HomeMy WebLinkAboutOrdinances_2654_CCv0001.pdf ORDINANCE NO. 2654 AN ORDINANCE OF THE CITY OF REDLANDS AMENDING CHAPTERS 3.62 AND 13.44 OF THE REDLANDS MUNICIPAL CODE RELATING TO RATES AND CHARGES FOR WASTEWATER SERVICES WHEREAS, the Utilities Advisory Committee, a committee established and appointed by the City Council of the City of Redlands ("this City Council"), and City staff, have recommended to this City Council that revisions to the City's wastewater rates and charges are necessary to recover the reasonable costs the City incurs by providing wastewater service to its customers and meeting the operating expenses of the City; and WHEREAS, the City has provided written notice by mail of the date, time and place of a public hearing on the proposed rates and charges to the record owner, and tenants, of each parcel of property on which the rate or charge is to be imposed, the specific amount of the rate or charge, the reason for the rate or charge, and the basis upon which the rate or charge was calculated; and WHEREAS, at a duly noticed public hearing, held not less than 45 days after the mailing of notice of the proposed rates and charges, verbal and written testimony was presented to this City Council relating to the proposed revisions in the City's rates and charges for wastewater service; and WHEREAS, at the public hearing on the proposed rates and charges, this City Council considered all protests against such rates and charges and determined that written protests against the rates and charges were not presented by a majority of owners of the parcels upon which the rates and charges are to be imposed; and WHEREAS, pursuant to Health and Safety Code section 5741, adoption of this ordinance requires a two-thirds vote of the members of this City Council; THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS: Section 1, Section 3.62.040 of the Redlands Municipal Code is hereby amended to read as follows: "3.62.040 Amount of Charges. Subsection 13.44.120 D of the Redlands Municipal Code is hereby amended to read as follows: "D. Sewer main frontage charge per foot shall be thirty dollars." Section 3. This City Council hereby finds and determines that the City's establishment and/or modification of the rates and charges approved by this ordinance is exempt from review under the California Environmental Quality Act ("CEQA") pursuant to Public Resources Code Section 21080(b)(8) and CEQA Guidelines Section 15273, because such rates and charges are necessary for meeting operating expenses of the City. Section 4. The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this ordinance shall take effect as provided by law.
