HomeMy WebLinkAbout7537RESOLUTION NO 7537 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS REMOVING PROPERTY FROM THE CITY'S AGRICULTURAL PRESERVE (AGRICULTURAL PRESERVE REMOVAL NO 121) WHEREAS, the Planning Commission of the City of Redlands has reviewed the proposed Agricultural Preserve Removal No 121 (the "Agricultural Preserve Removal") to remove 23.28 acres from the City -designated agricultural preserve, located on the north side of San Bernardino Avenue, approximately 600 feet east of Judson Street (Assessor's Parcel Nos. 0168-071-04, 05, and 11), and WHEREAS, the City of Redlands has established certain agricultural preserves pursuant to the California Land Conservation Act of 1965, and WHEREAS, the City Council has established criteria for removal of lands from within the City's Agricultural Preserve, and WHEREAS, on May 12, 2015, the Planning Commission held a noticed public hearing on Agricultural Preserve Removal No 121 and considered verbal and written testimony of City staff, the applicant for the proposed agricultural preserve removal, and testimony from members of the public, and WHEREAS, the Planning Commission has recommended to the City Council that Agricultural Preserve Removal No 121 be approved, and WHEREAS on June 9, 2015, December 22, 2015 and June 9, 2016 notices of the City Council public hearings for Agricultural Preserve Removal No 121 was published in the Redlands Daily Facts by the City Clerk, and WHEREAS, on July 7, 2015, July 21, 2015 and June 21, 2016 the City Council held public hearings, and considered the staff written and oral reports, the recommendation of the Planning Commission, the testimony and written evidence submitted by and on behalf of the applicant, and testimony by members of the public, and WHEREAS, following a pubhc hearing on the proposed Agricultural Preserve Removal application, at which this City Council provided opportunity for public testimony, the City Council determined that adoption of the Agricultural Preserve Removal application is in the best interests of the public health, safety and general welfare, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Redlands as follows Section 1. The City Council of the City of Redlands herby determines that the applicant and legal owner of the property designated as Assessor's Parcel Nos. 0168-071-04, 05, and 11 has filed an application in conformity with the Redlands General Plan, that the land I \cclerk\Resolutions\Res 7500-7599\7537 APR 121 docx-1- requested to be removed from the agricultural preserve does not circumvent any contract entered into pursuant to the California Land Conservation Act of 1965, and that the removal of the property will not adversely impact the City's goal of discouraging premature and unnecessary conversion of agricultural land to urban uses, and will not encourage discontinuous urban development patterns that unnecessarily increase the cost of community serves to Redlands' citizens Section 2.
