A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
DECLARING ITS INTENTION TO VACATE RIGHT-OF-WAY ON A
PORTION OF NEW YORK STREET
WHEREAS, NYS LLC, as an agent for the property owner for 370 — 404 New York Street,
has submitted an application requesting vacation of a portion of right-of-way, approximately 415
linear feet in length, adjacent to the frontage of the parcels identified as 370 — 404 New York Street
(APN 0171-161-18-0000, 0171-171-34-0000, 0171-171-30-0000, 0171-171-29-0000, and 0171-
021-06) in the Administrative Professional (A-P) District; and
WHEREAS, the City is authorized to vacate all or part of a public street pursuant to
California Streets and Highway Code section 8300 et seq , and
WHEREAS, pursuant to Section 8340 of the California Streets and Highways Code, the
City may for public convenience and necessity reserve and except public service easements from
a street vacation, and
WHEREAS, at its meeting on August 14, 2021, the City's Planning Commission made its
report to the City Council that the proposed street vacation will conform to the City's General
Plan, and
WHEREAS, the proposed street vacation qualifies for an exemption from environmental
review in accordance with the California Environmental Quality Act ("CEQA"), pursuant to
section 15061(b)(3) of the State CEQA Guidelines for projects where there is no possibility of any
significant environmental effects, and
WHEREAS, the City Council intends to vacate the excess right-of-way as more
particularly described in Exhibits "A" and "B" to this resolution,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
REDLANDS AS FOLLOWS
Section 1. The City Council hereby declares its intention to vacate that portion of New
York Street described in Exhibits "A" and `B," which are attached hereto and incorporated herein
by reference.
Section 2 The City Council hereby determines the proposed street vacation is exempt
from environmental review pursuant to section 15061(b)(3) of the State CEQA Guidelines because
it can see with certainty, based upon the testimony provided in the staff report, that approval of the
Street Vacation will have no physical effect on the environment.
Section 3. The City Council will conduct a public hearing on the subject of the
proposed vacation at a regularly scheduled public meeting of the City Council on December 7,
2021, beginning at 6 00 p.m. or as soon thereafter as the matter may be heard, to be held in the
City Council Chamber located at 35 Cajon Street, Suite 2, Redlands, California 92373
Section 4. The City Clerk shall give notice of the public hearing on the public hearing

on the proposed vacation by
A Publishing notice in the Redlands Daily Facts, for two successive weeks prior to the
hearing, and
B Posting notices of the proposed vacation conspicuously along the lines of the portion
of right-of-way to be vacated at least two weeks pnor to the date set for the pubhc
hearing The notices shall be posted no more than 300 feet apart, and at least three such
notices shall be posted The notices shall reference the adoption of this Resolution of
Intention and shall state the date, time, and place of the vacation hearing
