HomeMy WebLinkAbout3177_CCv0001.pdf RESOLUTION NO. 3177 RESOLU'T'ION OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF REDLANDS DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF REDLANDS TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HERE AND DESIGNATED "ANNEXATION DISTRICT NO . 50, " AND GIVING NO'T'ICE OF SUCH PROPOSED ANNEXATION BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF REDLANDS : SECTION ONE: That, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939, " proceedings have been initiated by the Council of the City of Redlands, on its own motion, to annex to the City of Redlands all that uninhabited territory situated in the County of San Bernardino, State of California, hereby designated. as "Annexation District No. 50" and described in Exhibit A attached hereto. SECTION TWO: That the City Council of the City of Redlands desires to annex said uninhabited territory to the City of Redlands for the fol- lowing reasons; The territory is contiguous to the City of Redlands and its proposed annexation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within. the City and within the territory proposed to be annexed; and will provide and facil- itate proper overall planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. SEC'T'ION THREE: That Annexation No. 50 as described in Exhibit A was approved by the Local Agency Formation. Commission at a regularmeet- ing thereof held April 9, 1975, as submitted to said Commission by the Council of the City of Redlands. SECTION FOUR: That May 20, 1975, at the hour of 7:00 P.M. , in the Council Chambers in the Safety Building, 212 Brookside Avenue, in the City of Redlands, County of San Bernardino, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory described in Exhibit A and proposed to be annexed to the City of Redlands, and having any obj circulation published outside the City of Redlands but in the County of San Bernardino, California, the county in which is located the terri- tory proposed to be annexed to the City of Redlands, said publication to be complete at least twenty (20) days prior to the date set for hear- ing. SECTION SIX: The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. SECTION SEVEN: In the event any land within the territory proposed to be annexed is owned by a county, the City Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. SECTION EIGHT: In the event that there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexa- tion. SECTION NINE: The City Clerk is directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law. ADOPTED, SIGNED AND APPROVED this 15th day of April, 1975, by the following vote: AYES: Councilmembers Miller, DeMirjyn, Knudsen, Grace, Mayor Cummings NOES: None ABSENT: None ATTEST: 46yor of the City of Redlands C ' lrk vt APPROVED FOR FORM- City Attorney Resolution No. 3177 Page two Legal Description for Annexation No. 50 to the City of Redlands, County of San Bernardino, State of California: All that portion of Block 12 and Block 19 of Barton Ranch as recorded in Book 6 of Maps, Page 19 in the office of the County Recorder, County of San 'Bernardino, State of California, described as follows : Beginning at the intersection of the northerly prolongation of the West line of the East 1/2 of said Block 12 with the centerline of Colton Avenue (now known as Redlands Boulevard) said inter- section being a point on the City of Redlands boundary line,, thence easterly and southeasterly along said City of Redlands boundary line to the intersection with the northerly prolongation of the East line of that real property as recorded on December 31, 1971 in Book 7826 of Deeds, Page 706 in said office, County aftd State; thence S. 10 00 ' 10" E to the Northeasterly corner of said Deed; thence S. 10 00 ' 10" E. , 182. 96 feet along the East line of said Deed to the Southeasterly corner thereof7 thence N. 790 12 ' 45" W. , to an intersection with the East line of that real property as recorded on November 3 , 1971, in Book 7788 of Deeds, Page 105 in the office of the Recorder of said County; thence South 10 00 ' 10" E. 40.00 feet along said East line to the Southeasterly corner of said Deed; thence N. 790 12 ' 45" W. , 100.00 feet to the Southwesterly corner of said Deed; thence S. 890 35 ' 20" W. , to an intersection with the centerline of Alabama Street; thence southerly along said centerline of Alabama Street to its intersection with a line parallel with the North line of said Block 12, last said parallel line being 450.25 feet as measured northerly along the West line of the East 1/2 of said Block 12 from the intersection of the centerline of Park Avenue with last said West line; thence westerly along said parallel line to its intersection with the west line of the East 1/2 of said Block 12 ; thence northerly along said West line to the point of beginning.
