HomeMy WebLinkAbout5603_CCv0001.pdf RESOLUTION NO. 5603 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS ORDERING TERRITORY ANNEXED TO THE CITY OF REDLANDS LAFCO NO. 2839B -ANNEXATION NO. 76B WHEREAS, this action is being taken pursuant to the Cortese/Knox Local Government Reorganization Act of 1985 (commencing with Section 56000 of the California Government Code); and WHEREAS, the Local Agency Formation Commission of the County of San Bernardino (LAFCO) adopted its Resolution No. 2628 on January 20, 1999, snaking determinations and approving the proposed annexation of territory comprised of approximately 10 acres generally located at the southeast corner of Wabash and Sixth Avenues more particularly described in Exhibits "A" and "A-1," attached hereto and by this reference incorporated herein; and WHEREAS, the terms and conditions of annexation as approved by the LAFCO, and contained in LAFCO Resolution No. 2628, are as follows: "Condition No. 1. The conducting authority for this proceeding shall be the City of Redlands (hereinafter referred to as 'the City'). Condition No. 2. The boundaries are approved as set forth in Exhibits "A" and "A-I" attached. Condition No. 3. The following distinctive short-form designation shall be used throughout this proceeding: LAFCO 2839B. Condition No. 4. All previously authorized charges, fees, assessments, and/or taxes currently in effect by the City (annexing agency) shall be assumed by the annexing territory in the same manner as provided in the original authorization pursuant to Government Code Section 56844(t). Condition No. 5. Approval is hereby granted to proceed without notice, hearing or election with 100%property owner consent. Condition No. 6. The City agrees to indemnify, defend, and hold harmless the San Bernardino County Local Agency Formation Commission from any legal expense, legal action, or judgment arising out of the Commission's approval of this proposal, including any reimbursement of legal fees and costs incurred by the Commission. Condition No. 7. The date of issuance of the Certificate of Completion shall be the effective date of this annexation;" and Resolution No. 5603 Page i of 4 WHEREAS, the reasons for this annexation are: the annexation of this territory will contribute to the orderly growth of the City of Redlands; insure the proper use of land in conformity with the General Plan of the City of Redlands; and will benefit from the full range of services available from the City of Redlands as evidenced by the City of Redlands' Plan for Services reviewed by the LAFCO. This proposal and its anticipated effects conform with adopted LAFCO policies and directives of law; and WHEREAS, the regular County of San Bernardino assessment roll is utilized by the City of Redlands; and WHEREAS, the affected territory will be taxed for existing general bonded indebtedness and contractual obligations of the City of Redlands; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Redlands hereby orders the territory described in Exhibits "A" and "A-1" annexed, and directs the City Clerk to transmit five certified copies of this resolution with applicable fees required by Section 54902.5 of the California Government Code to the Executive Officer of the San Bernardino County Local Agency Formation Commission, ADOPTED, SIGNED AND APPROVED this 16th day of February, 1999. Y ayt�r o -the City o land alifamia ATTEST: City erk 1, Lorrie Poyser, City Clerk of the City of Redlands, California, do hereby certify that the foregoing resolution was duly adopted by the City Council at a regular meeting thereof held on the 16th day of February, 1999, by the following vote: AYES: Councilmembers Banda, Gilbreath, Freedman, George; Mayor Cunningham NOES: None ABSENT: None City Clerk "`ity of Rel d , California Resolution No. 5603 Page 2 of 4 LEGAL DESCRIPTION FOR ANNEXATION NO. 76B That portion of Lot 2, Block 27 of the Crafton Tract, recorded in Book 3 of Maps, Page 14, records of San Bernardino County in the State of California, more particularly described as follows: Beginning at the intersection of the centerline of Sixth Avenue and the centerline of Wabash Avenue, said centerline also being the existing city limit line of the City of Redlands, and said point being the point of beginning; Thence East, 658.30 feet along the centerline of Sixth Avenue to the intersection with the northerly prolongation of the east line of Lot 2, Block 27 of the Crafton Tract; Thence South, 660.90 feet along last said east line to the southeast corner of said Lot 2; Thence West, 658.30 feet along the southerly line of said Lot 2, to a point on the centerline of Wabash Avenue, last said centerline also being the existing city limit line of the City of Redlands; Thence North 660.90 feet along the existing city limit line of the City of Redlands to the intersection with the centerline of Sixth Avenue, last point also being the point of beginning.
