AN ORDINANCE AMENDING ARTICLE 849 OF THE REDLANDS
ORDINANCE CODE RELATING TO WRECKED VEHICLES
(RECODIFICATION PROJECT)
THE CITY COUNCIL OF THE CITY OF REDLANDS does
ordain:
SECTION 1 : Section 84903 . 4 of Article 849 of the
Redlands Ordinance Code is hereby amended to read as
follows:
"84903 . 4 Notice -- Form and Contents.
Any posted notice shall be headed:
' Notice of Public Nuisance ' in letters
not less than one ( 1 ) inch in height and
shall , in legible characters , and direct
the abatement of the nuisance referring
to this code for particulars. The
notice shall state that the property
owner may appear in person at the
hearing held pursuant to this article or
may submit a sworn written statement
denying responsibility for the presence
of the vehicle on the land along with
his reasons for his denial in lieu of
appearing at the hearing. Notices
served by means other than posting as
required by this article shall contain a
description of the condition in general
terms reasonably sufficient to identify
the nuisance and direct abatement. "
SECTION 2 : Section 84905. 5 is hereby added to
Article 849 of the Redlands Ordinance Code and shall read as
follows:
"84905. 5 Reconstruction of Vehicle .
Upon the removal of a vehicle in
accordance with the terms of this
article, the vehicle shall not be
reconstructed or made operable unless it
is a vehicle which qualifies for either
horseless carriage license plates or
historical vehicle license plates
pursuant to California Vehicle Code
Section 5004, in which case the vehicle
may be reconstructed or made operable . "
SECTION 3 : Section 84904 . 3 is hereby added to
Article 849 of the Redlands Ordinance Code and shall read as
follows :
"84904 . 3 Responsibility for Vehicle.
The owner of the land on which the
vehicle is located shall be given the
opportunity to appear in person at the
hearing or present a sworn written
statement denying responsibility for the
presence of the vehicle on the land,
along with his reasons for such
denial . If it is determined at the
hearing that the vehicle was placed on
the land without the consent of the
owner, and that the owner of the land
has not subsequently acquiesce in its
presence, the City shall not assess the
costs of administration or removal of
the vehicle against the property upon
which the vehicle was located or
otherwise attempt to collect such costs
from such owner . "
SECTION 4 : This Ordinance shall be in force and
take effect as provided by law.
SECTION 5: The City Clerk shall certify to the
adoption of this Ordinance and cause it or a summary of it
to be published once in the Redlands Daily Facts , a
newspaper of general circulation printed and published in
this City.
