public comment on any item on the agenda for the closed session

City Attorney McHugh reviewed the need to take immediate action for consideration of real
property negotiations for a possible lease of Airport property Mayor Pro Tem Tejeda moved to
add to the City Council's closed session agenda as a "late breaking item", the matter of real
property negotiations with Gil Brown, Coyote Aviation, for terms of payment and price for
possible lease of Airport property by City The motion was seconded by Council Member Foster
and earned unanimously The item was added to the Closed Session Agenda

RECONVENE CITY COUNCIL MEETING
The meeting reconvened at 6 00 P M with an invocation by Mayor Pro Tem Tejeda followed by
the pledge of allegiance to the Amencan flag
CLOSED SESSION REPORT
City Attorney McHugh announced that no reportable action was taken during the closed session
PUBLIC COMMENT
Embracing Redlands History - Andy Hoder spoke of the importance of understanding the City's
history in order to preserve and protect the community's future He highly recommended the
instructive Redlands Local History Class, taught by Larry Burgess, Tom Atchley, and the team's
newest member, Nathan Gonzales The class is offered through A K Smiley Library
Various Items- Dennis Bell stated people flock to the downtown area for the bars, not public art,
and he thought a new online survey related to mural art seemed irrelevant to him He complained
of poor audio quality during the Municipal Utilities Public Works Commission meeting held on
October 4, 2021
PRESENTATIONS
Proclamation California Clean Air Day
Council Member Davis presented a Proclamation declaring October 6, 2021 as California Clean
Air Day in the City of Redlands to Mark Cloud, Government Relations Manager at Southern
California Edison Ms Davis and Mr Cloud encouraged everyone to take the pledge and
personally participate in actions that can directly improve the region's air quality

City Council unanimously approved the minutes of the regular meeting of September 21, 2021

Proclamation National Arts and Humanities Month
On motion of Council Member Paul Foster, seconded by Mayor Pro Tempore Eddie Tejeda, the City
Council unanimously approved issuance of a Proclamation declaring October 2021, as National Arts
and Humanities Month in the City of Redlands

Policy Renewal Dental Insurance
On motion of Council Member Paul Foster, seconded by Mayor Pro Tempore Eddie Tejeda, the City
Council unanimously approved a two-year policy renewal with California Dental Network providing
dental insurance coverage for City employees

Consulting Agreement Amendment
On motion of Council Member Paul Foster, seconded by Mayor Pro Tempore Eddie Tejeda, the City
Council unanimously determined that approval of the First Amendment of the Agreement with
Huitt-Zollars, Inc for Live Oak Creek and Oakmont Park Restoration Project Engineering services is
exempt from environmental review pursuant to Section 15061(b)(3) of the state's guidelines
implementing the California Environmental Quality Act, and approved the First Amendment of the
Professional Services Agreement with Huitt-Zollars, Inc for Live Oak Creek and Oakmont Part
Restoration Project Engineering services

Final Map Luxview Venue at Orange
Due to ownership of property within 500 feet of the proposed development, Council Member Davis
recused herself from this item
On motion of Mayor Pro Tempore Eddie Tejeda, seconded by Council Member Paul Foster, the City
Council unanimously approved Tract No 20244 Final Map prepared and submitted by Luxview Venue
at Orange, LLC

Other Council Member Denise Davis (RECUSE)
Emergency Repair Orange Street Sinkhole
On motion of Council Member Paul Foster, seconded by Mayor Pro Tempore Eddie Tejeda, the City
Council unanimously approved to receive and file the Municipal Utilities and Engineering Department
Emergency Procurement related to the repair of a large sinkhole on Orange Street, waived minor
irregularities m the emergency procurement process, and authonzed the City Manager to execute any
residual costs associated with this emergency

Dispatch/Records Management System Payment
On motion of Council Member Paul Foster, seconded by Mayor Pro Tempore Eddie Tejeda, the City
Council unanimously authorized authorize the Finance Director to pay the annual maintenance invoice
for the Police Department's Computer Aided Dispatch/Records Management System to Spillman
Technologies, Inc in the amount of $90,517 44

COMMUNICATIONS
League of California Cities Annual Conference Report
Council Member Davis attended the League of California Cities Annual Conference and Expo held
September 22-24, 2021 in Sacramento Session topics included, social media and the law, community
outreach and new ways to support informed decision -making, workforce housing solutions and best
practices for establishing a city council code of conduct She found the in -person event to be extremely
informative and engaging and as the voting delegate for the General Assembly, she recapped the
voting activities, adding that one resolution proved to be controversial
Council Member Vacancy
Assistant City Manager McConnell summarized the options available to the Council to fill a vacant
Council seat in District 5 as of January 3, 2022, due to the resignation announcement of Paul Foster
The City Council will have 60 days from the occurrence of the vacancy to either fill the vacancy by
appointment or call a special election to fill the vacancy An appointment must be made by March 4,
2022 and the appointee must be a Redlands resident, a registered voter and live in District 5 In
accordance with Government Code Subsection 36512(b)(2), any person appointed would hold office
until the next general municipal election, scheduled on November 8, 2022 A special election may be
held on a date not less than 114 days from the date of calling the election and the successful candidate
would serve out the remainder of the term expiring in December 2022 With this option, a special
election would be consolidated with the Statewide Primary Election scheduled for June 7, 2022, with
an estimated cost of $5,000
City Attorney McHugh announced Council Member Foster was not allowed to vote on his
replacement if Council chose to appoint, but he was able to fully participate in discussions Council
Member Foster recommended the Council consider appointing a former Council Member, who lived
in District 5, to serve the remainder of his term, since they would already be familiar with the duties
He added that due to recent complications with his wife's health, his resignation date of January 3,
2022, could possibly be shifted Council Member discussion centered on a timeline, the current
redistricting process underway and the merits of an appointment process and conducting interviews
Mayor Banch stressed the importance of being transparent and including the public throughout the
whole process A decision was not required immediately and Council Members agreed to consider this
matter to November 2, 2021, allowing for additional time to consider the options

Urgency Ordinance No. 2928 Temporary Moratonum
Mayor Banch opened the public hearing, continued from September 21, 2021, and called on
Development Services Director Desatnik who reviewed urgency Ordinance No 2928 and explained
staffs recommendation of a temporary 45-day moratorium on certain new development projects for
those limited number of properties that are 1) located within the EV/IC district, and 2) identified on
the list and map of potential housing sites associated with the Housing Element Update The City is
currently updating the Housing Element which is a required piece of the General Plan that provides
policies, programs, and actions to achieve the City's housing goals The sites that are subject to the
proposed Moratonum will assist the City m providing sufficient land to meet the City's required
number and density of housing units as required by the State and the temporary moratorium will allow
staff time to thoroughly study these sites and related land use issues The identified sites will be
required to be rezoned to authorize residential development as the primary use The State provides
severe penalties to local jurisdictions that fail to provide the appropriate zoning for the RHNA sites that
would be used for housing development
As public comment, Alan Gotta, longtime property owner on Iowa Street, reiterated his opposition to
the rezoning of certain parcels because he and his wife, personally stood to lose millions m the value
of their property as they now prepare to retire and sell their property He urged Council to designate
other parcels that could be used to meet the State's requirements Council Member Foster was hesitant
to rezone pnvate property without more information, and he requested staff reexamine parcel locations
for their potential economic value to the City and not just from the perspective of a land use decision
Council Members agreed to continue this matter to the November 16, 2021 meeting
Development Protect MLC Holdings, Inc
Mayor Banch opened the public hearing, continued from September 21, 21, and called on Project
Planner Sean Reilly, of Development Services, for an overview of the development applications
related to 58 6 gross acres of land located on the north side of Domestic Avenue, approximately 625
feet west of Texas Street, and on the east side of Interstate 210 The project proposes to construct a
total of 317 single family one-story and two-story homes, new interior streets to serve the project,
private recreational open space areas and on -site amenities, landscape and lighting, a new 11 84-acre
public park for active recreation, and related improvements including drainage basins and
public/private utility connections The park will be available for use as a public park Aaron Talonco,
of MLC Holdings, Inc, the Applicant, briefly spoke to the project and thanked staff for their assistance
throughout the whole process The developer was in agreement with all the Conditions of Approval,
including the two new additions of a secondary north/south access point
Two wntten comments were received stating that m their opinion, the Mitigated Negative Declaration
was not appropnate for this project because of the loss of prime agricultural land and the findings did
not meet the requirements of Measure U Mayor Pro Tem Tejeda thanked the developer and staff for
listening to concerns expressed by some north side residents asking for a second access point to the
project With no further discussion, Mayor Banch closed the public hearing
On motion of Mayor Pro Tempore Eddie Tejeda, seconded by Council Member Jenna Guzman -Lowery,
the City Council unanimously adopted Resolution Nos 8250, 8251, 8252, 8253, 8254, 8255, and 8262
to approve the Bergamot Specific Plan project, and approved modifications of the Municipal Utilities
and Engineering Department's Conditions of Approval, added during the City Council meeting, for the
purpose of providing for a north -side road between Pioneer and Domestic west of Citrus Valley High
School and east of the I-210 to provide an alternate north -south access to the project

NEW BUSINESS
Downtown Redlands Event Flag Program
Facilities and Community Services Assistant Director Sullivan explained the University of Redlands
approached Council Member Foster and expressed interest in displaying event flags on City
streetlights within the downtown Staff communicated with various event organizers to develop a
program to recognize events unique to Redlands and with Council approval, staff will implement the
new flag program utilizing existing flag locations on E State Street, Citrus Avenue, and Orange Street
Council Member Foster commended staff for their efforts to take a good idea and make it into a great
program Mayor Pro Tem Tejeda requested the flag locations be extended to also include Orange Street
and Colton Avenue corridors
On motion of Mayor Pro Tempore Eddie Tejeda, seconded by Council Member Jenna Guzman -Lowery,
the City Council unanimously approved a Downtown Redlands Event Flag Program, agreed to extend
the program location to include Orange Street and Colton Avenue corridors to celebrate events unique to
the City of Redlands, and determined that the event is categoncally exempt from environmental review
pursuant to Section 15061 (b)(3) of the State's guidelines implementing the California Environmental
Quality Act

Redlands Veterans Day Parade In -Kind Support
Facilities and Community Services Assistant Director Sullivan introduced a request from the Redlands
Hometown Heroes Foundation to serve alcoholic beverages and a request for in -kind support related
to the Redlands Veterans Day Parade event hosted by the Redlands Hometown Heroes Foundation to
be held on November 11, 2021, at Jennie Davis Park
On motion of Council Member Paul Foster, seconded by Mayor Paul Banch, the City Council
unanimously determined that approval of the American Legion Post #106 sale and consumption of
alcoholic beverages within a City park, is categorically exempt from environmental review pursuant to
Section 15061 (b)(3) of the State's guidelines implementing the California Environmental Quality Act,
approved a request for in -kind support in the amount of $8,244 related to the Redlands Veterans Day
Parade event hosted by the Redlands Hometown Heroes Foundation, and authonzed the sale and
consumption of alcoholic beverages for the Redlands Hometown Heroes Foundation to be held
on November 11, 2021, at Jennie Davis Park

Resolution No 8264 Land Sale Proceeds
Management Services/Finance Director Garcia provided details of Resolution No 8264 to direct the
deposit of land sale proceeds from the sale of parcels adjacent to the Landfill and Wastewater
Treatment Plant and additional appropriations for transfers out of the Sewer and Solid Waste funds,
each in the amount of $21,701,115 to the General Fund, as well as for revenue recognition in both
Sewer and Solid Waste funds each in the amount of $23,025,000 and in the General Fund of
$43,402,230

On motion of Mayor Pro Tempore Eddie Tejeda, seconded by Council Member Denise Davis, the City
Council unanimously approved Resolution No 8264 to direct the deposit of land sale proceeds from the
sale of parcels adjacent to the Landfill and Wastewater Treatment Plant and additional appropriations
for transfers out of the Sewer and Solid Waste funds each in the amount of $21,701,115 to the General
Fund, as well as for revenue recognition in both Sewer and Solid Waste funds each in the amount of
$23,025,000 and in the General Fund of $43,402,230

COUNCIL MEMBER ANNOUNCEMENTS AND ACTIVITIES
Mayor Banch attended the Oktoberfest event, hosted by the Optimist Club, Coptober Community Fair,
sponsored by the Community Policing Unit and the Redlands Police Community Foundation, and he
enjoyed Dinner at the Grove, in support of the Family Service Association of Redlands
Mayor Pro Tem Tejeda was privileged to attend a special event in recognition of Hispanic Heritage
month He thanked Mario Saucedo and Common Vision Coalition, for hosting the North Redlands
History Day - Celebrating Mexican Independence Day The Police Department and A K Smiley
Library supported the event with Mayor Banch and Council Member Guzman -Lowery also present

the City of Redlands City Council will be held on October 19, 2021
