Members of City Council
SUBJECT: RESOLUTION NO. 3411 , BUILDING MORATORIUM
The attached Resolution No. 3411 shows the resolution
as approved by the Council at the meeting Tuesday
evening. Should the resolution remain in its present
form, it would permit over 986 units to escape the
moratorium and water connection fees because plans are
in plan check. Some of the plans are actually for
tracts that have not gone final . Mr. Knudsen, oil re-
viewing the resolution, states that it was his intent
that paragraph 4-b simply further explain paragraph 4-a.
The special council meeting is for the express purpose
of rescinding Resolution No. 3411 and adopting Resolution
No. 3412 which reflects the true intent of Mr. Knudsen 's
changes to Resolution No. 3411 - We have also carefully
reviewed all the wording and changed the arrangement of
data in paragraphs to make the document easier to read
and understand. It has been carefully reviewed with
Bill Schindler and Jack Shefchik.
For your information, the clerk advises that the only
item that can be discussed during the meeting is this
resolution. In addition, no discussion from the floor
should be permitted.

RESOLUTION NO. 3411
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
TEMPORARILY PROHIBITING THE ISSUANCE OF PERMITS OR APPLI-
CATIONS FOR RESIDENTIAL CONSTRUCTION AND BUILDING UNTIL
THE FIRST COUNCIL MEETING In APRIL, 1978, OR AT AN EARLIER
DATE IF STUDIES CONTEMPLATED ARE COMPLETED I-ND DECLARING
THIS TO BE AN EMERGENCY RESOLUTION.
THE CITY COUNCIL OF THE CITY OF REDLANDS DOES HEREBY RESOLVE
AS FOLLOWS :
WHEREAS, this City Council of the City of Redlands finds and
determines that the protection of the public health, safety, and
welfare of the people of Redlands requires the cessation of any
land uses that may be in conflict with contemplated zoning proposals
or plans which this legislative body, the Planning Commission, or
the Planning Department are considering or intending to study im-
mediately; and
WHEREAS, the City intends to employ a professional planning
consultant for the purpose of studying overall zoning and develop-
ment of the City of Redlands; and it is appropriate and proper to
prevent any developments that may cause significant or irreversible
environmental impacts upon zoning of land uses within the City of
Redlands.
WHEREAS, a temporary moratorium on the issuance of permits for
the construction of new single and multiple family dwelling units
during the time of the study would deter and negate the purposes and
effects of such a study; and
WHEREAS, a temporary moratorium on the issuance of permits for
the construction of new single and multiple family dwelling units
is necessary to preserve the public safety, health and welfare.
THE CITY COUNCIL OF THE CITY OF REDLANDS DOES HEREBY RESOLVE
AS FOLLOWS:
1. The Building Department and Planning Department of the City
of Redlands is ordered to not issue any permits for building
and construction or to act upon any application for condi-
tional use permits related to residential uses, subdivisions
or any other means of property division or development to
any areas presently zoned as follows : R-2 , R-2-2000, R-3,
R-1, R-1-D, R-S, R-E, R-A, A-2 , A-1 , and such residential
uses as are permitted in the A-P zone.
2. Nothing herein contained shall prohibit the issuance of per-
mits for commercial or industrial developments or additions
to, or the remodeling, alteration, repair or rehabilitation
of existing residential buildings in the residential zones
or the processing or issuance of permits for construction in
other than residential zones.
3. In order to promote the orderly development of the City
of Redlands and to promote the public health, safety, and
welfare, the City Council hereby finds it necessary to
review various laws, ordinances, rules and regulations
pertaining to zoning, planning, building construction and
density, and requires sufficient time to meet such needs .
Therefore, the City Council declares this matter to be a
measure of extreme urgency and that the prohibition of
the issuance of building permits and approval of their
applications as specified herein for the period extending
until the first council meeting of April, 1978 is reason
able and necessary unless the Council finds otherwise at
an earlier date by reason of such studies- By reason of
such urgent conditions and circumstances, this resolution
shall be effective irunediately upbn its adoption and the
same shall be posted as prescribed by law.
4. This moratorium shall not apply to the following:
a) Existing lots which were finally approved and of
record prior to January 1, 1977 and where no more
than .three lots were under one ownership prior to
