HomeMy WebLinkAboutOrdinances_2309_CCv0001.pdf e ORDINANCE NO. 2309 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTER 5.12 OF THE REDLANDS MUNICIPAL CODE BY THE ADOPTION OF THE NATIONAL ELECTRICAL CODE, 1993 EDITION, AND MAKING RELATED AMENDMENTS THERETO WHEREAS, Government Code Sections 50020 et seg, empowers the City Council of the City of Redlands to adopt by reference various uniform codes, including the National Electrical Code; and WHEREAS, in accordance with Sections 17958.5 and 17958.7 of the Health and Safety Code, the City Council of the City of Redlands ("this City Council") desires to adopt the National Electrical Code, 1993 Edition; and WHEREAS, Health and Safety Code Sections 17958.5 and 17958.7 authorize this City Council to amend the National Electrical Code, based on climatic, geological and topographical conditions existing in the City; and WHEREAS, this City Council is informed and finds that the National Electrical Code, 1993 Edition, should be amended to address the following conditions existing in the City; 1. The City is subject to relatively low amounts of precipitation, very low humidity levels and extremely high temperatures. These climatic conditions are conducive to the spread of fire. For example, during July, August and September, temperatures often exceed 100° Fahrenheit. During the same months humidity is usually less than 40%, and measurements less than 10% are not uncommon. these recordings were documented by the San Bernardino County Flood Control District and the National Climatic Data Center. 2. The City is subject to extremely strong winds, commonly referred to as "Santa Ana Winds," which can reach speeds of 80 miles per hour. Extensive damage often occurs during such winds including downed trees, utility poles, utility circuits and utility service lines. These adverse conditions cause: (1) fires, (2) impairment of emergency apparatus access, (3) delays in response times of emergency apparatus, and (4) the depletion of apparatus readily available for fire suppression activities. For example, one wind storm lasted for approximately six hours and downed over 200 trees citywide in 1985. In 1989, the City experienced a 24 hour period of severe winds during which scores of utility lines were downed in the City impairing emergency access. On one occasion fire units from Redlands were sent to assist in the extinguishment of a fast moving, wind assisted fire in the San Bernardino/Highland Foothills which destroyed or damaged many homes. These units were then unavailable for fire suppression in the City. 3. Within the City there are four earthquake faults (Redlands Heights, Banning, Crafton and the Redlands Faults) and three other faults are located in immediately adjacent areas i DJM725LE 1 (Loma Linda, San Jacinto and the San Andreas Faults). In the event of a severe earthquake, these faults present the potential for catastrophic damage, including fire, damage to roadways and other impairments of emergency apparatus. (This information is according to maps used by Cal Tech, Pasadena and provided by the U.S. Geological Survey); and WHEREAS, the City Council is informed and finds that development has occurred in the City and continues to occur that has resulted in severe traffic congestion during peak business hours, weekends and holidays thus, decreasing emergency response time particularly on the following streets and highways: Citrus Avenue, Cajon Street, Orange Street, Lugonia Avenue, Colton Avenue, Tennessee Street, San Timoteo Canyon Road and 1-10 Freeway, The City Council of the City of Redlands does ordain as follows: Section 1. The text of Chapter 15.12 of the Redlands Municipal Code is hereby deleted in its entirety and rewritten to read as follows: "Chapter 15.12 NATIONAL ELECTRICAL CODE Section 15.12.010 Document adopted by reference - copies on file. Section 15.12.015 NEC Section 90-10 - future expansion and convenience. Section 15.12.020 NEC Section 90-11 added - Administration, Board of Appeals and permit fees Section 15.12.030 NEC Section 90-12 added - Electric fences. Section 15.12.035 NEC Section 90-13 added - 'Used materials. Section 15.12.045 NEC Section 90-14 added - Trailers. Section 15.12.010 Document adopted by reference - copies on file. That certain document on file in the Office of the City Clerk which is marked and designated as "National Electrical Code, 1993 Edition," and each and all of the regulations, provisions, additions and terms of the National Electrical Code as amended in this Chapter, are referred to, adopted and made a part of this Chapter. There is a copy of the document and code referred to above now on file in the office of the City Clerk. 15.12.015 NEC Section 90-10 - future expansion and convenience. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this Code, is amended by adding Section 90-10, which shall read as follows: "Section 90-10. Distribution centers Located in readily accessible locations shall provide three additional approved conduits, three quarter inch minimum in size; two additional conduits for interior and one for exterior use." DJIM725LE 2 15.12.020 NEC Section 90-11 added - administration, Board of Appeals and permit fees. The first chapter of the National Electrical Code, entitled Article 90, Introduction. as incorporated into this Code, is amended by adding Section 90-11, which shall read as follows: Section 90-11. Administration. (1) Board of Appeals. The Board of Appeals and the procedures concerning its operation, as stated in Chapter 15.04 of the Redlands Municipal Code, shall also apply to all appeals resulting from the administration of this Code. (2) Electrical Permit Fees. Table 3-B of the Uniform Administrative Code shall be deleted and Electrical Permit Fees shall be as per resolution of the City Council. Minimum electrical permit will be $30.00. 15.12.030 NEC Section 90-12 added - Electrical fences. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this code, is amended by adding Section 90-12, which shall read as follows: Section 90-12. It is unlawful to install any type of electric fence within the City of Redlands. Electric fences prohibited include those energized by battery, generator or electrical utility. 15.12.035 NEC Section. 90-13 added - Used material. The first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this Code, is amended by adding Section 90-13, which shall read as follows: Section 90-13. Previously used electrical material shall not be reused without written approval obtained in advance from the Building Official. 15.12.045 NEC Section 90-14 added - Trailers. This first chapter of the National Electrical Code, entitled Article 90, Introduction, as incorporated into this code, is amended by adding Section 90-14, which shall read as follows: Section 90-14. Trailers, mobile homes, commercial coaches and house cars being utilized for construction projects as defined in Section 8.20 which connect to temporary power shall comply to the City's adopted National Electrical Code. Trailers, mobile homes, commercial coaches and house cars connected to an electrical source shall apply for an electrical permit, a $30.00 placement permit DJM72SLE 3 and deposit a refundable $2,000.00 bond or bond equivalent prior to the placement and inspections." Section 2.
