HomeMy WebLinkAboutOrdinances_2077_CCv0001.pdf ORDINANCE NO. 2077 AN ORDINANCE AMENDING THE REDLANDS MUNICIPAL CODE BY ADOPTING ZONING ORDINANCE AMENDMENT NO. 197 RELATING TO HOME OCCUPATION PERMITS R.P.C. NO. 741 SECTION ONE: That Section 18. 160 .010 of the Redlands Municipal Code be amended as follows: "18 . 160 .010 . Purpose of provisions. The purpose of the home occupation provisions is to permit the conduct of a business in the residential districts. Home occupations are limited to those uses which may be conducted within a residential dwelling, without in any way changing the appearance or condition of the residence. " SECTION TWO: That the first sentence in Section 18.160 .020 of the Redlands Municipal Code be amended as follows: "18 . 160 .020 . Validity - Criteria for Commission Decision. The following criteria shall be used to determine a valid home occupation: " SECTION THREE: That Paragraph F of Section 18.160 .020 of the Redlands Municipal Code be deleted. SECTION FOUR: That Paragraph I of Section 18 .160 .020 of the Redlands Municipal Code be amended to read as follows: " I . No building or space outside of the main building shall be used for home occupational purposes. No outdoor storage shall be permitted. " SECTION FIVE: That Section 18.160 .050 of the Redlands Municipal Code be amended to read as follows: "18 . 160 .050 . Public Notice and Procedures. A. All property owners within 100 feet of the external boundaries of the property described in the application shall be notified of the requested home occupation. If within ten days no public hearing is requested by the applicant or another interested party, then the Community Development Director shall approve, conditionally approve, or deny the request in writing. B . The decision of the Community Development Director shall be final unless an appeal is taken to the Planning Commission as provided for in Section 18 .160 . 100 . Such decision shall not become effective for ten days from the date that the written decision has been made and notice thereof mailed to the applicant. A copy of the decision shall be forwarded to the Planning Commission and the City Council ." { SECTION SIX: That Section 18 .160 .060 of the Redlands Municipal Code be amended to read as foll.--.ws: "18 .160 .060. Public Hearing . A. If a public hearing is requested, then notices shall be mailed not less than ten days prior to the first available Planning Commission meeting date. Notices shall be mailed to owners of property within a 100 foot radius of the external boundaries of the property described in the application. B . The decision of the Planning Commission shall be final unless an appeal is taken to the City Council as provided for in Section 18 .160 .100 . Such decision shall not become effective for ten days from the date that the written decision has been made and notice thereof mailed to the applicant. A copy of the decision shall be forwarded to the City Council ." SECTION SEVEN: That Section 18 .160 .070 of the Redlands Municipal Code be deleted. SECTION EIGHT: That Paragraph C of Section 18. 160.080 of the Redlands Municipal Code be amended to read as follows: "C. Notice of the requested time extension shall be mailed to neighboring property owners in accordance with the procedure described in subsection B of Section 18.160 .050 . " SECTION NINE: That Section 18 . 160 . 100 of the Redlands Municipal Code be amended to read as follows: "18.160.100 . Appeals procedures. A. Appeal of Community Development Director decision. 1 . Any person aggrieved by the determination of the Community Development Director shall have the right to appeal to the Planning Commission. 2. Appeals shall be filed, on forms supplied by the Planning Department , with the Planning Commission within ten days from the date of the Community Development Director ' s decision. 3 . On the appeal , the Planning Commission shall review the decision of the Community Development Director, hear new evidence and testimony, if offered, and, in deciding the appeal , may either affirm, reverse or modify the decision of the Community Development Director . "B. Appeal of Planning Commission decision. Appeal of the Planning Commission decision shall be made in compliance with Section 18. 12.110 , Appeal Procedures, of the Redlands Municipal Code. " SECTION TEN: This ordinance shall be in force and take effect as provided by law. SECTION ELEVEN: The City Clerk shall certify to the adoption of this ordinance and cause it to be published once in the Redlands Daily Facts , a newspaper of general circulation printed and published in this City.
