HomeMy WebLinkAbout7931RESOLUTION NO 7931 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING DELETION OF A CONDITION OF APPROVAL REQUIRING THE CONSTRUCTION OF PUBLIC IMPROVEMENTS ALONG CENTER STREET FOR FINAL TRACT MAP NO 8124 AND APPROVING THE RECORDATION OF A RELEASE OF LEIN WHEREAS, on May 1, 1973, the Planning Commission of the City of Redlands unposed a condition of approval for Tentative Tract Map No 8124 requiring the construction of street improvements along the Center Street frontage of the parcel to be subdivided, and WHEREAS, on February 4, 1981, the City of Redlands entered into an agreement with the property owner of Tract Map No 8124 to defer the construction of public street improvements, and WHEREAS, future development of the properties along Center Street within Tract No 8124 will allow for the imposition, per the Redlands Municipal Code Section 12 22 040(B), of a requirement for the construction of street unproveinents on those property owners engaging m such development, and WHEREAS, the City Council hereby determines that approval of this Resolution is exempt review under California Environmental Quality Act ("CEQA") pursuant to CEQA Guidehnes Section 15061(b)(3) which provides that CEQA does not apply if it can be seen with certainty that there is no possibility that the activity m question may have a sigmficant effect on the environment, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redlands as follows Section 1 The City Council hereby deletes condition Nos 7 and 10 requiring the construction of street improvements along Center Street from Final Tract Map No 8124, as denoted m the attached agreement dated February 4, 1981 (Exhibit "A"), and terminate the agreement to fund those improvements Section 2 The City Council hereby approves, and authonzes recordation by the City Clerk of, that certam hen release m the form attached hereto as Exhibit "B " ADOPTED, SIGNED AND APPROVED this 19th day of February, 2019 aul W Foster, Mayor ATTEST nne Donaldson, City Clerk 1 L \ca\Reso\7931 Consider waive of construction ofpubhc improvements along Center Street TM 8124.docx I, Jeanne Donaldson, City Clerk of the City of Redlands, do hereby certify that the foregoing Resolution was duly adopted by the City Council at a regular meeting thereof held on the this 19th day of February, 2019, by the followmg vote AYES Councilmembers Barich, Tejeda, Momberger, Davis, Mayor Foster NOES None ABSTAIN None ABSENT None m1e Donaldson, City Clerk 2 L \ca\Reso\7931 Consider waive of construction of public improvements along Center Street TM 8124.docx EXHIBIT "A" AGREEMENT 3 L:\ca\Reso\7931 Consider waive of construction of public improvements along Center Street TM 8124.docx WHEN RECCIRDt0 PC.rt7R.
