AN ORDINANCE OF THE CITY OF REDLANDS ADDING
ARTICLE 925 TO CHAPTER 92 OF DIVISION 9 OF
THE CITY OF REDLANDS ORDINANCE CODE RELATING
TO VESTING TENTATIVE MAPS
THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN:
SECTION ONE: Article 925 is added to Chapter 92 of
Division 9 of the City of Redlands Ordinance Code as follows :
"ARTICLE 925
VESTING TENTATIVE MAPS
SECTION 92501 . GENERAL PROVISIONS
(a ) This Ordinance is adopted to supplement and.
implement Chapter 113 of the Statutes of 1984 (S . B. 1660 ) relating
to vesting tentative maps .
( b) The purpose of this Ordinance is to establish
procedures necessary for the implementation of the Statute
relating to vesting tentative maps , and to supplement the
provisions of the Subdivision Map Act and the Subdivision
Ordinance of Redlands . Except as otherwise provided herein, the
provisions of the Subdivision Ordinance of Redlands shall apply to
vesting tentative maps .
(c) This ordinance may be cited as the "Vesting
Tentative Map Ordinance . "
SECTION 92503 . DEFINITIONS
(a ) "Development" means the uses to which the land
which is the subject of a map shall be put, the buildings to be
constructed on it, and all alterations of the land and
construction incident thereto .
(b ) "Vesting tentative map" means a "tentative map" for
a proposed residential subdivision that shall have printed
conspicuously on its face the words "Vesting Tentative Map" prior
to filing and is thereafter processed in accordance with the
provisions of this Article .
SECTION 92505. APPLICATION
(a ) This Ordinance shall apply only to residential
development .
(b) Whenever a provision of the Subdivision Map Act, as
implemented and supplemented by the Subdivision Ordinance of
Redlands, requires the filing of a tentative map or tentative
parcel map for a residential development , a vesting tentative map
may be filed in accordance with the provisions hereof .
SECTION 92507 . COMPLIANCE WITH PROPOSITION R.
Notwithstanding any other law implementing the
provisions of the initiative ordinance to moderate growth within
the City of Redlands ( "Proposition R" ) , prior to filing a vesting
tentative map the applicant must first submit the proposed
residential development to the City' s point rating evaluation and
must qualify for and receive residential development allocations,
or must demonstrate to the City' s satisfaction that the
development is exempt from that allocation process .
SECTION 92509 . VESTING TENTATIVE MAP PROCESSSING FEE.
Every person submitting a vesting tentative map shall
pay a processing fee in an amount prescribed by resolution of the
council .
SECTION 92511. FILING OF VESTING TENTATIVE MAP.
(a ) Vesting tentative maps shall be filed with the
Planning Department and shall be processed in accordance with the
Subdivision Map Act, the Subdivision Ordinance of Redlands and
this Ordinance .
(b) At the time a vesting tentative map is filed it
shall have printed conspicuously on its face the words "Vesting
Tentative Map. "
(c) At the time a vesting tentative map is filed the
subdivider shall also provide the Planning Department with the
following information:
architectural landscaping plans
detailed information regarding the height ,
size and location of buildings

- city approved plans for all required site and off-
site improvements , including but not limited to,
streets , storm drains , water, sewer and lighting
information on the uses to which the buildings
will be put
- detailed grading plans
- geological studies including soil reports for
street design and building purposes
- complete hydrological study when required by City
staff and all other necessary flood control
information
SECTION 92513 . EXPIRATION OF VESTING TENTATIVE
MAP APPROVAL.
The approval or conditional approval of a vesting
tentative map shall expire at the end of the same time period,
and shall be subject to the same extensions established by the
Subdivision Ordinance of Redlands for the expiration of approval or
conditional approval of a tentative map.
SECTION 92515 . VESTING ON APPROVAL OF VESTING
TENTATIVE MAP.
(a ) The approval or conditional approval of a vesting
tentative map shall confer a vested right to proceed with
development in substantial compliance with the Ordinances ,
policies and standards described in Government Code Section
66474 . 2 .
( b ) However, if Section 66474 . 2 of the Government Code
is repealed, the approval or conditional approval of a vesting
tentative map shall confer a vested right to proceed with
development in substantial compliance with the ordinance, policies
and standards in effect at the time the vesting tentative map is
approved or conditionally approved.
(c) Notwithstanding Subsections (a ) and ( b) , a permit ,
approval , extension, or entitlement may be made conditional or
denied if any of the following are determined:

1 . A failure to do so would place the residents of
the subdivision or the immediate community, or both, in a
condition dangerous to their health or safety, or both.
2 . The condition or denial is required in order to
comply with State or federal law.
(d) The rights referred to herein shall expire if a
final map is not approved prior to the expiration of the vesting
tentative map as provided in Section 92513 .
(e ) In the event the final map is approved, these
rights shall last for the following periods of time :
1 . An initial time period of one ( 1 ) year
beyond the recording of the final map.
2 . Where several final maps are recorded on
various phases of a project covered by a single vesting tentative
map, the one year initial time period shall begin for each phase
when the final map for that phase is recorded.
3. The initial time period shall be automatically
extended by any time used by the City for processing a complete
application for a grading permit or for design or architectural
review, if the time used by the City to process the application
exceeds 30 days, from the date that a complete application is
filed.
4 . The subdivider may request a one--year extension
at any time prior to the expiration of the intitial time period
provided by this Section. The application shall state the reasons
for requesting the extension. The Council shall consider the
application as soon as practicable after filing. The Council
shall set forth its reasons for granting any extension.
5 . If the subdivider submits a complete
application for a building permit during the periods of time
specified in this Section, the rights referred to herein shall
continue until the expiration of that permit or any extension of
that permit granted by the City. "
SECTION 92517. PAYMENT OF FEES.
Tentative approval of a vesting map shall not relieve
the developer of any requirement to pay all fees, including water
and sewer frontage fees as appropriate. Such fees shall be
calculated as of the date of final approval , and final approval
shall be deemed conditional upon payment of all such required
fees .

SECTION TWO: This Ordinance shall be in force and take
effect as provided by law.
SECTION THREE: The City Clerk shall cerify to the
adoption of this Ordinance and cause it to be published once in
the Redlands Daily Facts, a newspaper of general circulation
printed and published in the City.
