A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
REDLANDS AUTHORIZING DESIGNATION OF APPLICANT'S
AGENT TO OBTAIN FEDERAL AND NATURAL DISASTER
ASSISTANCE ACT FINANCIAL ASSISTANCE (FEMA-3140-
EM/NDAA-99-05-SEVERE FIRES).
WHEREAS, in accordance with Chapter 7 of Division 1 of Title 2 of the
Government Code of California, the Governor proclaimed that a State of Emergency (NDAA-99-
05) exists in the counties of Butte, Plumas, San Bernardino, Shasta, Tehama, and Tuolomne as
a result of the recent fires in California;
WHEREAS, the Governor's proclamation makes state financial assistance available
to local governments, including counties, cities and special districts;
WHEREAS, in addition, the President signed a federal Emergency Declaration
(FEMA-3140-EM) authorizing the Federal Emergency Management Agency (FEMA) to provide
federal assistance as authorized under Title V of the Robert T. Stafford Disaster Relief and
Emergency Assistance Act, P. L. 93-288 as amended for the counties listed above;
WHEREAS, under the federal emergency declaration, overtime for emergency
response personnel and the removal of fire related debris (that poses a health and safety hazard
to the general public) are eligible for federal assistance;
WHEREAS, said procedures established by the Federal Emergency Management
Agency and the State of California Governor's Office of Emergency Services require the applicant
to certify by resolution the designation of applicants' agents; and
WHEREAS, said application contains assurances that the applicant must comply
with; and
WHEREAS, the applicant will enter into a contract with the Federal Emergency
Management Agency and the State of California to recover costs of identified damages;
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby:
1. Approves the filing of an application for financial assistance under Chapter
7, Division 1 of Title 2 of the Government Code of the State of California
(Natural Disaster Assistance Act) and Title V of the Robert T. Stafford
Disaster Relief and Emergency Assistance Act, P. L. 93-288 as amended;
2. Certifies that said applicant understands the assurances in the application
form;
3. Certifies that said applicant has or will have sufficient funds to operate and
maintain the project(s);
4. Authorizes Mary Petite, Cost Recovery Administrator, Mel Enslow, Fire
Chief, and John Habant, Deputy Fire Chief to execute for and on behalf of
the City of Redlands, a public entity established under the laws of the State
of California, this application and to file it in the Office of Emergency
Services to obtain financial assistance under Chapter 7, Division 1 of Title
2 of the Government Code of the State of California (Natural Disaster
Assistance Act) and Title V of the Robert T. Stafford Disaster Relief and
Emergency Assistance Act, P. L. 93-2$8 as amended, for costs incurred
because of severe fires;
S. That the City of Redlands, a public entity established under the laws of the
State of California, hereby authorizes its agent(s) to provide to the Federal
Emergency Management Agency and the State Office of Emergency
Services for all matters pertaining to such state disaster assistance the
assurances and agreements required.
