HomeMy WebLinkAbout2849_CCv0001.pdf RESOLUTION No. 2849 RESOLUTION OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF REDLANDS DE- CLARI'NG THAT PROCEEDINGS HAVE BEEY iNTTIATTED 3Y THIE COUNCIL OF THE CITY OF REDLANDS TO AN14EX TO SATD CITE CERTAIN UNINHABITED TERRITORY DESCRIBED HERE AND DESIGNATED "A NEXATION DISr1HRIMP N-10� '15, " AND GIVING _2MOTTCE Or SUCH PROPOSED A14-NEXIATION BE IT RESOLVED BY THE MAYOR A114D THE CITY COUNCIL OF THE CITY OF R E D L A LN D S: SECTION ONE: That, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939, " proceed-ngs have been initiated by the Counc=il Of the City of Redlands, on its own" motion, to annex to the City of Redlands all that unirihzibited territory situated in the County of San Bernardino, State of California, hereby designated as "Annexation DIStrict. NNo. 45" and described as fol luvis: All of Block 23 of a portion of the Barton Ranch as per map recorded in Book 6, Page 19, in the office of the County Recorder, County ot- San Bernardino, State of California, and a portion of Lot 3 and Lots 4 and 5 in Block 27 of a portion of West Redlands per map recorded in Book 9, Page 22 in the office of the County Recorder, County of San Bernardino, State of California, more particularly described as follows: Beginning at the centerline intlersec,tion of Kansas Street, 80 feet wide, and Orange Avenue, 50 feet wide; thence easterly along the centerline of orange Avenue to the centerline of Tennessee Street, 80 feet wide; thence soi;-.therly along t-l-le cen- terline of Tennessee Street and the centerline of Tennessee Street produced to the north line of Section 33, TIS , R3W, S .B,B,M. ; thence easterly along the north line of said Section 33 to the north 1/4 corner of said Section 33. Thence southerly along the east line- of the northwest 1/4 of sa.id Section 33 to the center- line of Brookside Avenue, 100 feet wide, thence south-westerly along the centerline of Brookside A-.,7enue to the centerline of Barton Road, 80 -feet wide; thence westerly along the centerline of Barton Road to its intersection with tfie prolongation of the centerline of Kansas Street.; thence northerly along the prolonga- tion of the centerline of Kansas Street and the centerline of Kansas Street to the Point of Beginning. SECTION TWO: That the City Council Of the City of Redlands desires to annex said uninhabited territory to the City of Redlands for the fol- lowing reasons: The territory Is contiguous to the City- of Redlands and its proposed annexation w,11- 11L contribute to and facilitate the orderly qrowt','-, and development of both -he City and the territory proposed to be annexed; wili facilitate and contribute to the proper and order!'V V layout, de8iQn and construction of streets, gutt-t-ers, sidewalks, sanitary and sto.-M %,"a-l-er sewers and, drainage facilities, both w= thin the City and wi thin the territory p=roposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands , and s-tabdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhab-L-t-ed territorv,. SECTION THREE: That Annexation No. 45 as above described was ap- proved by the Local Agency Formation commission at a regular meeting thereof held November 25, 1970, as submitted to said Commission by the Council of the City of Redlands . SECTION POUR: That September 21,-. 19:71 at the hour of 7: 00 P.M. , in. the Council Chambers in the Safety Building, 212 Brookside Avenue, in the City of Redlands, County of San Bernardino, California, is hereby fixed as the time and place when and where any person owning real property with- in the uninhabited territory described above and proposed to be annexed to the City of Redlands, and having any objections to the proposed annexa- tion, may appear before the Council of the City of Redlands and show cause why such uninhabited territory should not be so annexed to said City of Redlands. Such protest must be in writing, may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description and area of such property, in general terms . SECTION FIVE: The City Clerk of the City of Redlands is hereby authorized and directed to cause a copy of this resolution to be pub- lished at least twice, but not oftener than once a week, in the Redlands Daily Facts, a newspaper of general circulation published in said City of Redlands, the city to which it is proposed to annex the aforesaid terri- tory, and also in the San Bernardino Sun, a newspaper of general circula- tion published outside the City of Redlands but in the County of San Bernardino, California, the county in which is located the territory pro- posed to be annexed to the City of Redlands , said publication to be com- plete at least twenty (20) days prior to the date set for hearing. SECTION SIX: The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assessment roll available on the date above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the Clerk, such notice to be given not less than twenty (20) days before the first public hear- ing on the proposed annexation. SECTION SEVEN: in the event any land within the territory proposed to be annexed is owned by a county, the city Clerk is directed to cause written notice of such proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. SECTION E1G9T: in the event that there is, upon the land proposed to be annexed, a structural improvement owned, being acquired or leased by a county fire protection district, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body, of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation, Resolution No. 2849 Page two SECTTON NINE: The City Clerk A directed to cau8e written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
