HomeMy WebLinkAboutOrdinances_1635_CCv0001.pdf 3 ORDINANCE NO. 1635 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS REGULATING THE SALE OF PERSONAL PROPERTY TO THE GENERAL PUBLIC FROM RESIDENTIAL PREMISES AND AMENDING THE REDLANDS ORDINANCE CODE. THE CITY COUNCIL OF THE CITY OF REDLANDS DOES ORDAIN AS FOLLOWS : SECTION ONE: That the Redlands Ordinance Code be amended by the addition of a new Chapter 24 entitled, YARD SALE PERMIT, reading as follows ; 1(5 BUSINESS YARD SALE PERMIT CHAPTER 24 CHAPTER 24 YARD SALE PERMIT 24001. YARD SALE DEFINED. The term "Yard Sale" as used herein shall include any event where items of per- sonal property owned, utilized, or maintained by occupants of premises other than a licensed commercial business, are to be offered for sale to the general public. This shall include garage, patio, rummage, and other similarly conducted sales. 24002. PERMIT REQUIRED. It is unlawful for any person, firm, or corporation to conduct or carry on any sales activity commonly described as a yard, garage, patio, rummage or similar type sale within the City of Redlands without first having obtained from the City Treasurer a permit to do so. 24003 . PERMIT FEE. The fee for said permit shall be $5.00 . 24004. EXEMPTIONS . The provisions of this section shall not apply to sales of personal property made under court order or process. 24005. FREQUENCY AND HOURS . An individual or household shall be limited to one such sale per twelve month period and shall be limited to three consecutive days or two consecutive weekends of two days each. Such sales may be conducted only between the hours of 8:00 A.M. and 8 :00 P.M. § 24006. SALE OF GOODS. Before a permit may be issued, an affidavit must be filed with the City Treasurer stating that all property to be sold is the applicant ' s own personal property and has not been acquired or consigned to him for the purpose of resale or benefit of other than the occupants of the premises . 24007. DISPLAY OF GOODS . Sale goods may not be displayed in the public right-of-way, on porches, or within the front or side yards and all such goods shall be arranged so that fire safety service and other officials may have access for inspection at all times during the sale. 24008. SIGNS. No other sign shall be permitted, excepting one double-faced sign, not to exceed four square feet in area on any one side, which shall be permitted only on the property where such sale is located. Such sign may be posted only on the days of sale on such property and shall be prohibited on all other days. Ordinance No. 1635 1/3/78 BUSINESS YARD SALE PERMIT Sec. 24009 24009 . ENFORCEMENT. The Director of Building and Safety is authorized and directed to enforce the pro- visions of this chapter. He may delegate his powers and duties to his assistants and safety personnel. 24010 . PENALTY. Any person violating any of the provisions of this chapter shall be guilty of a misde- meanor and upon conviction thereof shall be punished by a fine of not less than twenty-five ($25. 00) dollars, and not more than five hundred ($500 . 00) dollars or by imprison- ment for a period of not more than six (6) months or by both such fine and imprisonment. Ordinance No. 1635 1/3/78 SECTION TWO: This ordinance shall be in force and take effect as provided by law. SECTION THREE: The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts, a newspaper of general circulation printed and published in the City of Redlands .
