HomeMy WebLinkAboutOrdinances_1471_CCv0001.pdf ORDINANCE NO. 1471 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 42 OF THE REDIANDS ORDINANCE CODE AND ADOPTING THE 1971 EDITION OF THE UNIFORM FIRE CODE THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain as follows - SECTION ONE. That Chapter 42 of the Redlands Ordinance Code be amended to read as follows: Y 0 SAFETY FIRE CODE CHAPTER 42 CHAPTER 42 Article 420. Adoption 1971 Uniform Fire Code 421. Establishment and Duties of the Division (Bureau) of Fire Prevention 422. Limitation of Storage of Flammable and Explosive Materials 423 . Appeals and Penalties 424. Establishment of Fire Zones Article 420 Adoption of the 1971 Uniform Fire Code § 42001 . The herein designated Uniform Fire Code, 1971 Edition, and Appendix A, Appendix C, Appendix D and Appen- dix E thereto, and errata sheets forthcoming, providing regula- tions consistent with nationally recognized standard practice, to safeguard life, health, property and public welfare to a reasonable degree from the hazards of fire and explosion aris- ing from the storage, use and handling of dangerous and hazard- ous materials, substances and devices, the operation, installa- tion, construction location, safeguarding and maintenance of attendant equipment, and the installation and maintenance of adequate means of egress not provided for by the Building Code, are adopted by reference and made a part hereof. Three copies of said code and said appendixes have been certified as true copies and filed in the office of the City Clerk. The code and appendixes so adopted by reference are made a part of this ordi- nance as though set forth at length herein. (1471) Article 421 Establishment and Duties of the Division (Bureau) of Fire Prevention § 42100. The Uniform Fire Code shall be enforced by the Division of Fire Prevention in the Fire Department of the City of Redlands, California, which is hereby established and which shall be operated under the supervision of the Chief of the Fire Department. § 42101 . The Chief of the Division of Fire Prevention shall be appointed by the Chief of the Fire Department pursuant to the provisions of the Personnel Merit System of the City. § 42102 . The Chief of the Fire Department may detail such members of the Fire Department as inspectors as shall from time to time be necessary. 1/4/72 0 0 SAFETY FIRE CODE Article 422 Article 422 Limitation of Storage of Flammable and Explosive Materials 42200. Limits of Districts in Which Storage of Flammable or Combustible Liquids in Outside Aboveground Tanks is to be Prohibited: (a) The limits referred to in Section 15 . 201 of the Uniform Fire Code in which storage of flammable or combus- tible liquids in outside aboveground tanks is prohibited, are hereby established as follows: (1) Not permitted without specific authoriza- tion in writing by the Chief of the Fire Department. (b) The limits referred to in Section 15 . 601 of the Uniform Fire Code, in which new bulk plants for flammable or combustible liquids are prohibited, are hereby established as follows : (1) Not permitted except as specified in Section 28. 51 and Section 29.10 of City of Redlands Ordinance No. 1000 . 42201. Limits in Which Bulk Storage of Liquefied Petroleum Gases is to be Restricted: (a) The limits referred to in Section 20. 105 (a) of the Uniform Fire Code, in which bulk storage of liquefied petroleum gas is restricted, are hereby established as follows: (1) Not permitted without specific author- ization in writing by the Chief of the Fire Department. § 42202. Limits of Districts in Which Storagq of Explosives and Blasting Agents is to be Prohibited: (a) The limits referred to in Section 11.106 (b) of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited, are hereby established as follows: (1) Not permitted without specific author- ization in writing by the Chief of the Fire Department. 1/4/72 SAFETY' FIRE CODE Article 423 Article 423 Appeals and Penalties 42300. Appeals: Whenever the Chief shall dis- approve an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the Code do not apply or that the true intent and meaning of the Code have been misconstrued or wrongly interpreted, the applicant may appeal from the decision of the Chief to the City Council within 30 days from the date of the decision appealed. § 42301 . New Materials, Processes or Occupancies which May Require Permits : The City Manager, the Chief and the Chief of the Division of Fire Prevention shall act as a commit- tee to determine and specify, after giving affected persons an opportunity to he heard, any new materials, processes or occu- pancies, which shall require permits, in addition to those now enumerated in said Code. The Chief of the Division of Fire Prevention shall post such list in a conspicuous place in his office, and distribute copies thereof to interested persons ., 42302 . Penalties: (a) Any person who shall violate any of the pro- visions of this Code hereby adopted or fail to comply there- with, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder, or any certificate or permit issued there- under, and from which no appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the Chief, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively, be guilty of a misdemeanor. (b) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions. (1471) 1/4/72 SECTION TWO. Ordinance No. 1267 and any other ordinances or parts of ordinances in conflict herewith be and are hereby repealed. SECTION THREE. This ordinance shall be in force and take effect as provided by law. SECTION FOUR. The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and pub- lished in the City of Redlands .
