VALLEY VIEW DRIVE AND VALLEY ROAD IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF VALLEY VIEW DRIVE AND VALLEY VIEW ROAD WHEREAS, the Redlands Planning Commission has adopted its Resolution No 1231 determining that the vacation of Valley View Drive and Valley Road is in conformity with the City's General Plan and recommending approval to the City Council of the City of Redlands ("this City Council"), and WHEREAS, a certified copy of Planning Commission Resolution No 1231 and related material has been forwarded to this City Council, WHEREAS, on November 15, 2016, the City Council held a public hearing and considered the Final Initial Study / Mitigated Negative Declaration together with any connnents received during the public review process, adopted the Final Initial Study / Mitigated Negative Declaration on the basis of the whole record before it and found that there is no substantial evidence that the project will have a significant effect on the environment and that the mitigated negative declaration reflects the lead agency's independent judgement and analysis, and adopted a program for reporting on or monitoring the changes which it has either required in the project or made a condition of approval to mitigate significant envu-onunental effects, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS Section 1 The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and Highways Code of the State of California, and having held a public hearmg as provided therein, hereby finds from all evidence submitted that approximately 161 feet of Valley View Drive as 244 feet of Valley Road, as more specifically described in Exhibit "A" attached hereto and made a part hereof (the "Street), is unnecessary for present or prospective public use and that the public interest and convenience require the vacation of that portion of the Street Section 2 The City Council hereby orders the vacation of a portion of the Street described in the attached Exhibit "A" and depicted on the attached Exhibit "B" Section 3 In connection with the vacation of a portion of the Street described in the attached Exhibit "A", the City of Redlands reserves and excepts from such vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew waterlines, sanitary sewers and storm drains and appurtenant structures, in, upon, over, and across said Street or part of thereof proposed to be vacated and, pursuant to any existing franchises or renewables thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge
