AN ORDINANCE REGULATING HEIGHTS OF STRUCTURES AND
NATURAL GROWTH, AND THE USE OF AIR SPACE IN' THE
VICINITY OF THE REDLANDS MUNICIPAL AIRPORT BY
CREATING AIRPORT APPROACH ZONES, TRANSITION ZONES,
HORIZONTAL ZONE AND CONICAL ZONE, AND ESTABLISHING
THE BOUNDARIES THEREOF-. PROVIDING FOR CHANGES IN
THE RESTRICTIONS AND BOUNDARIES OF SUCH ZONES,,
DEFINING CERTAIN TERMS USED HEREIN- PROVIDING FOR
ENFORCEMENT AND PRESCRIBING PENALTIES FOR THE
VIOLATION THEREOF.
THE CITY COUNCIL OF THE CITY OF RE LANE does
ordain as follows :
SECTION ONE-, That Pursuant to the authority
conferred by Article XI, Section 11, of the
California Constitution, the City Council. of the
City of Redlands , State of California, deems it
necessary to create an "Airport Space Zoning
Ordinance" for the purpose of promoting the
health, safety and general welfare of the inhabi-
tants of the City of Redlands , preventing the
creation of establishment of airport hazards ,
thereby protecting the lives and property of the
users of the Redlands Municipal Airport and of
the occupants of the land in its vicinity and
preventing destruction and impairment of the
utility of the airport and the expenditure of
public funds in establishing its

TITLE & DEFINITIONS
See. 9300HORT TITLE� This ordinance shall be known
as the "Redlands Municipal Airport Air Space Zoning Ordinance
of the City of Redlands "
See. 9301. DEFINITIONS. As used in this ordinance,
unless the context otherwise requires .
(1 ) "Airport" means the Redlands Municipal AirportA
(2 ) "Airport Hazard" means any structure or tree or use
of land which obstructs the airspace required for
the flight of aircraft in landing or taking off at
the airport or is otherw1se hazardous to such
landing or taking off' of aircraft.
(3) "Non-Conforming Use" means any structure, tree, or
use of land which does not conform to a regulation
prescribed in this ordinance or an amendment there-
to as of the effective date of such regulations.
(4) "Person" means any individual , firm, co-partnership,
corporation,, company, association,
joint stock
association, city, county or district, and includes
any trustee,, receiver, assignee or successor in
interest .
(5 ) "Structure" means any object confit ructed or in-
stalled by man, including, but, without limitation,
buildings, towers , smoke-stacks, and overhead lines.
(6) "Landing Area" means the area of the Airport used
for the landing, take-off, or taxiing of aircraft ,
(7) "Treet, means any object of natural growth,
(8) "City or County" mean s any city, county or city
and county,
(9) "Planning Commission " means the City Planning
Commission of the City of Redlands , State of
California,,

See , 9310, ZONES, In order to carry out the purposes
of this ordinance , all of the land within the boundaries of
the Redlands Municipal Airport and within two (J 2) miles of
the landing area of the Airport is hereby diori ded into hori-
zontal zone, conical zone , transition zones and runway
approach zones, boundaries of which are shown on the Redlands
Municipal Airport Air Space Zoning Map,
The Redlands Municipal Airport Air Space Zoning Map is
hereby approved as the official. map for such zoning purposes ,
and shall be incorporated as part of this ordinance, subject
to amendments made pursuant to law from time to time . Such
amendments shall be entered on the official map, which shall.
be maintained up to date and be on file and available for
examination during bus!,T)ess hours In the office of the City
Clerk.
See. 9311 . HE,"IGHT LIMITS. Except as otherwise provided
in this ordinance, no structure shall be erpeted, altered or
maintained in any airport approach zone', transition one.

Such height limItations are computed from the adjusted
airport elevation as determined at the di-5placed threshold
and are hereby established for each of the zones in question
as followsg
(1) APPROACH ZONES, One (1 ) foot in height for each
twenty (20) feet in horizontal- distance beginning
at a po,-int 200 feet from and at the elevatlon of
the end of the runway, and extending to a point
10, 200 feet from the end of the runway, The west
end of the runway shall be considered the most
westerly point of the future extension, and the
east end of the runway sha.1.1 be considered the
east displaced threshold,a
(2) TRANSITION ZONES. One (1 ) foot in height fox, each
seven (7 ) feet in borizontal distance beginning at
any point 1feet normal to and at the elevation
of the centerline of the runway, extending 200
feet beyond each end thereof', extending to a height
of 150 feet above the adjusted airport elevation
which is :l X524 feet above mean sea level. In
addition, to the foregoing, there are establisned
height limits of (1 foot -%re:rtical height for
eacb (7 ) feet horizontal distance measured, from
the edgers ,,)f al-1 approach zones for the entire
length. of the approach zones and extending upward
and outward to the points where they intersect
the horizontal. or conical surfaces ;
(3) HORIZONTAL E. One hundred fifty ( 150) feet above
the adjusted airport elevation or a height of 1.696
feet above mean sea, lovel ; and

(4 ) CONICAL ZONE, One ( 1 ) foot in height for each
twenty (20) feet of horizontal distance beginning
at the periphery of the horizontal one , extending
to a height of 300 feet above the adjusted airport
elevation , or a height of 1846 feet above mean sea
level ,
Where an area is covered by more than one height limita-
tion, the more restrictive limitation shall prevail,,

Use Restrictions
See . 9320. USE RESTRICTIOW No use may be made of
land within any airport approach zone, transition zone, horizon-
tal zone or coi
ncal zone , in such a manner as to create
electrical interference with radio communication between the
airport and aircraft , making it difficult for pilots to dis-
tinguish between airport lights and other lights, resulting in.
glare in the eyes of the pilots using the airport , impairing
visibility in the vicinity of theairport, or otherwise en-
dangering the landing, take-off or maneuvering of aircraft ,

Non-conforming Uses
Sec . 9330, NON-CONFORMING USESv The regulations
prescribed inSections 931 and 912 of this ordinance shall not
be construed to require the removal , lowering, or other change
or alteration of any structure or tree not conforming to the
regulations as of the effective date hereof, or otherwise inter-
fere with the continuance of any nonconforming use, Nothing
herein contained shall require any change in the construction,,
alteration or intended use of any structure, the construction
or alteration of which was begun prior to the effective date of
this ordinance , and diligently prosecuted and completed within
a reasonable time thereoK,

See , 9340. ADMINISTRATIVE AGENCY. The City
Planning Commission of the City of Redlands is hereby designa-
ted the administrator charged with the duty of administering
and enforcing the regulations herein deseribs& The duties of
the Planning Commission shall include that of reviewing and
deciding all applications for permits and variances under
Sections 915 and 96 of this ordinance .

Permits
Sec, 93, 0. PERMITS. Before any non-conforming
structure or tree may be replaced, substantially altered or
repaired, rebuilt , allowed to grow higher, or replanted, a
permit must be secured from the Planning Commission. No
permit shaLl be granted that -would to thet ablishment or
creation of an airport hazard or permit a non-conforming struc-
ture or tree or non-conforming use to be made or become higher
or become a greater hazard to air navigation than it was on the
effective date of this ordinancel or when the application for a
permit is made4 No permit shall be required for such maintenance
repairs or replacement of parts of existing structures as do not
enlarge or increase the hoight of the existing structure ,

Variances
Secy 936W VARTANCM A person desiring to erect
any structure , or increase the height of any structure, or
permit the growth of any tree, or otherwise use his property in
violation of airport zoning regulations adopted under this
article, may apply to the Planning Commission for a variance
from the zoning regulations in question, Such variances may be
granted only where application or enforcement of the provisions
of this ordinance will cause difficulty or unnecessary hardship
and the variance will promote the public interest, do substan-
tial justice , and conform to the spirit of the regulations and
this article ; provided, that any variance may be allowed subject
to such reasonable conditions as the PlanAing Commission may
require to effectuate the purpose of the article.

Violations
sec. 937WVIOLATION& In the event any person, or
his agent , employee , or persons under his control, moves , alters
or attempts to erect , constructny
, move or alter astructure or

ls any strctre or tree to exceed a height in violation of
the provislons of this ordinance, the same is hereby declared a
public nuisance, and it shall be the duty of the it Attorney
of the City of Redlands to bring, and prosecute an action in any
Court of competent jurisdiction to abate such nuisance, to
enjoin such person from maintaining same, and to require him,
to remove and eliminate the nuisance condition,

Sec . 938M PENALM A person violating any pro-
visions of this ordinance shall be guilty of misdemeanor, and
upon conviction thereof shall be punishable by a in of not

more than Five Hundred ($500) Dollars or by imprisonment for
a term not exceeding six months, or by both such fine and
imprisonmest. Such person shall be de guilty of a separate
offense for each and every day during any portion of whtch any
violation of this ordinance is committed, continued or per-
mitted.

Conflicting Regulations
SacA 93ONFLICTING REGULATIONS. Where this
ordinance tmposes a greater or more stringent restriction upon
the use of land than is imposed or required by any other ordi-
nance or regulation, the provisions of this ordinance shall
govern. Notg In this ordinance shall be construed as pro-
hibiting the growth, construction or maintenance of any tree
or structure to a height uP to 35 feet above the surface of
the land.

Validity
Sec40M VALIDTTY. Should any section or part of
a section, clause or provision of this ordinance be declared by
any Court to be invalid, the same ahall not affect the validity
of the ordinance as a whole or any part thereof, other than the
part so declared to be invalid,
