HomeMy WebLinkAboutContracts & Agreements_34-2022FOURTH AMENDMENT TO AGREEMENT TO PERFORM PROFESSIONAL SERVICES This fourth amendment ("Fourth Amendment") to the agreement for the preparation of an environmental site assessment for the city of Redlands' Alabama Street septic disposal ponds dated October 30, 2018 ("Agreement"), by and between the City of Redlands, a municipal corporation and general law city ("City"), and Rincon Consultants, Inc., a California corporation ("Consultant"), is made and entered into this 15th day of March, 2022. RECITALS WHEREAS, it is the desire of City and Consultant to amend Exhibit "A" of the Agreement, titled "Scope of Services," to increase the scope of services to include those described in Exhibit "1," which is attached hereto and incorporated herein by reference; and WHEREAS, it is the desire of the City and Consultant to amend Article 5 1 of the Agreement to increase Consultant's total compensation of Three Hundred Thirty Four Thousand Six Hundred Thirty Five Dollars ($334,635) to the amount of Three Hundred Eighty Two Thousand Eight Hundred Eight Five Dollars ($382,885), NOW, THEREFORE, for good and valuable consideration in the receipt of which is hereby acknowledge City and Consultant agree as follows. AGREEMENT Section 1 The scope of work performed by Consultant pursuant to Exhibit "A" of the Agreement, titled "Scope of Services," is hereby amended to include the work that is identified in Exhibit "1," which is attached hereto and incorporated herein by this reference. Section 2. Section 5 1 of the Agreement, titled "Payment to Consultant," is hereby amended to read as follows. "5 1 Total compensation for Consultant's performance of the Services shall not exceed the amount of Three Hundred Eighty Two Thousand Eight Hundred Eight Five Dollars ($382,885) City shall pay Consultant on a time and materials basis up to the not to exceed amount, in accordance with Exhibit "B," titled "Cost Proposal," which is attached hereto and incorporated herein by this reference." Section 3. By Torin Snyder, Principal EXHIBIT "1" SCOPE OF SERVICES The changes to the scope of work are described below Septage Ponds Sub -surface Investigation Task 4. Soil and Groundwater Investigation Rincon will conduct the soil and groundwater investigation consistent with the RWQCB-approved Work Plan The soil and groundwater investigation will include the following elements: Health and Safety Plan: No changes are anticipated with respect to costs of preparation of a Health and Safety Plan Initial Proposal Budget $430 Additional Budget $ - Total Budget $430 Boring Mark -outs and USA Notification. Because installation of groundwater monitoring wells will occur more than 14 days after Utility Services Alert (USA) notification associated with the soil sampling scope of work, an additional mark -out will be required Initial Proposal Budget $840 Additional Budget $250 Total Budget $1,090 Permitting: San Bernardino County Well Permits require information pertaining to well construction and drilling activities. As such, a new San Bernardino County Well Permit will be required prior to mobilizing for well installation activities. Initial Proposal Budget $1,972 Additional Budget $1,100 Total Budget $3,072 Monitoring Well Installation, Well Development, Groundwater Sampling and Soil Sampling: Additional costs associated with monitoring well installation, well development, groundwater sampling, and soil sampling include increased drilling costs based on revised methods (i.e , air rota' y t�sii hammer (ARCH) and sonic drill rigs) (revised quote was provided January 2022) Initial Proposal Budget + August 2021 Addendum $182,030 Additional Driller Costs $33,600 Additional Labor Cost $5,350 Total Additional Cost - $38,950 Total Budget $217,330 Soil and Groundwater Sample Analysis: No additional costs are anticipated at this time Initial Proposal Budget + August 2021 Addendum $33,140 Additional Groundwater Analytical $ - Additional Soil Analytical $ - Total Additional Cost $ - Total Budget $33,140 :dived Waste. In the initial proposal, it was assumed that groundwater monitoring well installation would occur within the same time period as soil sampling activities; therefore, rental of the roll -off bins was assumed for a shorter period of time. In addition, administrative project management costs are included in this task.
