AN ORDINANCE OF THE CITY OF REDLANDS AMENDING ARTICLE 941 OF THE
REDLANDS ORDINANCE CODE ESTABLISHING PROCEDURES FOR ALLOCATION OF
WATER AND SEWER CONNECTIONS IN THE UNINCORPORATED AREA WITHIN THE
CITY OF REDLANDS SPHERE OF INFLUENCE.
THE CITY COUNCIL OF THE CITY OF REDLANDS does hereby ordain
as follows:
SECTION
Article 941 of the Redlands Ordinance Code is hereby
amended as follows:

ALLOCATION OF WATER ANIS SEWER CONNECTIONS OUTSIDE OF THE CITY LIMITS'
Sec. 94100. IMPLEMENTATION OF PROPOSITION R. SECTION 6
The City Council shall implement section 6 of Proposition R by
allocating water and/or sewer service connections to up to 1.50
dwelling 'units outside the City but within the City' s sphere of
influence in: each calendar year pursuant to the procedures set
forth in this Article.
Sec 94101. DEFINITIONS'
1. "Water Allocation" .Weans the allocation of e dwelling
unit to be served by water connection to the Redlands
Domestic Water System.
. "Sewer Allocation' means the allocation of a dwelling
unit to be served by sewer connection to the Redlands
Domestic Sewerage system.
3 . "Major Project* means a, development with five (5) or
more dwelling units, existing or proposed.
4. "Minor Project' means a development with four (4) or
less dwelling units, existing or proposed.
5 . "Water Board* consists of the City Manager, utilities
Director, and Utilities Engineer.
Sec. 94102. GENERAL REQUIREMENTS
Allocations shall be rade in accordance with the following provi-
sions:
1. Application for water and/or sewer allocations shall be
filed with the Municipal utilities Department. In order
to apply for water or sewer allocations, the applicant
must be the owner of the property for which the service
is requested, or the .legal, agent of the owner.; Applica-
tions
pp ica-tions shall expire at the end of the calendar year, new
applications must be filed for the new calendar year.
2. Projects shall be consistent with the Redlands General
Plan as interpreted by the City Council.

. Allocations shall be distributed ' o minor projects on a
first come, first served basis up to 25 water, sewer, or
water and sewer allocations per calendar year. Unused
allocations shall be transferred to the major project
pool in December of each year.
4. A maximum of 35 water, sewer', or water and sewer
allocations per major project per allocation period
shall be awarded by the City Council in accordance with
the fbllowing schedule.
April 65 allocations.
August 60 allocations.
December Any unused current year allocations.
5 All County-approved major projects requesting water or
sewer connections shall be allocated by the City
Council. The order of priority sof the project shall be
established by the time at which final grading plans
and improvement plans are submitted to the County for
plan check and for which fees have been paid.
6. Major projects must receive final approval and building
permits within two years from date of; award or lose the
allocation.
7. Minor projects must 'receive final approval and building
permits within one year from date of award or Lase the
allocation.
8. A processing fee shall be charged for processing all
applications for water and/or sewer allocations. The
processing fee per single family dwelling or per
multiple family dwelling unit, the processing fee for
all other applications for service that are not for
residential development allocation, and the maximum
charge shall be established by City 'Council resolution
or Article 144 of the Municipal; Code. The processing,
fee shall not be refundable. However, a new processing
fee shall not be required for reapplication for the same
units in the same project.
Sec. 94103. WATER ALLOCATIONS
1. Application for dwelling units shall be submitted to the
Water Hoard for approval or to recommend approval of all
water allocations for connections to the Redlands water
system for property within the unincorporated area in
the City's sphere of influence, subject to the following
conditions:

a. Minor Projects.
1. The Water Board shall determine what facili-
ties are required to provide water connec-
tions.
2 . To assure that expansion of the Redlands
Domestic Water System will conform to sound
#` operational policies, and be within the
capacity of its facilities, the Water Board
may, at its discretion, reject any application
that is determined to be detrimental to the
Citic System
b. Major Projects.
1. Major projects shall comply with the require-
ments of Section 94103.1.a
2. The Water Board shall refer the application to
the planning Department for verification that
the existing or proposed development is con-
sistent with the Redlands General Flan.
3. Upon receipt of lana use information from the
Planning Department and confirmation from the
Municipal Utilities Department that the exist,
ing or the required facilities are adequate to
provide the additional wager connections, the
WaterBoard shall recd end, approval or
denial of the application for allocations to
the City Council.
2. Following approval of water allocations, the applicant
shall be subject: to the following conditions:
a. Applicant shall pay all applicable charges as
required by the Redlands ordinance Code before
connections will be approved.
b. Connections will be approved only after the appli-
cant installs facilities in accordance with City
requirements and specifications.

C* Before connections will be approved, the owner of
the property to be served shall enter into an
agreement and record same as a covenant running
with the land requiring the owner to annex the
property to the City of Redlands, subject to any
outstanding bond obligations of the Cityof
Redlands, within 120 days after the City requests
annexation. The owner shall state in the agreement
that in the event the property is not annexed to
the City of Redlands within the 120 day period, the
water rates and charges to that property shall be
twice the normal outside rates until such time as
the property is annexed to the City of Redlands.
d. water connections made under the provisions of
this Article shall comply with all the rules and
regulations established by the City..
e. In the event a- water meter is issued and subsequent
action by the owner or occupant results in a change
of zone or property use that is inconsistent with
the general plan of the City of Redlands, or the
owner ;refuses to annex upon request of the City,
the meter will be removed and water service
discontinued.
Sec. 94104 SEER ALLOCATION
1. Application for dwelling units shall be submitted to the
water Roam for approval or to recommend approval of all
sewer allocations for connections to the Redlands sewer
system for property within the unincorporated area in
the City's sphere of influence, subject to the following
conditions ,
a. Minor Projects.
1. Sewer allocations shall be provided only to
those projects receiving domestic water from
the City of Redlands domestic water system.
2. The water Board shall, determine what facili-
ties are required to provide the connections.

3 . To assure that the operation of the City sewer;
system conforms with all requirements of the
State Health Department and the mater Quality
Control Board, and other sound operational
policies and within the capacity of its
facilities, the Water Board may at its dis-
cretion, reject any application that is
determined to be detrimental to the City
system.
b. Major Projects.
1. All major projects will comply with the
requirements of Section 94104.1.a.
2 The water Board shall refer the application to
the Planning department for verification that

T7N SEVERA13ILITY
If any portion of this Ordinance is found to be unconstitutional
or invalid the City Council hereby declares that it would have
enacted the remainder of this Article regardless of the absence of
any such invalid part.
S=-T.1 THREE: REPEALER`
The portion SeAion 1 of Ordinance No. 1946 establishing Article
942 is hereby repealed.
19ECTIQ fQR&O EFFECTIVE DATE
This Ordinance shall be in farce and take effect as provided by
law.
21S.TIM ULM. CERTIFICATION
The City Clerk shall certify to the adoption of this Ordinance and
cause it to be published once in the Redlands gaily Facts, a
newspaper of general circulation and published in this City.
