HomeMy WebLinkAbout3679_CCv0001.pdf RESOLUTION NO. 3675 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING ANNEXATION NO. 57-A, LAFC NO. 2004, TO THE CITY OF REDLANDS WHEREAS, the City Council of the City of Redlands did adopt Resolution No. 3678 declaring its intention to annex 122 .48 acres of property contiguous to the City of Redlands, bounded by the existing City Limits on Alabama Street, Lugonia Avenue, I-10, and a line 1, 320 feet from the Center Line of California Street, pur- suant to the District Reorganization Act in accordance with MORGA; and WHEREAS, on April 9, 1980, the Local Agency Formation Commis- sion of San Bernardino County, following appropriate proceedings and public hearing, approved LAFC No. 2004 by adoption of Resolu- tion No. 1644, which approved Annexation No. 57-A, an uninhabited annexation subject to the following conditions: 1. The conducting authority shall not make any changes in the boundaries hereby approved nor shall it impose any new conditions or modify any conditions hereby imposed unless and until it receives the approval of the Local Agency Formation Commission for such changes, modifi- cations, or conditions, pursuant to the procedures prescribed in Section 35162 of the Government Code. 2. The conducting authority shall provide the Local Agency Formation Commission Executive Officer with a certified copy of the resolution calling the hearing and the required number of certified copies of the resolution indicating final disposition of the proposal pursuant to the Government Code Section 35350. 3. The boundaries are approved as set forth in Exhibit A attached hereto. 4 . The conducting authority for this annexation shall be the City of Redlands. 5. The following distinctive short form designation shall be used throughout this proceeding: LAFC 2004 . 6 . The detachment of County Service Area 38, CSA 38 Improve- ment Zone G (fire protection) , County Service Area 70, and CSA 70 Improvement Zone A (weed abatement) without split of assets or liabilities. 7 . The date of issuance of the Certificate of Completion shall be the effective date of this action. WHEREAS, a duly advertised public hearing has been held on Resolution No. 3679 as required by MORGA; and WHEREAS, said hearing produced protests of less than twenty- five percent (250) of the registered voters or property owners in writing; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redlands does hereby order the following : 1. That the territory hereinafter described be and is ordered annexed to the City of Redlands, subject to full compliance with the findings and conditions set forth in Local Agency Formation Commission Resolution No. 1644; 2. That the regular County assessment roll will be used for tax purposes; 3. That the affected property will be taxed for any existing bonded indebtedness and/or contractural obligations equally with the property within_ the City of Redlands; 4 . That the subject territory is hereby detached from County Service Area 38, CSA 38 Improvement Zone G (fire protec- tion) , County Service Area 70, and CSA 70 Improvement Zone A (weed abatement) without split of assets or liabilities; 5. That said territory, the annexation of which to the City of Redlands is herein approved, is all that territory situated in the County of San Bernardino, State of California, and particularly described in the attached Exhibit A. Williams Tract recorded in Book 11, Page 17 , Official Records of San Bernardino County described as follows: Beginning at the intersection of the center lines of Alabama Street and Lugonia Avenue, said intersection being on the City Limits of Redlands; Thence leaving the City Limits of Redlands, west along the center line of Lugonia Avenue 3 , 971 feet to the intersection of the center Line of Lugonia Avenue with the north prolongation of the west line of Lot 2, Block 3, of the Henry L. Williams Tract, said intersection being on the City Limits of Redlands; Thence south along the City Limits of Redlands 718 feet to the center line of Interstation 10 Freeway; Thence leaving the City Limits of Redlands, east along the center line of Interstate 10 Freeway 660 feet to the City Limits of Redlands; Thence continuing along the City Limits of Redlands east 3 ,300 feet to the center line of Alabama Street; Thence north along the City Limits of Redlands, to the POINT OF BEGINNING.
