HomeMy WebLinkAbout3048_CCv0001.pdf RESOLUTION NO. 3048 RESOLUTION DECLARING THE INTENTION OF THE COUNCIL OF THE CITY OF REDLANDS TO INITIATE ON ITS OWN MOTION PROCEEDINGS TO ANNEX CERTAIN UNINHABITED TERRITORY - ANNEXATION NO. 50 BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDLANDS: 1. That the Council of the City of Redlands, for the reasons hereinafter mentioned, proposes to initiate on its own motion, as soon as it can legally do so, proceedings to annex to the City of Redlands all of the territory hereinafter described, as uninhabited territory, under provisions of the Annexation of Uninhabited Territory Act of 1939 as set forth in Sections 35300 to 35325 of the Government Code of the State of California. 2 . That this City Council ' s reasons for initiating said annexa- tion proceedings are as follows: this land, contiguous to the City of Redlands and situate in the County of San Bernardino, State of California, will be used for municipal purposes and will contribute to the orderly growth of the city. 3 . That the territory which the Council proposes to annex is hereby identified as "Annexation No. 50" and, consists of all that real property situate in the County of San Bernardino, State of California, described on Exhibit A attached hereto and shown on the map attached hereto as Exhibit B. 4. That the City Clerk of the City of Redlands is hereby directed to file with the Local Agency Formation Commission of the County of San Bernardino, State of California, this resolution that proceedings have been initiated to annex the hereinabove described uninhabited territory to the City of Redlands, to request a report by the Commis- sion provided for in Section 35002 of the Government Code, and to sub- mit and execute such other applications and reports as may be required by law in such annexation proceeding. The application of the American Missionary Society of License Los Tingeles, California, for exemption of business Waiver lico'nse reauirelvlent for door-to-door solicitation within Denied the City ot-' Redlands was denicd on motion of Councilman DeMirjyn, seconded by Coun-cilman Knudsen, by AYE votes of all present. -o,ancil M ntites P� ,` COMMUNICATIONS ------ City Manager Merritt read a letter received from Neste, Brudin & Stone, the engineering firm hired to evaluate the disposal site and prepare an application, to the Regional Water Quality Control Board, The letter des- cribed soil permeability and erosive characteristics which would require very careful monitoring if used as a disposal site, and stated that survey and photogrartrarte-try revealed a limited capability of the site to meet the requirements for use as a regional facility. Councilman Knudsen moved, and Vice Mayor DeYr1irjyn seconded, that the City accept the rescission agreement and authorize cancellation of the escrow, and that the Mavor be author- ized to sign in behalf of the City. In the discussion which followed, Vice Mayor DeMirjyn suggested the Citv seek a smaller site, one to last five x. to eight years. Mayor Cupttm nings stated that he was not anxious to work on a s-maller site. Councilman Sewall pointed out that the environmental quality studies just completed by SCAG indicated that solid--waste recycling will not be avai'l'able for the next fifteen years. n- e agreement was eventuallv adopted by the following roll call vote: AYES: Councilmen DeMirjyn, Knudsen, Mayor Cummings ABSTAIN: Councilman Sewall, who stated that he did not have sufficient information at this point to vote. ABSENT: Councilman Miller Councilman Knudsen read from West's Annotated California Codes, Chapter 6 .5 - Contracts of Sanitation or Sewerage Enterprises, and stated that he believed this chapter related to the original vote on the disposal site, which vote he held to be liltieaal .
