HomeMy WebLinkAbout8299RESOLUTION NO 8299 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ADOPTING A MITIGATED NEGATIVE DECLARATION AND MITIGATION MONITORING AND REPORTING PLAN, AND THE PRELIMINARY PROJECT PLANS AND SPECIFICATIONS, FOR THE OAKMONT PARK TRIBUTARY REHABILITATION PROJECT WHEREAS, an Initial Study and Mitigated Negative Declaration ("IS/MND") for the Oakmont Park Tributary Rehabilitation Project (SCH #2021120214) (the "Project") was prepared for the City of Redlands which was circulated for public review for a period of thirty (30) days beginning on December 10, 2021, and ending on January 10, 2022, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS Section 1. CEQA Compliance. The City Council has reviewed and considered the information contained in the IS/MND, and supporting documentation, for the project and determines that the IS/MND and related documents contain a complete and accurate reporting of the environmental impacts and mitigation measures associated with the Project. Section 2. Independent Judgment of Lead Agency. The City Council has exercised independent judgment and analysis in accordance with Public Resources Code Section 21082.1(c)(3) in that the City Council analyzed the IS/MND and accompanying related documents, and finds that the IS/MND reflects the independent judgment and analysis of the City Section 3. Adoption of Mitigated Negative Declaration. The City Council finds on the basis of the whole record that there is no substantial evidence that the Project will not have a significant effect on the environment, with the included mitigation measures and Project design features, and hereby adopts the IS/MND for the Project. Section 4. Adoption of Mitigation Monitoring/Reporting Plan. Pursuant to Public Resources Code Section 21081 6, the City hereby adopts the Mitigation Monitoring/Reporting Plan within the IS/MND, and all mitigation measures will be included as conditions of approval for the Project. Section 5. Project Plans and Specifications. The Preliminary Plans and Specifications for the Project, in substantially the form attached hereto as Exhibit "A," are hereby approved. Section 6. Notice of Determination. The City Council hereby directs staff to file and post a Notice of Determination in accordance with the State CEQA guidelines. Section 7. Effective Date.
