HomeMy WebLinkAboutOrdinances_1684_CCv0001.pdf 3 i ORDINANCE NO. 1684 AN ORDINANCE OF THE CITY OF REDLANDS RELATING TO THE ACQUISITION OF WATER STOCKS AND WATER RIGHTS, ESTAB- LISHING THE WATER SOURCE ACQUISITION FUND; AMENDING ARTICLE 592 OF THE REDLANDS ORDINANCE CODE; REPEALING ORDINANCE NO. 1322, AS AMENDED BY ORDINANCE NO. 1474; RESCINDING ORDINANCES NOS . 1217 AND 988; AND PORTIONS OF ORDINANCES OR RESOLUTIONS THAT MAY BE IN CONFLICT WITH THIS ORDINANCE THE CITY COUNCIL OF THE CITY OF REDLANDS does ordain as follows : SECTION ONE: Ordinance No. 1322 entitled "An Ordinance of the City of Redlands, California, Relating to the Acquisition of Stocks and Water Rights by said City with Particular Regard to New Dwellings and Sub- divisions, " as amended, is hereby repealed. SECTION TWO: Article 592 of Chapter 59 of the Redlands Ordinance Code is hereby amended to read: i WELFARE WATER ARTICLE 592 ARTICLE 592 ACQUISITION OF WATER STOCKS AND WATER RIGHTS AND ESTABLISHING THE WATER SOURCE ACQUISITION FUND § 59200. In order to provide an adequate water supply for new dwellings, subdivisions, and other land develop- ments within the City, and approved developments outside the City, and to conserve the water supply, this ordinance requires that land owners, subdividers , and developers, before receiving final approval or securing water service, shall first pay to the City certain fees or convey to the City certain approved water rights or water stock. The fees received by the City are to be utilized for the purpose of water resource development including the purchase of approved water stock. (1684) § 59201. The "Water Source Acquisition Fund" shall be established by the City for the purpose of providing funds for water resource development and the purchase of approved water stock. All existing funds within the existing "Water Stock Acquisition Fund" shall be transferred into the "Water Source Acquisition Fund. " (1684) § 59202. A. Before any land subdivision, land development, or improvement that will require water service from the City is given final approval, the owner of the land shall make payment to the City of Redlands for deposit into the "Water Source Acquisition Fund" or convey to the City, free and clear with all assessments paid to the date of con- veyance, sufficient City-approved water stock or other lawful water rights acceptable to the City in accordance with this ordinance. (1684) B. Land Development or Improvements within the City of Redlands : (1684) 1. Single Family Subdivisions: Pay $1, 000 per gross acre to be developed or convey acceptable water stock. If any lot or lots exceed 20, 000 square feet in area, such area in excess of 20 , 000 square feet shall be deducted from the total acreage of the subdivi- sion. 2 . Minor Single Family Subdivision: Pay $250 . 00 per lot created or convey acceptable water stock or water rights. Ordinance No. 1684 - Page two WELFARE WATER § 59202 (B) , Cont. 3. Single Family Home on Single Lot: Pay $100. 00 or convey acceptable water stock or water rights . (1684) 4 . Multiple Unit Residential Subdivi- sions and Multiple Unit Development: Pay $100. 00 per dwelling unit or convey acceptable water stock or water rights. (1684) 5. Non-Residential Developments or Improvements: Pay $100. 00 per miner inch day per month (MID/Mo. ) or $0. 0579 per cubic feet per month (ft. 3/Mo. ) of City of Redlands ' estimated average monthly water consumption for development or convey acceptable water stock or water rights . (1684) C. Land Developments or Improvements Out- side of the City of Redlands: The fees and requirements for land development or improvements outside of the City of Redlands shall be the same as for developments or improvements within the City, excepting for the Single Family Home on a Single Lot" shall be to pay $250. 00 or convey acceptable water stock or water rights. (1684) § 59203. In the event land owners or developers desire to convey to the City of Redlands acceptable water stock or water rights in lieu of paying cash, the following cash credit for stock in the following water companies or water rights shall be given: (1684) Mill Creek Water Rights $100. 00 per miner inch day per month (MID/Mo. ) Crafto4 Water Company $670 . 00 per share of stock Redlands Heights Water Co. $410. 00 per share of stock South Mountain Water Co. $180 . 00 per share of stock East Redlands Water Co. $415 . 00 per share of stock Lugonia Water Company $ 32 . 00 per share of stock Redlands Water Company $ 69. 00 per share of stock West Redlands Water Co. $ 43 . 00 per share of stock East Lugonia Water Co. $ 21. 00 per share of stock Lugonia Park Water Co. $ 12 . 00 per share of stock Bear Valley Mutual Water Co. $ 2. 50 per share of stock Ordinance No. 1684 Page three WELFARE WATER 59204 § 59204. The cash credit amounts provided to land owners or developers shall not exceed the cash requirements under this ordinance, excepting in order to provide cash credit for the nearest full share of water stock. "Water Credits" shall not be provided to land owners or developers with surplus shares of water stock or portions thereof. (1684) § 59205. Cash credit shall be provided to land owners or developers for their "Water Credits" on file in the office of the Public Works Department of the City of Redlands. The cash credit shall not exceed the cash requirements under this ordinance and shall be set at $100. 00 per miner inch day per month (MID/Mo. ) . Cash credit for "Water Credits" shall be terminated five (5) years after the effective date of this ordinance and all remaining "Water Credits" on file shall be terminated five (5) years after the effective date of this ordinance. (1684) § 59206 . The Water Board, consisiting of the City Manager, Public Works Director, and the Utilities Engineer, shall review annually the list of Water Companies and related cash credit amounts per share of stock contained herein, and shall report prior to January 31 of each year to the City Council of Redlands relative to their findings and recommenda- tions. (1684) § 59207. Subsequent changes to the cash requirements and cash credit provisions contained herein shall be changed or modified as needed by resolution. (1684) § 59208 . All revenue to the City of Redlands collected in accordance with this ordinance shall be deposited into the "Water Source Acquisition Fund. (1684) Ordinance No. 1684 - Page four SECTION THREE: This ordinance shall be in force and take effect as provided by law. SECTION FOUR: The City Clerk shall certify to the adoption of this ordinance and cause the same to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in this City.
