HomeMy WebLinkAboutOrdinances_0005-Interim_CCv0001.pdf ORDINANCE NO. 5 (INTERIM) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS TEMPORARILY PROHIBITING THE ISSUANCE OF PERMITS FOR OUTSIDE WATER AND SEWER CONNECTIONS UNTIL FEBRUARY 20, 1979, AND DECLARING THIS TO BE AN EMERGENCY ORDINANCE THE CITY COUNCIL OF THE CITY OF REDLANDS does hereby find as follows: WHEREAS, the voters of the City of Redlands on November 7, 1978, exercised their initiative right to adopt Proposition "R" entitled "INITIATIVE ORDINANCE TO MODERATE THE RATE OF GROWTH WITHIN THE CITY OF REDLANDS TO PRESERVE THE CITY'S UNIQUE ENVIRON- MENT AND CHARACTER"; and WHEREAS, connections to the municipal water and sewer systems have a direct im- pact upon sound and proper planning and zoning for land uses within the City of Redlands, particularly in areas adjacent to the municipal boundaries; and WHEREAS, a temporary moratorium until February 20, 1979, to withhold all permits for connections, and connections to the water and sewer systems at points without the corporate boundaries is necessary to promote the orderly and sound planning of the use of land, and the operation of municipal water and sewer services within and with- out the City of Redlands; and WHEREAS, a principal basis for approving Proposition "R" is the finding by the voters with respect to water and sewage services as follows: ". . . . . that accelerating and disorderly residential, growth have caused conditions harmful to the public health, safety and general welfare have resulted or will soon result in overcrowding of schools, deteriorating water quality and sewage treatment capacity . . . . .'" WHEREAS, this City Council of the City of Redlands finds and determines that the protection of the public health, safety, and welfare of the people of Redlands re- quires the temporary cessation of additional connections to the municipal water and sewer systems to properties outside the City; and such connections in conflict with contemplated proposals or plans which this legislative body, the Planning Commission, or the Planning Department are considering or intending to study immediately; and WHEREAS, it is appropriate and proper to prevent any developments that may cause significant or irreversible environmental impacts upon zoning of land uses within the City of Redlands; and WHEREAS, a temporary moratorium on the issuance of permits for water and sewer connections to properties outside this city will allow this city to evaluate, apply, and implement the growth study prepared for the City by John Blayney & Associates and to weigh effects of such a study; and WHEREAS, a temporary moratorium on the issuance of permits or approvals of water and sewer connections outside the City boundaries is necessary to preserve the public safety, health and welfare. THE CITY COUNCIL OF THE CITY OF REDLANDS DOES HEREBY RESOLVE AS FOLLOWS: SECTION OVE: The Dcpartments of Public Works, Building and Safety, and Planning of the City of Redlands are ordered temporarily not to issue any permits or appro"als for connections to the City water and sewer systems from properties located without the corporate boundaries of the City until February 20, 1979. SECTION TS4O: In order to promote the orderly development of the City of Redlands ,end the public health, safety and welfare, the City Council hereby finds it necessary to review various laws, ordinances, rules and regulations pertaining to planning, building construction and density, and utility capacity, particularly water and sewage, and requires sufficient time to evaluate the effect of Proposition "R" upon the muni- cipal utilities. Thereforo, this City Council declares this matter to be a measure of extreme urgency and that the prohibition of such outslide water and sewer connection, until. February 20, 1979 is reasonable and necessary. By reason of such urgent condi- tions and circumstances, this ordinance shall be effective immediately upon its adoption and the same shall. be posted as prescribed by law. s/ Oddie J.
