IPAL CODE RELATING TO RATES D CHARGES FOR 'Vv'ATER SERVICE WHEREAS, the l_xtilities Advisory Committee, a committee~ established and appointed by they City Council of the City of Redlands ("this City Council") and City staff, have recon-unaended to this City Council that revisions to the City's water rates and charges are necessary to recover the reasonably casts the:. City incurs by providing water set-vice to its ce:stonaers and meeting the operating expenses of the City-, and WHEREAS, the: City has provided written notice by mail of the date, time and place of a public hearing on the proposes rates and charges to the record;owner and tenants, of each parcel of property on which the rate or charge is to he imposed, the specific arnount of the rate; or charc, the reason for the rete or charge, and the basis Capon which the rate or charge � a calculated, and WHEREAS, at a duty noticed public hearing, held not less than 45 days after the mailing of notice of the proposed rates and charges, verbal and written testimony was presentee to this City Council relating to the; proposed revisions in the City's rates and charges< for water service; and WHEREAS, at the public hearing can the proposed rates and charges, this C'it Council considered all protests against such rues and charges and determined that written, protests against the rates and charges were not presented by a majority of owners of the parcels upon which the rates and charges are to he imposed; THE CITY COUNCIL OF THE CITY" OF REDLANDS DOES ORDAIN AS FOLLOWS: Section 1.. A. The City may use a unified billing system for City-provided services. The charges for water, wastewater, and refuse service, or any cattier City provided services, tilay be billed can one bill and collected as one item_. Failure to pay the amount dace in full for any of the services may result in the discontinuation of water services. Procedures and charges for restoration of service are set forth in Section 3.52,040 and 1112.050 of this Code. Z� E Failure to receive a bill shall not relieve the consumer of liability. Any amount due Shall he deerried a debt to the City, and any person, firm or corporation falling, neglecting or refusing neglecting; to pay said indebtedness shall, be liable in a civil action brought by the City in any court of competent jurisdiction for the amount thereof F. In addition to any other remedies it may have for the collection of delinquent accounts, the City may cause notice of a hearing on delinquent accounts in accordance with Government Code Sections 25831 and 38790.1. Such notice shall be mailed to property owners listed as delinquent accounts not less than ten days prior to the date of the hearing. At the hearing, the City Council shall hear any objections or protests of such property owners. The City Council may make such revision, corrections or deletions to the report of delinquent accounts as it deems just, after which, by resolution, the report shall be confirmed. The delinquent charges set forth in the delinquent account report may be placed as a lien on such properties for the amount of such delinquent charges plus legal fees and administration costs. A certified copy of the confirmed report shall be filed with the City Clerk for the current tax roll. The lien created attaches upon recordation, in the Office Of the County Recorder, of a certified copy of the resolution of confirmation. All laws applicable to the levy, collection and enforcement of City ad valorem property taxes shall be applicable to such liens.- Section 5. Section 13,1 6.030 of the Redlands Municipal Code is hereby amended to read as follows: "Section 13.16.030 Meter Testing When the accuracy of water ureter is questioned, the City, upon request of the customer, will cause an official test of the meter to be made for a charge as set forth in Section 3. 2.040 of this Code. The meter will be tested on variable rates of delivery and if the average registration is more than two percent (211/t)) in excess of the actual quantity of water passing through the meter, the division shall refund to the CUStOrner the overcharge based upon the test, for the prior twelve (12) months, unless it can be shown that the error was due to some cause for which the date can be fried. In the latter case, the overcharge shall be Computed back and not beyond such tu-nes. In the event the accuracy of the meter is determined to be In error, than all testing and meter replacement charges shall be at the City's expense." DJ%1'-,0RD1NAN(T`:2655 Page 12 Section 6, This City Council hereby finds arid determines that the City's establishment and/or modification of the rates arid charges approved by tills ordinance is exempt front review tinder the California Environmental Quality Act ("CEQA") pursuant to Public Resources Code Section 21080(b)(8) and CEQA Guidelines Section 15273, because such rates and charges are necessary for meeting operating expenses of the City, Section 7. The Mayor shall sign this ordinance and the City Clerk- shall certify to the adoption of this ordinance and shall cause it, or a snuirriary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this ordinance shall take effect as provided by law.
