HomeMy WebLinkAbout2213_CCv0001.pdf RESOLUTION NO. 2213 RESOLUTION OF INTENTION TO CLOSE A PORTION OF AN ALLEY IN TRACT 20832 ROGERS TERRACE, STREET CLOSURE NO. 34. THE CITY COUNCIL OF THE CITY OF REDLANDS DOES RESOLVE AS FOLLOWS: SECTION ONE: The City Council of the City of Redlands hereby elects to pro— ceed under the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California and to vacate a part of a street in the manner provided therein. SECTION TWO: This City Council does hereby declare its intention to order the vacation of a portion of an alley in Tract No. 2083 ® Rogers Terrace m des— cribed as follows: All that portion of the alley in Tract No. 2083, Rogers Terrace , in The City of Redlands, County of San Bernardino, State of California, as recorded in Book 30 of Maps, Page 26 thereof, records of said County, described as: Commencing at the northeast corner of Lot 50 of said Tract No. 2083 said corner being on the westerly line of 50—foot wide North Eureka Street, formerly First Street; thence along the north line of said Lot 50 west 120 feet to the beginning of a tangent curve whose radius is 10 feet con— cave to the southeast, said point being the True Point of Beginning; thence westerly along said tangent curve 15.71 feet through an included angle of 890 56' to a point on the westerly line of Lot 50; thence along the westerly line of Lot 50 and Lot 49 of said Tract, south 00 041 west 67.48 feet to a point in the northerly line of InLer— state Highway No. 10; thence westerly along said northerly line 10.00 feet to a point in the westerly line of Tract 2083; thence along the westerly line of said Tract, north 00 041 east 77.47 feet; thence east 19.99 feet to the True Point of Beginning. SECTION THREE: In the proceeding herein adopted by this Council for the vacation--of the portion of street described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time , or from time to time , to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in,'- upon, over and across any street or part thereof proposed to be vacated and pursuant to anY existing franchises or renewals thereof, or otherwise, to construct, maintain, operate , replace, remove, renew and enlarge lines of pipe, conduits, cables, wires , poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines , telegraphic and telephone lines , railroad lines, and for the , transportation- or distribution of electric energy, petroleum, and its products, ammonia, water, and incidental purposes, including access and the right to keep the property free from inflammable materials , and wood growth, and other— wise protect the same from hazards in, upon and over the street or part of the street proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of the portion of the street described herein is required by public interest, conven— ience, safety and welfare. —1— SECTION FIVE: A map setting out the particulars of the proposed street vacation shall be on file in the Office of the Department of Public Works and available for inspection by persons interested in or objecting to the proposed vacation. SECTION SIX: The City Council hereby fixes the time and date and place of Public Hearing on the above described street closing at 7:00 P.M. on the 5th day of June, 19622 in the regular meeting place of the City Council in the City Hall , Redlands, California. SECTION SEVEN: Within fifteen days after its passage , this resolution shall be published in the Redlands Daily Facts, a newspaper of general circulation published and circulated in the City of Redlands, California.
