HomeMy WebLinkAboutOrdinances_1677_CCv0001.pdf ORE ORDINANCE NO. 1677 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS PROHIBITING THE ISSUANCE OF PERMITS FOR WATER AND SEWER CONNECTIONS UPON NINETY PER CENT USE OF SYSTEM CAPACITY THE CITY COUNCIL OF THE CITY OF REDLANDS does hereby find as follows : WHEREAS, the voters of the City of Redlands on November 7 , 1978 , exercised their initiative right to adopt Proposition "R" entitled "INITIATIVE ORDINANCE TO MODERATE THE RATE OF GROWTH WITHIN THE CITY OF REDLANDS TO PRESERVE THE CITY' S UNIQUE ENVIRONMENT AND CHARACTER" ; and WHEREAS , connections to the municipal water and sewer systems have a direct impact upon sound and proper planning and zoning for land uses within the City of Redlands, particularly in areas adjacent to the municipal boundaries; and WHEREAS, a determination by the City Council to with- hold all permits for connections, and connections to the water and sewer systems when the systems are utilized at ninety (90) per cent of capacity is necessary to promote the orderly and sound planning of the use of land, and the operation of municipal water and sewer services within and without the City of Redlands ; and WHEREAS , a principal basis for approving Proposition "R" is the finding by the voters with respect to water and sewage services as follows : " . . . . . that accelerating and disorderly residential growth have caused conditions harmful to the public health, safety and general welfare have resulted or will soon result in overcrowding of schools , deteriorating water quality and sewage treatment capacity. . . . . " WHEREAS, this City Council of the City of Redlands finds and determines that the protection of the public health, safety and welfare of the people of Redlands requires the cessation of additional connections to the municipal water and sewer systems after they reach ninety (90) per cent capacity and such connections conflict with contemplated proposals or plans which this legislative body, the Planning Commission, or the Planning Department are considering or intending to study immediately; and WHEREAS, it is appropriate and proper to examine any developments that may cause significant or irreversible environmental impacts upon zoning of land uses within the City of Redlands; and WHEREAS, a moratorium on the issuance of permits or approvals of water and sewer connections to the City water and sewer systems is necessary to preserve the public safety, health and welfare once the systems have been utilized to ninety (90) per cent of total capacity; THE CITY COUNCIL OF THE CITY OF REDLANDS DOES HEREBY RESOLVE AS FOLLOWS: SECTION ONE: The Departments of Public Works, Building and Safety, and Planning of the City of Redlands are ordered not to issue any permits or approvals for connections to the water and sewer systems of the City of Redlands once such municipal systems have reached ninety (90) per cent of their total capacity. SECTION TWO: The time at which the use of the water and sewer systems have reached ninety (90) per cent of total capacity shall be determined by the City Council. ATTEST: �..
