These climatic conditions are conducive to the spread of fire. For example, the following data was taken from the recorded to nperaft€res and meastared rainfall at the .San Bernardino Cot€nty Flood Control District Office; located at 825 East 3s€ Street, San Bernardino, for 2006 2004: Maximum tennperat`ttre greater than l00'F` recorded dt€riitu the Months 01' April, May, July, ALIgLlst and September. Extensive damage often Occurs dUrill"Z- Such winds Including downed trees, power lines, Litilitity poles and utility service lines, These adverse conditions cause: a) f I res, b) impairment of ernergency apparatus access; C) delays in response times of emergency apparatus; and d) tile depletion of apparatus readily available Cor fire suppression activities. Specific amendments to the Wildland-Urban interface Code contained In this Ordinance pursuant to this express finding of local necessity are made to Sections: Specific amendments to the Wildland-Urban Interface Code contained in this Ordinance pursuant to tills express finding of local necessity are made to Sections: 101.1, 1053, 105.1 t, 105-12, 106.3, 107.121, 201.3, 202, 404 5, 404.10.3, 50 1,1, 504.3, 504.7, and 505,T 2. Within tile City there are four earthquake faults: a) Redlands Heights b) Banning C) Crafton d) The Redlands Faults Numerous other faults lie in close proximity, including the Sail Andreas Fault. In the event of a severe earthquake, these faults present tile potential for catastrophic damage, including extensive damage to buildings, fire damage to rnjjor infrastucture including water and sewer distribution lines, roadways, bridges across a major storm drain and railroad right-of-way, and other impairments to the movement of enlergency apparatus, Specific amendments to the Wildland-Urban Interface Code contained in this Ordinance pursuant to this express finding of local necessity are made to Sections: Specific amendments to the �Vildland-Urban Interface Code contained in this Ordinance pursuant to this express finding of local necessity are made to Sections.* 101.1, 105.3, 105,11, 105 12, 1063, 107,121, 201.3, 202, 404,5, 404,IM, 501,1, 504.3, 504.7 1 , and 505.7. 4, Within tile area of the City development has occurred and continues to occur which has resulted in severe traffic congestion during peak hOUrs, weekends and holidays, particularly on the following streets and highways: Citrus AVenLic. Cajon Street, Orange Street, Lugonia Avenue,, Colton Avenue, Tennessee Street, Sail Tirnoteo Canyon, 1-10 Freeway, and Alabama Street', thus decreasing response time. This development includes high-rise structures, institutional, commercial, industrial and residential structures. Development has Occurred within that portion of the City known as Sunset Hills, where roadways have been built in areas of severe topographical conditions including street and driveNvay grades in excess of 12%, Such traffic congestion and severe roadway conditions 2 extend the time (or culel-gency vehicles to reach the scene of' tires and othcr emergencies, Sl)cclf'tc amendments to the Wildiand-Urban Interface Code contained in this Ordinance pursuant to this express finding of local necessity are made to Sections: IOL 1, 1053, 105.11, 105.12, 106.3, 107.1.2.1, 201.3, 202, 404.5, 404.10.3, 501.1, 5043, 504.7, and 505.7, WHEREAS, this City Council is informed and finds that because tile City is Subject to the above rel"crenced climatic, geological and topog ,raphical conditions, that amendments to tile Wildland-Urban Interface Code, 2006 Edition, are necessary to protect life: and property, and that such anlendments address the following issues: 1) high fire hazard areas; 2) water supplies; 3) fire extinguishing systems and sprinkler systems, and 4) the storage, handling and use of' flammable and combustible liquids and hazardous materials; and WHEREAS, this City Council does hereby establish that the modifications to the 2006 Wildland-Urban Interface Code, as outlined In this=Ordinance No. 2689, are necessary due to local climatic, geographic and topographic conditions; The City Council of the City of Redlands does ordain as follows: SECTION 1. Chapter 15.30, entitled "Wildland-Urban Interface Code," is hereby added to the Redlands Municipal Code to read as follows ``Chapter 15.30 WfLDLAND-URBAN INTERFACE CODE Sections: 15.30-010 Findings and Adoption of the International Wildland-Urban Interface Code 15.30.020 Definitions 1530,030-220 Amendments to the International Wildland-Urban Interface Code 1534 . M Penalties 1530M0 Findings and Adoption of the International Wildland-1,.Jrhan Interface Code A. FINDINGS. 'File City Council of the City of Redlands hereby findsand determines: Ie That the friternatiomal Code Council ([CC) is a private organization %vllicll has been ill existence for a period of at least three years. I That the International Wildland-Urban Interface Code (IWUIC), 2006 EditiolL published by said organization, is a nationally recognized compilation of proposed rules, regulations, and standards of said organization. 3 3. That said International Wildland-Urban Interface Code has been printed and published as a code in book form within the meaning ol'Section 50022,2 et seq. of the Calilbrilia Government Code. 4: That one copy of the 2006 International Wildland-Urban Interface Code, certified by the City's Clerk of the City of Redlands to be a, true copy, has been filed t'01- use and examination by the PLiblic III the Fire Prevention office of the Fire Department of the City. 5. The sections of said International Wildland-Urban Interface Code may be referred to by the number used in said published con.-Ipilation, preceded by the words "International Wildland-Urban Interface Code Section" or "Wildland-U'rban Interface Code Section" or ­WUI Code Section," and may also be referred to by additional reference to the Redlands ',—\It Lill let pal Code and sections therein pertaining to said International Wildland-Urban Interface Code. B. ADOPTION OF THE THE INTERNATIONAL WILDLAND-URBAN INTERFACE CODE. The City Council of the City hereby adopts and amends the 2006 Edition of the International Wildland-Urban Interface Code, and International Wildland-Urban Interface Code Appendices A, B and D; as compiled and published by the International Code Council. 15.30.020 Definitlolls� (a) Wherever the word "Jurisdiction" is used in said Wildland-Urban Interface Code, it shall mean the City of Redlands. (b) Wherever the term "Code Official" is used in said Wildland-Urban Interface Code, it shall mean the Fire Marshal for the City. (c) Wherever the term "Corporation Counsel" is used in said Wildland-Urban Interface Code, it shall mean the City Attorney for the City. (d) Wherever the term "Fire Department" IS used in said Wildland-Urban Interface Code, it shall mean the Fire Department of the City. (e) Ali employee of the Fire Department of the City, when enflorcing the International Wildland-Urban, Interface Code, the Redlands Municipal Code and other laws, rUles and re-11=1ulations relating to fire and life satety, fire prevention and fire investigation, shall be deemed a - "Peace Officer" as those words are used in Section 830.31 ofthe California Penal Code. 15.30-030 Section 101.1 of the International Wildland-Urban Interl-ace Code is hereby amended to read as follows: 10LI Title. These regulations shall be knwN.--n as the Wildland-Urban Interface Code of the City of Redlands, hereinafter referred to as "this code." 1530.040 Section 103.3 of the International Wildland-Urban Interface Code is hereby amended to read as follows: 4 103.3 Alternative materials or methods. The code official, ill colic 11 ITcIlc C with approval from the building official and fire chief, is authorized to approve aitcriiativc materials or methods, provided that the code official linds that the proposed design, use or operation satisfactorily complies with the intent of this code and that the alternative is, for the purpose Intended, at least equivalent to the level of quality, strenoth, effectiveness, fire resistance, durability and safety prescribed by this code, Approvals under tile authority herein contained shall be SLII�j(!Ct to the approval of the>building official whenever the alternate niaterial or method involves matters regulated by the California Building Code. 1530.050 Section 105.3 of the International Wildland-U'rban Interrace Code is hereby amended to read as follows: 105-3 Work exempt fironi permit. Unless otlirwise provided in the requirements of the California Building Code, a permit shall not be required for the following: (Renlainder of Z section remains tile sanic.) 1-5.30.060 Section 105.11 of the International Wildland-Urban Interface Code is hereby added to read as follows: 105.11 Permit Fees. Permit fees as established by resolution of:the City Council shall be collected by tile Finance Department. Proof of receipt shall accompany all applications for permit applications prior to inspection and approval by the code official. 153UM Section 105,12 of the International Wildiand-Urban Interface Code is hereby added to read as follows: 105.12 Fees Not Refundable. Permit fees shall not be refundable for any reason after initiation of inspection procedures. 15.30.080 Section 1063 of the International Wildland-Urban Interface Code is hereby anienided to read as follows: 1063 Site plan. In addition to lie reqUirerrientsfor plans in the California Building Code. site plans shall include topography, width and percent of grade of access roads, landscape and vegetation details, locations of structures or building envelopes, existing or proposed overhead utilities, occupancy classification of buildings, types of ignition-resistant constrction of buildings, strucutes and then- appendages, roof classification of buildings, and site water supply systems. 1530.090 Section 107.1.2.1 of the International Wild land­Urban Interface Code is hereby added to read as follows: 107.1.2,1 Inspection fees; Tile code official is authorized to collect appropriate fees t'or inspections as established by resolution of tile City Council Of the City 15.30.100 Section 201.3 of the international Wildland-Urban Interface Code is hereby amended to read as follows: 5 2013 Terms defined in other codes. Where terms are not defined in this code and are defined in other California or international Codes, such terms shall have the n-icanill"s ascribed to them as in those codes. 15,30-110 Section 202, definition of' -BUILDING OFFICIAL,- of the international Wildland-Urban Interaice Code is hereby amended to read as follows: BUILDING OFFICIAL. The officer or other des' ignated authority charged with the administration and enforcement ofthe Call fornia Building Code, or the building official's duly authorized representative. 15.30.1 20 Section 202, definition of"'FUEL, HEAVY," ofthe International Wildland-Urban Interface Code is hereby amended to read as f'ollows, FUEL, HEAVY. Vegetation consisting of round wood 3 to 8 inches (76 to 203 jurn) in diameter. Heavy fuels represent dense conifer stands where there is a heavy accumulation of litter and downed woody material. See applicable National Fire Danger Rating, system (N FDR.), fa cl models G & U as described in Appendix D. 15.30.130 Section 202, definition of"FUEL, LIGHT," of the International Wildland-Urban Interface Code is hereby amended to read as follows; FUEL, LIGHT. Vegetation consisting ot'herbaceOLIS plants and round wood less than 114 inch (6.4 mill) in diameter. Light fuels represent western grasslands vegetated by annual or perennial grasses and forbs. Grasses and forbs are the primary ground fuel, but there can be enough needle litter and branch wood present from all open pine stand to contribute to the fuel loading. See applicable National Fire Danger Rating system (NFDR), fuel models A, C & L as described in Appendix D. 15.30.140 Section 202, definition of "FUEL, MEDIUM,- of the International Wildland- Urban Interface Code 'is hereby amended to read as follows: FUEL, MEDIUM. Vegetation consisting of round wood 1/4 to 3 inches (6.4 nista to 76 nim) in diameter. Medium fuels represent mature, dense fields of California mixed chaparral. See applicable National Fire Danger Rating system (NFDR), fuel models B & F as described in Appendix D, 1530,150 Section 202, definition of"FUEL MODIFICATION ZONE,- of the Interliational Wildland-Urban Interface Code is hereby added to read as follows: FUEL MODIFICATION ZONE. A strip of land where combustible vegetation has been thinned, modified, or both, and partially or totally replaced with approved drOLIght-tolerant, fare-resistant, and/or irrigated plants to provide all acceptable level of risk, from vegetation tires, Fuel Modification reduces radiant and convective heat, thereby reducing the amount of heat exposure oil the roadway or structure and providing Fire suppression forces a safer area in which to take action. 1530,160 Section 202, definition of "HEAVY TIMBER CONSTRUCTION," of the International Wildland-Urban Interface Code is hereby amended to read as follows: 6 IJEAVY TIMBER CONSTRUCTION. As described in tile Callf'Orilia Btlilding Code. 15341A70 Section 404.5, Subsection 2, Exception, of the International Wildland-Urban Interface Code is hereby aniendcd to read as fiolloits: Exception: A reduction in required flow late of up to 50 percent, as approved by tile code official, is allowed when the building is provided with an approved autornatic sprinkler systein. 'file reSUIOMY , water Supply shall not be less that 1,500 gallons per IllillUtC (94,0 us). 1530.180 Section 404.10.3 of the Interriational Wildland-Urban Interface Code is hercbv amended to read as follows; 404.10.3 Standby power. Stationary water supply facilities within the wildland-urban intert'ace area dependent on electrical power to meet adequate water supply demands shall provide standby power systems in accordanece with the California Electrical Code to ensUrc that an uninterrupted water supply is maintained. The standby power Source shall be capable of providing power for a minimum of two hours. (Remainder of section remains the same,) 15.3Q 190 Section 501.1 of the International Wild land-Urban Interface Code is hereby amended to read as follows: 5411.1 Scope, Buildings and strUCtures shall be constructed in, accordance with tile California Building Code and this code. (Remainder of section remains the same.) 15.30.200 Section 504.3 of the International Wildland-Urban friterface Code is hereby amended to read as follows: 504.3 Protection of eaves, Eaves and soffits shall be protected oil the exposed underside by materials approved for a rnimmUrn of I-hour fare;-resistance-rated construction, 2-inch (51 mrn) nominal dimension lumber, or 1-inch (25A irmi) nominal fire-rctar(Lint-ti-cated lumber or �/t-inch (19 trim) nominal fire-retardant-treated plywood, identified for exterior use and rneeting the requirements of Section 230-1.2 of the California Building Code, Facias are required and shall be protected on the backside by materials approved for as rilinimurn of I-hoar fire-resistance-rated construction or 2-inch (51 mm) nominal dimension klinber. 15.X210 Section 504.7 of the International Wildland-Urban Interface Code is hereby amended to read as follows. 504,7 Appendages and prqjections. Any person convicted ofan infraCtI011 Shall be ]MIlishable by(1) as title ofnot more than one hundred dollars ($100.00) for a first violation; (2) as fine riot exceeding two IlUndrcd dolkirs ($200.00) for as second violation of this Chapter within one year and () to fine not exceeding live hundred dollars ($500.00) for each additional violation of this Chapter within one year. Each Such person shall be deemed guilty of;.a separate offense for every day during Such portion of which ,illy violation of this Chapter is committed, continued or permitted by Such person, and shall be punishable therefore as provided by this Chapter." SECTION 2. ValLdj_!y. If any section, subsection, sentence, i laause< or phrase of this Ordinance is for any reason held to be invalid, such holding or holdings shall not affect tile validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each Section, Subsection, claUSC sentence alld Phrase thereof, irrespective of the fact that any oric or more sections, subsections, clauses, sentences or phrases be declared invalid. SECTION 3. "Publication and Postir gM . The ayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or as SUrnmary of it, to be published once in the Redlands Daily Facts, as newspaper of general circulation within the City.
