AN ORDINANCE OF THE CITY OF REDLANDS AMENDING
CHAPTER 3 .52, ADDING CHAPTER 3 .62, AND DELETING
SECTIONS OF CHAPTER 13 .48 OF THE REDLANDS MUNICIPAL
CLUE RELATING TO WATER AND SEWER SERVICE FUND

WHEREAS, the California Health and Safety Code
Section 5471 requires that water and sewer fees be establish-
ed by ordinance adopted by a two-thirds vote;

Sections 13 .12.080 and 13 .12 .090 of the Redlands Muni-
cipal Code are amended to read as follows:
13.12.080 Prepayment.
The Water Division shall require a prepayment from all
applicants who have not established credit. Established
credit is defined as one year of service with a satisfactory
payment record. This prepayment shall be the larger of the
two following amounts: seventy dollars minimum or a sum
equal to three times the costs of the average or estimated
monthly service rendered. The prepayment shall be refunded
at the end of the one year without interest, or at an earlier
date if the consumer orders the service discontinued, pro-
vided that the water bills have been paid in full.
13.12.090 Deleted
SECTION THREE:
Chapter 3.62 is hereby added to the Redlands Municipal
Code as follows:
3.62.010 Establishment.
There is established the Sewer Service Fund to provide
for administration , operation, and maintenance of the Red-
lands domestic sewerage system and its capacity to serve its
existing users. All interest in the cash balance of the Fund
shall accrue to the Sewer Service Fund. The following rules
shall apply:
A. All service charges and all miscellaneous charges
not otherwise designated shall be credited to the Sewer
Service Fund.
B. Established within the Sewer Service Fund is a
reserve for capital. The reserve for capital shall be in
addition to annual capital replacement budget, to establish a
fund for capital expenditures necessary due to unforeseen or
unusual capital costs in any year, necessary to maintain the
existing system and its capacity.

3.6 .020 Definitions.
For the purpose of carrying out the intent of this
chapter, the following definitions shall apply.-
A.
pply.A. "Multiple family dwelling unit" means a structure
designed and used for occupancy of two or more families, but
does not include motels, hotels, or rest homes, nursing
homes, with common cooking facilities.
B. "Single family dwelling unit" means a structure or
portion thereof used exclusively for the occupancy of one
family.
C. "Premises" means a lot, parcel of land, building or
establishment .
D . "Sewerage system means those pipelines and
appurtenances maintained and operated by the City for the:
collection and conveyance of sewage to the plant owned and
operated by the City, wastewater treatment, and treatment and
discharge of such wastewater to required standards.
E. "Sewer connection" or "connection" means physically
tapping into sewer mains or their laterals for the purpose of
serving a private sewer line or building sewer from a prop-
erty or premises .
F. "Sewer rates" means the sewer rates, rate stru+ --
tures, and rete classes to be established by the City Council
to be used as a basis for charging users for service from the
sewerage systema
C. "Sewer service charge" means service charges for
the use of the sewerage system based on sewer rates.
3.62.030 Charges.
The sewer service charges for the following cate-
gories shall be paid for sewer service.
Every person whose premises in the City are served
by a connection with the .sewerage system of the City, whereby
the sewage or industrial wastes:, or either or both, are
disposed of by the City, either through the facilities of the
wastewater treatment and sewage disposal works owned by the
City, of otherwise, shall pay a sewer service charge which
shall be as specified in Section 3 .62.040 of this Code.
A. Residential: Pates
1. For all dwelling units including; single-family
dwelling units's multi-family dwelling units, and mobilehomes,
having cooking facilities there shall be a charge per month:.
2 For each dwelling unit zi.thout cooking facilities
there shall be a charge per month:-.
B. Non-residential
All non -residential users shall pay_ a monthly
charge based on a charge for each one thousand gallons or
fraction there of estimated sewage discharge.
C. Schools
Each school shad pay a sewer service fee per month for
each one hundred average daily attendance or part thereof.

Sections 13 .48-.010 , .020 , .030 , .040, and «060 are
deleted from the Redlands Municipal Cade as follows:
13.48.010 Definitions.
As used in this chapter.
A. "Apartment house" means any building containing
three or more dwelling units with separate plumbing facili-
ties, but shall not include any building commonly known as a
hotel, motel_, or auto court .
H. "City" means the City of Redlands.
C. "Premises" means a lot, parcel of land, building or
establishment.
D. "Sewerage system" means these pipelines and
appurtenances maintained and operated by the City for the
collection and conveyance of sewage to the plant awned and
operated by the City, wastewater treatment, and treatment and
discharge of such wastewater to required standards .
E. "Surer connection" or "connection" means physically
tapping into sewer mains or their laterals for the purpose of
serving a private sewer line or building sewer from a prop-
erty or premises,
F. "Sewer rates" means the sewer rates, rate struc-
tures, and rate classes to be established by the City Council
to be used as, a basis for charging users for service from the
sewerage system.
C. "Sewer service charge" means service charges for
the use of the sewerage system based on sewer rates .

13.40.024 Designated_.
Every person whose premises in the City are served by a,
connection with the sewerage system of the City, whereby the
sewage or industrial wastes, or either or both, are disposed
of by the City, either through the facilities of the waste-
water treatment and sewage disposal works owned by the City,
or otherwise, shall pay a sewer service charge which shall be
set by City Council resolution based on the following rates;
A . Domestic Rates
1. For all dwelling units including single-family
residences, apartments, hotel accommodations and mobilehomes,
having cooking facilities there shall be a charge per month.
2 For each dwelling without cooking facilities there
shall be a charge per month
E. Each school shall, pay a sewer service fee according
to the following schedule: a charge per month during the
school term .for each: one hundred average daily attendance or
part thereof, computed on the previous year' s attendance.
C Each business establishment, manufacturing plant,
commercial house, industrial building, or plant shall pay ar
monthly charge for each sewer connection based on the amount
of water consumption of said premises .as follows: a charge
for each one thousand cubic feet or fraction thereon.
The above charge shall be based on one hundred percent
of the estimated coat for sewage treatment and disposal per
milligram.
D. Club buildings and meeting places shall be charged
on the same basis as commercial houses, business establish-
ment
stabli. h-mentand industrial buildings or plants.
E. The sewer service rate for commercial houses and
small industries maintaining yard space and landscaping shall
be based on the average water usage for the month of December
and the following month of January, this basis to be estab-
lished annually.
F. For each church, a charge per month,- This section
includes, churches only, and not paronaes, 'which shall be
charged at the regular domestic rate.
13.48.030 Sewer service fund.
There is established a sewer service fund to provide for
administration, operation, and maintenance of the Redlands
domestic sewerage system and its capacity to serve its
existing users. All interest on the cash balance of the fund
shall accrue to the sewer service fund. The following rules
shall apply:

13.48.041 Amounts
The City Council may, from time to time, in its discre-
tion and by resolution, fix, alter, change, amend or revise
the amounts of charges and rates for facilities and services
of the sewerage system.
13.48 .060 Service outside City limits'.
Every person whose premisesoutsidethe City limits are
served by a connection with the sewerage system of this City,
whereby the sewage or industrial wastes of eitheror both are
disposed of by the City, either through the facilities; of the
sewage treatment and sewage disposal works owned by the City
or otherwise, shall pair a sewer service charge of double the
rates established for those persons within the City pursuant
to this chapter.

SECTIO SIX.
'the City Clerk shall certify to the adoptions of this
Ordinance and cause it, or a summary of it, to be
published once in the Redlands Daily Facts, a newspaper
of general circulation printed and published in this
City.
