Redlands or laws of the State of California are more restrictive than the standards set forth herein, the provisions of said zoning ordinance, other ordinances adopted by the City of Redlands and laws of the State of California shall apply to all new construction, additions or extensions to any building or structure. SECTION FIVE: Included in the adoption by reference of said Uniform Housing Code, 1964 Edition is the adoption of the following puni- tive provision therein which provides as follows: Section H-204: It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish, equip, use, occupy, or maintain any building or structure in the city, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this Code. Any person, firm, or corporation violating any of the provi- sions of this Code shall be guilty of a misdemeanor, and each such person shall be deemed quilty of a separate offense for each and every day or porti.on . thereof during which any viola- tion of any of the provisions of this Code is committed, con- tinued, or permitted, and upon conviction of any such violation such person shall be punishable by a fine of not more than $300.00 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. SECTION SIX: Each provision of this Ordinance shall be separate and severable and in the event any specific provision is declared void or invalid, no other section, otherwise legal and valid, shall be affected thereby. SECTION SEVEN: This Ordinance shall be in force and effect as provided by law. - 2 SECTION EIGHT: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published once in the Redlands Daily Facts, a daily newspaper hereby designated for that purpose. s/ Waldo F.
