HomeMy WebLinkAbout8325RESOLUTION NO 8325 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS APPROVING A HISTORIC PARKING MODIFICATION NO 31 IN CONNECTION WITH THE ADAPTIVE REUSE OF THE PROPERTY LOCATED AT 1605 CALVARY CIRCLE WHEREAS, Guadalupe Cobanov ("Applicant") has filed applications for Amendment No 47 to Specific Plan No 40, Conditional Use Permit No 1107, Variance No 799, Historic Parking Modification No 31, and Historic Resource Designation No 135 for an adaptive reuse project to establish a medical office use in a residential building, and construct a 1,238 square foot two-story addition, with associated improvements (collectively, the "Project") located at 1605 Calvary Circle (the "Property") (San Bernardino Assessor's Parcel No 0293-133-13-0000), and WHEREAS, Historic Parking Modification No 31 is a request to reduce the landscaping planter width from 5'0" to 3'0", reduce the driveway width from 26'0" to 20'4", waiving loading space requirements, allow four (4) compact parking stalls for the adaptive reuse of the structure as a medical office, and WHEREAS, on February 22, 2022, the Planning Commission held a public meeting and considered the staff report, oral report, the testimony, and the written evidence submitted by and on behalf of the Applicant; and WHEREAS, on February 22, 2022, the Planning Commission recommended to the City Council that Variance No 799 be approved, and WHEREAS on April 8, 2022, notice of the City Council's public hearing for the Amendment was published in the Redlands Daily Facts by the City Clerk; and WHEREAS, on April 19, 2022, the City Council held a public hearing and considered the staff written and oral reports, the recommendation of the Planning Commission, the testimony and written evidence submitted by and on behalf of the applicant, and testimony by members of the public, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS Section 1. The City Council hereby determines that approval of the Project and this Resolution approving Historic Parking Modification No 31 are exempt from review under the California Environmental Quality Act ("CEQA") pursuant to Sections 15061(b)(3), 15301, 15305, and 15331 of the State's CEQA Guidelines. Section 2 The City Council of the City of Redlands hereby approves Historic Parking Modification No 31 for the Project subject to the conditions of approval identified in Exhibit "A" of this Resolution, and based upon the following findings 1 L:\ca\Reso\8325 Cobanov I-Iistoric Parking Modification No. 31.docx.jn A. The proposed parking modification and use of the historic structure is necessary or desirable for the development of the community, is in harmony with the various elements and objectives of the general plan, and is not detrimental to existing uses or to uses specifically permitted in the zone, The parking modification is necessary to ensure the adaptive reuse of the existing single family dwelling as a medical office will be able to meet their minimum parking requirement on -site The use of the historic structure as a medical office is necessary and desirable for the development of the community, as it allows the property to transition to a use permitted by right in the zoning designation. It is in harmony with the various elements and objectives of the general plan, which encourage appropriate adaptive reuse projects, and is not detrimental to existing uses or uses specifically permitted in the zone With the parking modification, as proposed, the Project will not require a reduction in parking stalls, will not need to rely on parking located within the public right-of-way or rely on off -site parking agreements. B That approving the proposed parking modification and use will significantly improve the possibility that the structure will be preserved and maintained as a historic structure, The approval of the parking modification will significantly improve the possibility that the structure will be preserved and maintained as a historic structure The property, as part of the Project as a whole, is requesting historic designation. Additionally, the Project will allow the conversion of the property to a medical use, complete the rehabilitation to the existing building, and allow the building, which has been vacant for several years, to be occupied by a new office tenant. C That the required parking cannot be provided without the approval of the requested modification, The Project's ability to meet the required parking is contingent on the approval of the historic parking modification, as requested. Due to the limitations of property size and configuration, as well as the limited available area to construct parking and landscaping improvements, the more flexible regulations under the modification will allow the property to comply with requirements and meet their minimum parking requirements D That all on -site parking lots will function safely, The on -site parking lot will function safety All parking stalls meet the minimum requirements for standard and compact parking stalls in the RMC, and the drive aisle will comply with the 26 foot minimum requirement for 2-way traffic The design has also been reviewed by the City's Municipal Utilities and Engineering Department and Fire Department. 2 L:\ca\Reso\8325 Cobanov Historic Parking Modification No. 31.docx.jn E That approval of the parking modification will not harm the integrity of the historic structure or the surrounding neighborhood, The parking modification will not harm the integrity of the historic structure or the surrounding neighborhood, as the Project has been designed in accordance with the Secretary of the Interior's Standards for the Treatment of Historic Properties and provides flexibility in parking standards to ensure the integrity may be maintained Section 3. Effective date. Allow a reduction in the width of landscape planters to 3 feet B Allow up to 4 compact parking stalls, without requiring twenty five full sized spaces C Allow for the deletion of the loading space requirements for historic structures having less than 6,000 square feet of gross floor area, D Allow the reduction of driveway approach from 26 feet to approximately 20'4" feet. 4 All plans submitted to the City shall reflect Planning Commission approval and any other changes required by the Commission and/or staff. 5 A building permit shall be obtained prior to the construction of any structure 6 No Certificate of Occupancy or finaled building permit shall be granted until all conditions of approval have been satisfied. 7 The applicant shall not make any modifications or changes during construction that are in conflict or contrary to the project's approved site design without first consulting with the Development Services Director or his designee. 8 The applicant for this subdivision, and its successors and assigns, shall defend, indemnify and hold harmless the City of Redlands, and its elected officials, officers, agents and employees, from and against any and all claims, actions, and proceedings to attack, set aside, void or annul the approval of this permit by the City, or brought against the City due to acts or omissions in any way connected to the applicant's project that is the subject of this permit. This indemnification shall include, but not be limited to, damages, fees, costs, liabilities, and expenses incurred in such actions or proceedings, including damages for the injury to property or persons, including death of a person, and any award of attorneys' fees In the event any such action is commenced to attack, set aside, void or annul all, or any, provisions of this permit, or is commenced for any other reason against the City for acts or omissions relating to the applicant's project, within fourteen (14) City business days of the same, the applicant shall file with the City a performance bond or irrevocable letter of credit (together, the "Security") in a form and in an amount satisfactory to the City, to ensure applicant's performance of its 5 L:\ca\Reso\8325 Cobanov Historic Parking Modification No. 31.docx.jn defense and indemnity obligations under this condition. The failure of the applicant to provide the Security shall be deemed an express acknowledgement and agreement by the applicant that the City shall have the authority and right, without objection by the applicant, to revoke all entitlements granted for the project pursuant to this permit.
